client<\/figcaption><\/figure>\n<p><strong>The attorney who represented\u00a0<a href=\"https:\/\/neonnettle.com\/tags\/hillary-clinton\">Hillary Clinton&#8217;s<\/a>\u00a02016 presidential campaign is headed to trial after an attempt to get his case dismissed was rejected by a federal judge.<\/strong><\/p>\n<p>Attorney Michael Sussmann is set to go on trial on May 16 on one count of lying to the FBI.<\/p>\n<p>He has pleaded not guilty.<\/p>\n<p>According to special counsel John Durham\u2019s team, Sussmann <a href=\"https:\/\/www.theepochtimes.com\/john-durham-ex-clinton-lawyer-allegedly-lied-to-fbi-in-writing_4384038.html\" target=\"_blank\" rel=\"noopener\">lied <\/a>when he said he wasn\u2019t providing the tip on behalf of a client.<\/p>\n<p>Sussmann, through his attorneys, attempted to convince U.S. District Judge Christopher Cooper, an Obama nominee, that he should dismiss the case, arguing that Sussmann\u2019s lie was an ancillary matter.<\/p>\n<figure title=\"The information that Sussmann provided to the-FBI General Counsel James Baker included three &#039;white papers&#039;\">\n<div Sean Berkowitz, one of Sussmann\u2019s attorneys, said during a recent hearing on the motion to dismiss, charging that <em>\u201cwe haven\u2019t ever seen a case where someone who provided a tip to the government was charged for making a false statement about something other than the tip.\u201d<\/em><\/p>\n<p>Cooper said it\u2019s too early to tell if Berkowitz\u2019s argument is correct, noting that the cases Sussmann cited to support the motion all went to trial.<\/p>\n<p><em>\u201cSo, while Sussmann is correct that certain statements might be so peripheral or unimportant to a relevant agency decision or function to be immaterial under [federal law] as matter of law, the court is unable to make that determination as to this alleged statement before hearing the government\u2019s evidence,&#8221; <\/em>he said.<\/p>\n<p><em>&#8220;Any such decision must therefore wait until trial,<\/em>\u201d the judge wrote in a six-page opinion.<\/p>\n<p>The information that Sussmann provided to then-FBI General Counsel James Baker included three<em> \u201cwhite papers\u201d<\/em> and associated data files that Sussmann claimed would support media reports of a secret communications channel between Trump\u2019s campaign and Alfa Bank, a Russian bank.<\/p>\n<figure title=\"Sussman represented Hillary Clinton\u2019s 2016 presidential campaign\">\n<div presidential campaign <\/figcaption><\/figure>\n<p>The supposed connections have never been proven, and several investigators, including special counsel Robert Mueller, have said no evidence has been found to substantiate the claim.<\/p>\n<p>Sussmann, at the time, was representing the campaign of Clinton\u2014who was running for president\u2014as well as the Democratic National Committee.<\/p>\n<p>The FBI opened an investigation into Sussmann\u2019s tip but ultimately concluded that there was<em> \u201cinsufficient evidence\u201d<\/em> to support the allegations, according to Sussmann\u2019s indictment.<\/p>\n<p>The probe revealed that the email server that allegedly communicated with Alfa Bank wasn\u2019t owned or operated by the Trump Organization but had been administered by a mass marketing company that distributed advertisements for hundreds of clients in addition to Trump hotels.<\/p>\n<p>According to Durham, if the FBI had been aware of the parties Sussmann represented, the bureau might have been more cautious about opening an investigation<\/p>\n<p>As<a href=\"https:\/\/neonnettle.com\/news\/18294-hillary-clinton-lawyer-gave-sensitive-data-on-trump-to-cia-durham-reveals\" target=\"_blank\" rel=\"noopener\"> Neon Nettle<\/a> reported in February:<\/p>\n<p>Durham revealed in a\u00a0<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.235638\/gov.uscourts.dcd.235638.35.0_1.pdf\">court filing<\/a>\u00a0that Sussmann distributed the data on the sitting President of the United States in early 2017.<\/p>\n<p>Information on Trump had been gathered from the White House and Trump Tower servers in an effort to\u00a0<em>&#8220;dig dirt&#8221;<\/em>\u00a0on the 45th president.<\/p>\n<p>The computer servers were repeatedly accessed through a\u00a0<em>&#8220;sensitive&#8221;<\/em>\u00a0government contract, according to Durham.<\/p>\n<p>Sussmann faces up to five years in prison if convicted.<\/p>\n<h4><a
