Version: 4.0.47--><div><\/div>\n<div class=\"RichTextArticleBody\">\n<div class=\"RichTextArticleBody-body\">\n<p><span class=\"ArticlePage-articleBody-firstLetter\">A<\/span>n agency believed to be the CIA concluded the data underpinning certain Trump-Russia <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/democratic-lawyer-sussmann-fights-durham-use-of-fbi-expert-testimony-on-alfa-bank-data-accuracy\">collusion allegations<\/a> was not \u201ctechnically plausible\u201d by early 2017, casting <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/durham-sussmann-put-his-lie-to-the-fbi-in-writing\">further doubt<\/a> on claims <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/jake-sullivan-promoted-alfa-bank-story-center-durham-indictment\">pushed<\/a> by the Clinton campaign before the 2016 election.<\/p>\n<p>Democratic cybersecurity lawyer Michael Sussmann was <u><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/policy\/courts\/sussmann-wants-durham-filing-about-trump-white-house-snooping-stricken-from-record\">indicted<\/a><\/u> last September for allegedly <u><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/durham-grand-jury-indicts-lawyer-allegedly-lying-fbi-concealing-ties-clinton-campaign\">concealing<\/a><\/u> his clients \u2014 Hillary Clinton&#8217;s 2016 presidential campaign and \u201cTech Executive-1,\u201d known to be former Neustar executive <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/tech-exec-1-says-he-will-plead-the-fifth-in-durham-case\">Rodney Joffe<\/a> \u2014 from FBI general counsel James Baker in September 2016 when he pushed since-debunked claims of a secret back channel between the Trump Organization and Russia\u2019s Alfa Bank.<\/p>\n<div class=\"Enhancement\">\n<div class=\"Enhancement-item\"><\/div>\n<\/div>\n<p>The September 2021 indictment alleged Sussmann <u><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/durham-argues-sussmann-lie-fbi-mattered-as-he-pushed-collusion-claims\">lied<\/a><\/u> when he said he was not providing the domain name system data allegations to the FBI on behalf of any client when he was, in fact, doing so on behalf of Joffe and the Clinton campaign.<\/p>\n<p>Durham is also scrutinizing claims Sussmann made to the CIA in February 2017 about Russian phones, called YotaPhones, which the Democratic cybersecurity lawyer had claimed linked former President Donald Trump to these phones near the White House.<\/p>\n<p>Durham revealed Friday that while the FBI \u201cdid not reach an ultimate conclusion regarding the data\u2019s accuracy or whether it might have been in whole or in part genuine, spoofed, altered, or fabricated\u201d as it was being pushed to government agencies, the CIA \u201cconcluded in early 2017 that the Russian Bank-1 data and Russian Phone Provider-1 data\u201d \u2014 the Alfa Bank and YotaPhone information \u2014 was not \u201ctechnically plausible,\u201d did not \u201cwithstand technical scrutiny,\u201d was \u201cuser created and not machine\/tool generated,&#8221; \u201ccontained gaps,\u201d and \u201cconflicted with [itself].\u201d The special counsel said his office \u201chas not reached a definitive conclusion in this regard.\u201d<\/p>\n<p>Durham said his prosecutors expect to cite evidence at trial reflecting that \u201cthe FBI and Agency-2 concluded that the Russian Bank-1 allegations were untrue and unsupported.&#8221;<\/p>\n<p>The special counsel said earlier this year that Sussmann <u><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/policy\/courts\/sussmann-wants-durham-filing-about-trump-white-house-snooping-stricken-from-record\">told<\/a><\/u> the CIA about the dubious Russian bank connection during the 2017 meeting in which he again allegedly misled about who his client was. Sussmann \u201cprovided data which he claimed reflected purportedly suspicious DNS lookups by these entities of internet protocol addresses affiliated with a Russian mobile phone provider\u201d that also \u201cdemonstrated that Trump and\/or his associates were using supposedly rare, Russian-made wireless phones in the vicinity of the White House and other locations,&#8221; according to the special counsel.<\/p>\n<p>\u201cThe Special Counsel\u2019s Office has identified no support for these allegations,\u201d Durham wrote in February.<\/p>\n<p><b><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/judge-denies-democrat-lawyer-michael-sussmanns-effort-to-toss-durham-indictment\">JUDGE DENIES SUSSMANN EFFORT TO TOSS DURHAM INDICTMENT<\/a><\/b><\/p>\n<p>Durham <u><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/durham-argues-sussmann-lie-fbi-mattered-as-he-pushed-collusion-claims\">revealed<\/a><\/u> this year he has evidence Joffe \u201cexploited\u201d DNS internet traffic at Trump Tower, Trump\u2019s Central Park West apartment building, and the Executive Office of the President. The special counsel <u><a class=\"Link\" href=\"https:\/\/twitter.com\/ProfMJCleveland\/status\/1495157692012376066\">said<\/a><\/u> in October that Joffe exploited his company&#8217;s access to data at a &#8220;high-ranking executive branch office&#8221; both before and after the 2016 election.<\/p>\n<p>In December 2019, Michael Horowitz, the inspector general of the Justice Department, <u><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/ratcliffe-says-all-kinds-of-intelligence-showed-fake-russia-collusion\">said<\/a><\/u> the FBI &#8220;concluded by early February 2017 that there were no such links&#8221; between Trump and Alfa Bank.<\/p>\n<p>When asked about the Alfa Bank claims during House testimony in summer 2019, special counsel Robert Mueller said, &#8220;My belief at this point is that it\u2019s not true.\u201d Mueller also &#8220;did not establish&#8221;
