Sussmann filed a motion to <a href=\"https:\/\/dailycaller.com\/2022\/03\/04\/durham-filing-clinton-sussmann-indictment\/\">dismiss<\/a> the case in February, but a judge <a href=\"https:\/\/dailycaller.com\/2022\/04\/13\/michael-sussmann-john-durham-probe-judge-case-will-proceed\/\">ruled<\/a> in April that the case will be allowed to proceed.<\/p>\n<p>In the latest court filing, Durham noted that the CIA \u201cconcluded in early 2017\u201d that the data didn\u2019t \u201cwithstand technical scrutiny.\u201d<\/p>\n<p>\u201cWhile the FBI did not reach an ultimate conclusion regarding the data\u2019s accuracy or whether it might have been in whole or in part genuine, spoofed, altered, or fabricated, [the CIA] concluded in early 2017 that the Russian Bank 1 data and Russian Phone Provider 1 data was not \u2018technically plausible,\u2019 did not \u2018withstand technical scrutiny,\u2019 \u2018contained gaps,\u2019 \u2018conflicted with [itself]\u2019 and was \u2018user-created and not machine\/tool generated,&#8217;\u201d Durham wrote <a href=\"https:\/\/www.scribd.com\/document\/570091923\/70-Memorandum-in-Opposition-Re-Sussmann-Motion-in-Limine-by-USA\">according<\/a> to the court documents.<\/p>\n<p>While Durham also noted that the Special Counsel\u2019s office hadn\u2019t yet \u201creached a definitive conclusion in this regard,\u201d he argued in the court filing that the evidence showing agencies had taken measures to investigate \u201cis critical to establishing materiality.\u201d<\/p>\n<div id=\"attachment_7411583\" class=\"wp-caption aligncenter\">\n<p id=\"caption-attachment-7411583\" class=\"wp-caption-text\">BROOKLYN, NY \u2013 JUNE 7: Democratic presidential candidate Hillary Clinton arrives onstage during a primary night rally at the Duggal Greenhouse in the Brooklyn Navy Yard, June 7, 2016 in the Brooklyn borough of New York City. (Photo by Drew Angerer\/Getty Images)<\/p>\n<\/div>\n<p><span class=\"a\">\u201cAt a minimum, however, the Government does expect to adduce evidence at trial reflecting <\/span><span class=\"a\">(i) the fact that the FBI and Agency-2 concluded that the Russian Bank-1 allegations were untrue <\/span><span class=\"a\">and unsupported and (ii) the primary bases for these <span class=\"fourgen_highlight\">conclusion<\/span>s, including the particular <\/span><span class=\"a\">investigative and analytical s<span class=\"l6\">teps taken by these agencies,\u201d Durham wrote.<\/span><\/span><\/p>\n<p>The Friday evening filing responded to Sussmann\u2019s defense, which had questioned what evidence would be allowed into the trial.<\/p>\n<p>Durham has <a href=\"https:\/\/dailycaller.com\/2022\/02\/16\/jen-psaki-dodges-durham-report-questions-doj\/\">accused<\/a> Sussmann of lying \u201cabout the capacity in which he was providing\u201d his accusations made to the FBI, Business Insider previously\u00a0<a href=\"https:\/\/www.businessinsider.com\/judge-rejects-michael-sussmann-request-dismiss-durham-indictment-2022-4\">reported<\/a>. Sussmann claimed the Trump organization and a Russian bank \u2013 Alfa Bank \u2013 had a \u201csecret communications channel,\u201d and the original indictment accuses Sussmann of lying to the FBI regarding whom he was working for, the news agency added.<\/p>\n<p>Durham\u2019s Friday court filing also goes in-depth about Sussmann\u2019s relationship with Christopher Steele, a former British Intelligence agent responsible for the now-<a href=\"https:\/\/dailycaller.com\/2021\/12\/21\/john-durham-filing-igor-danchenko-clinton-campaign-testify-probe-trump\/\">debunked<\/a> anti-Trump <a href=\"https:\/\/dailycaller.com\/2020\/08\/12\/christopher-steele-trump-russia-dossier-tape\/\">dossier<\/a>, Fox News reported. <strong><a href=\"https:\/\/dailycaller.com\/2022\/02\/14\/jim-jordan-democrats-trump-spying-durham-clinton-campaign\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: \u2018As Wrong As It Gets\u2019: Rep. Jim Jordan Calls Out Liberal Media And Democrats For Denying That Trump Was Spied On)<\/a><\/strong><\/p>\n<p>Durham says the two met in 2016\u00a0at the Perkins Coie offices to speak about possible connections to Russia, <a href=\"https:\/\/www.foxnews.com\/politics\/durham-cia-concluded-data-alleging-trump-russia-connection-not-technically-plausible-user-created\">according<\/a> to Fox News.
