Biden walked down memory lane again this month when Congress reauthorized the Violence Against Women Act (VAWA). \u201cMy dad would say the greatest sin of all, that anyone could commit was the abuse of power, and the cardinal sin was for a man to raise his hand to a woman or a child,\u201d he reminisced.<\/p>\n<p>Unfortunately, <a href=\"https:\/\/www.dailywire.com\/news\/this-isnt-a-mandate-biden-admin-says-of-new-osha-covid-19-mandate\">the Biden administration<\/a> commits both of his dad\u2019s cardinal sins. In its haste to avoid enforcing the law, the Biden administration has issued guidelines that make officials <em>less <\/em>likely to deport illegal immigrants guilty of domestic violence.<\/p>\n<p>The official guidance comes in a <a href=\"https:\/\/www.ice.gov\/doclib\/news\/guidelines-civilimmigrationlaw.pdf\">memo<\/a> from DHS Secretary Alejandro Mayorkas, and essentially makes federal guidelines on the topic fuzzier. \u201cFederal government officials have broad discretion to decide who should be subject to\u201d removal proceedings, the memo states. While a \u201cnoncitizen who poses a current threat to public safety\u201d is \u201ca priority for apprehension and removal,\u201d whether someone poses such a threat is \u201cnot to be determined according to bright lines or categories.\u201d<\/p>\n<p>One might think being accused of abusing women or children would create a sufficiently bright line, but the Biden administration\u2019s guidance is not so bright. \u201cThe broader public interest is also material in determining whether to take enforcement action\u201d against domestic abusers, Mayorkas wrote. \u201cFor example, a categorical determination that a domestic violence offense compels apprehension and removal could make victims of domestic violence more reluctant to report the offense conduct. The specific facts of a case should be determinative.\u201d<\/p>\n<p>As <a href=\"https:\/\/www.townandcountrymag.com\/leisure\/arts-and-culture\/a32947129\/how-perry-mason-hbo-tv-different-from-original\/\">Perry Mason<\/a> might say, \u201c<a href=\"https:\/\/thelegalseagull.com\/blogs\/news\/5-common-objections-in-court-you-should-master\">Objection: Calls for speculation<\/a>!\u201d How can any Border Patrol agent know whether removing an illegal immigrant \u201ccould\u201d make someone \u201cmore reluctant\u201d to report an abuser? Risk-averse government employees (a redundant phrase, to be sure) could simply stop deporting everyone who falls into this category.<\/p>\n<p>This is far from a theoretical concern. Senator John Cornyn (R-TX) <a href=\"https:\/\/www.cornyn.senate.gov\/content\/news\/cornyn-amendment-would-require-deportation-illegal-immigrants-convicted-domestic\">noted<\/a> that, in Fiscal Year 2020, \u201cillegal immigrants administratively arrested by ICE Enforcement and Removal Operations had the following convictions and charges related to domestic violence\u201d:<\/p>\n<ul>\n<li>Sexual assault: 3,051 convictions, 1,334 charges<\/li>\n<li>Sex offenses generally: 4,184 convictions, 1,733 charges<\/li>\n<li>Family offenses: 2,336 convictions, 1,880 charges<\/li>\n<\/ul>\n<p>Cornyn introduced an <a href=\"https:\/\/www.congress.gov\/congressional-record\/2021\/08\/10\/senate-section\/article\/S6296-1\">amendment<\/a> to the Democrats\u2019 $3.5 trillion budget that would call for the \u201cdetention and removal of aliens \u2026 convicted of crimes of domestic violence, sexual assault, dating violence, or stalking, as those terms are defined [by] the Violence Against Women Act of 1994.\u201d<\/p>\n<p>The decision not to deport criminal aliens guilty of domestic violence puts the Biden administration to the Left of the Obama-Biden administration. In 2014, then-DHS Secretary Jeh Johnson <a href=\"https:\/\/www.dhs.gov\/sites\/default\/files\/publications\/14_1120_memo_prosecutorial_discretion.pdf\">issued<\/a> his set of \u201cPolicies for the Apprehension, Detention and Removal of Undocumented Immigrants\u201d \u2014 \u201cThe Johnson Memo\u201d \u2014 which established tiers of offenses for deportation. After the most egregious offenders, such as those posing a threat to national security, Johnson prioritized \u201caliens convicted of a \u2018significant misdemeanor,\u2019 which for these purposes is an offense of domestic violence; sexual abuse or exploitation,\u201d and crimes such as drug trafficking that inflict specific and measurable harms.<\/p>\n<p>The policy also sets the Biden administration at odds with itself. Last June, Attorney General Merrick Garland made suffering from domestic violence <a href=\"https:\/\/www.politico.com\/news\/2021\/06\/16\/asylum-standards-biden-494918\">grounds<\/a> for foreigners to claim asylum in the United States. That indicates the Biden administration considers domestic violence an especially egregious crime \u2014 because it goes well beyond the controlling law, the <a href=\"https:\/\/uscode.house.gov\/view.xhtml?req=granuleid:USC-prelim-title8-section1227&#038;num=0&#038;edition=prelim\">Immigration and Nationality Act<\/a>. The INA allows would-be immigrants to apply for asylum if they are persecuted based on their membership in a specific <em>group<\/em>: race, religion, nationality, social group, or political views. As sympathetic as domestic violence victims may be, they can likely find safety well short of moving to the United States \u2014 e.g., by moving to another house, another town, or a nation in closer geographic proximity than the U.S.<\/p>\n<p>Similarly last July, the Biden administration \u2014 relying on the work of Vice President Kamala Harris as border czar \u2014 issued its \u201cStrategy to Address the Root Causes of Migration in Central America.\u201d The <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2021\/07\/29\/fact-sheet-strategy-to-address-the-root-causes-of-migration-in-central-america\/\">fifth pillar<\/a> of Harris\u2019 master plan to curtail illegal immigration reads: \u201cCombating sexual, gender-based, and domestic violence.\u201d<\/p>\n<p>Certainly, Joe Biden has presented himself as an ardent defender of women. On the campaign trail, candidate Biden famously promised to keep \u201c<a href=\"https:\/\/nypost.com\/2019\/11\/20\/democratic-debate-joe-biden-says-we-need-to-keep-punching-at-domestic-violence\/\">punching at<\/a>\u201d domestic violence. President Biden has <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/speeches-remarks\/2022\/03\/16\/remarks-by-president-biden-celebrating-the-reauthorization-of-the-violence-against-women-act\/\">boasted<\/a> about writing the original <a href=\"https:\/\/www.heritage.org\/gender\/commentary\/violence-against-woman-act-back-its-still-no-better-here-are-its-5-biggest-flaws\">Violence Against Women Act<\/a>. Yet his administration has essentially created a safe harbor for domestic abusers, which is particularly troubling, since domestic abusers have a high recidivism rate. As many as <a href=\"https:\/\/www.uscourts.gov\/sites\/default\/files\/72_3_6_0.pdf\">41% of abusers<\/a> will be rearrested within two years.<\/p>\n<p>\u201cIf Biden promised to protect victims of domestic violence in the United States, Garland removed limitations on asylum for victims of domestic violence abroad, and Obama and Johnson made alien domestic abusers a priority for \u2018apprehension, detention, and removal,\u2019 why is Mayorkas elliptically telling ICE officers not to go after aliens who engage in domestic violence?\u201d asked Arthur. \u201cI have no idea, but it is the sort of crime that ICE officers should be targeting.\u201d<\/p>\n<p>The Biden administration\u2019s inversion of domestic violence priorities shows how Democrats have radicalized themselves on illegal immigration. Apparently in the Democrats\u2019 world, the fact that these criminals committed immigration crimes erases their guilt for committing violent crimes.<\/p>\n<p>The irony has likely not been lost that Democrats spent the <a href=\"https:\/\/www.usnews.com\/debate-club\/is-there-a-republican-war-on-women\/democrats-war-on-women-rhetoric-is-insulting-and-disingenuous\">2012<\/a> and <a href=\"https:\/\/therightswriter.com\/2014\/11\/listen-democratic-operative-says-war-on-women-rhetoric-left-women-feeling-manipulated\/\">2014<\/a> election cycles accusing Republicans of waging a \u201cwar on women.\u201d Where are the feminist concerns over illegal immigrants exuding \u201ctoxic <em>machismo<\/em>\u201d? Leftists\u2019 silence calls into question their moral commitment and seriousness.<\/p>\n<p>\u2026 Or it reveals their commitment to illegal immigration. President Biden already <a href=\"https:\/\/www.dailywire.com\/news\/how-joe-biden-effectively-ended-deportations\">effectively ended deportations<\/a>. He has since <a href=\"https:\/\/www.dailywire.com\/news\/officials-bracing-for-18000-migrants-per-day-if-title-42-is-rescinded-republicans-slam-biden-admin-for-national-security-threats\">rescinded<\/a> Title 42, which has allowed Border Patrol agents to repel more than half of all would-be illegal immigrants since the beginning of the Biden administration. Agents warn they find themselves overwhelmed and unable to secure the border. \u201c<a href=\"https:\/\/www.dailywire.com\/news\/this-is-by-design-this-is-not-accidental-did-democrats-dismantle-border-security-on-purpose\">This is by design<\/a>,\u201d said Senator James Lankford (R-OK) recently. \u201cThis is not accidental. The policies that have been put in place at the border are to encourage people to cross the border knowing full well they won\u2019t actually be deported.\u201d<\/p>\n<p>Whatever Biden\u2019s reasons, his administration has prioritized illegal immigration over the basic health and safety of women. His apparent indifference to their abuse, pain, and victimization shows the callous calculus guiding Democrats\u2019 concerted effort to throw our borders open for their perceived political gain.
