She had induced her own abortion in January and was reported to authorities by <\/span><span>Starr County Memorial Hospital after seeking subsequent treatment.<\/span><\/p>\n<p><span>\u201cListen, right now I have no words,\u201d Ismael Herrera, the unborn child\u2019s father, told <a href=\"https:\/\/www.youtube.com\/watch?v=rlteeSH0PeU\">Spanish-language news station Noticias Ya 48<\/a>\u00a0after learning his ex-wife would not face charges. \u201cIt was my son, a boy.\u201d<\/span><\/p>\n<p>Ismael Herrera filed for divorce on the day of her arrest, according to reports.<\/p>\n<p><span>Starr County District Attorney Gocha Allen Ramirez announced that he asked the judge to dismiss the murder charge, saying no applicable law existed to justify the charge.\u00a0<\/span><\/p>\n<p><span>\u201cAlthough with this dismissal Ms. Herrera will not face prosecution for this incident, it is clear to me that the events leading up to this indictment have taken a toll on Ms. Herrera and her family,\u201d Ramirez said. \u201cTo ignore this fact would be shortsighted.\u201d<\/span><\/p>\n<p><span>\u201cThe issues surrounding this matter are clearly contentious, however based on Texas law and the facts presented, it is not a criminal matter,\u201d the prosecutor added.<\/span><\/p>\n<p>The district attorney\u2019s\u00a0reversal came amid pressure from abortions rights activists and national news coverage of the case. Pro-a<span>bortion rights groups including La Frontera Fund and the American Civil Liberties Union (ACLU) of Texas raised Herrera\u2019s $500,000 bail within days of her arrest.\u00a0<\/span><\/p>\n<p><span>\u201cShe miscarried at a hospital and allegedly confided to hospital staff that she had attempted to induce her own abortion and was reported to the authorities by hospital administration or staff,\u201d <a href=\"https:\/\/www.reuters.com\/world\/us\/protesters-gather-outside-texas-jail-after-reported-abortion-arrest-2022-04-09\/\">said<\/a> La Frontera Fund founder Rickie Gonzalez<\/span><span>.<\/span><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">On April 9, 2022, Frontera Fund held a protest outside of the Starr County Jail opposing Lizelle Herrera\u2019s arrest\u2014a woman who was jailed for murder over a self-induced abortion. The fundraising page <\/span><span>was active as of press time.<\/span><\/p>\n<p><span>Ramirez\u2019s office declined to comment further when contacted by The Daily Wire, although text messages between Ramirez and an unnamed person obtained by The Washington Post\u00a0appear to show the prosecutor relaying what he told Herrera\u2019s attorney, Calixtro Villarreal.<\/span><\/p>\n<p><span> \u201cI assure you I never meant to hurt this young lady,\u201d Ramirez allegedly recounted telling Villareal, with whom he has worked closely in the past and appears to be friends from Ramirez\u2019s time in private practice.<\/span><\/p>\n<p><span>Court records reflect that Villarreal and Ramirez represented co-defendants in numerous federal cases. In late February 2020, a month before Ramirez was elected, Villarreal hosted a campaign event for him. A Facebook <a href=\"https:\/\/www.facebook.com\/LawOfficeofCalixtroVillarreal\/posts\/2813561628739168\">post<\/a> showed that the campaign event began at Villarreal\u2019s office and ended at the Starr County Courthouse, where they encouraged the community to cast their vote for Ramirez.<\/span><\/p>\n<p><span>The case brought renewed attention to Texas\u2019 recently enacted, so-called \u201cHeartbeat Law,\u201d which outlaws abortions after a heartbeat is detected. <\/span><span>However, the law does not provide for criminal prosecution and allows private citizens to sue those who perform or assist an abortion. That law<\/span><span>\u00a0<\/span><a href=\"https:\/\/www.dailywire.com\/news\/supreme-court-rejects-abortion-providers-request-to-stay-texas-heartbeat-law\"><span>survived<\/span><\/a><span> a Supreme Court challenge that would have prohibited its enforcement while legal challenges continue. <\/span><\/p>\n<p><i><span>Corinne Murdock is a reporter for The Daily Wire and AZ Free News.
