Elise Stefanik (R-NY) and 35 of her Republican colleagues are calling on President Joe Biden to remove a newly-appointed immigration judge after the judge expressed hostility toward immigration law enforcement, Breitbart News has learned.<\/p>\n<p>Stefanik, the third-ranking Republican in the House, detailed reasons for her and her colleagues\u2019 \u201cdeep concern\u201d with Judge Carmen Maria Rey Caldas and asked that Caldas be removed from her post, according to a letter sent to Biden on Thursday.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>Caldas, who hails from Stefanik\u2019s home state of New York, was part of a wave of 25 immigration judges <a href=\"https:\/\/www.justice.gov\/eoir\/page\/file\/1487036\/download\" target=\"_blank\" rel=\"noopener\">appointed<\/a> by U.S. Attorney General Merrick Garland in March. Caldas now serves on the federal Stewart Immigration Court in Georgia.<\/p>\n<p>\u201cYour administration has appointed <em>at least<\/em> one IJ [immigration judge] who has consistently and publicly expressed contempt for immigration enforcement,\u201d Stefanik and her fellow Republicans wrote, adding that Caldas has shown \u201ccomplete disregard for the role\u201d of U.S. Immigration and Customs Enforcement (ICE).<\/p>\n<p>Read the full letter below:<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>The letter notes that Caldas conveyed support for sanctuary cities by discouraging New York City from cooperating with ICE in a May 2019 Twitter post, according to a screenshot from her Twitter account, which Caldas appears to have recently\u00a0<a href=\"https:\/\/twitter.com\/CarmenMariaRey\" target=\"_blank\" rel=\"noopener\">deactivated<\/a>.<\/p>\n<p>Caldas wrote, according to the screenshot, \u201cEvery day, thousands of New Yorkers are fighting back against the Trump Admin, as they try to crush immigrants with the full force of the federal government. (SAUL LOEB\/AFP via Getty Images)<\/p>\n<\/div>\n<p>Jon Feere, a former Department of Homeland Security official within ICE, shared other examples, which are also noted in Stefanik\u2019s letter, that demonstrate Caldas\u2019s disapproval of ICE and her open borders stance.<\/p>\n<figure id=\"M-ROS-B3\" class=\"a8d adSo\"><\/figure>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Biden&#8217;s ignorant new immigration judge says ICE officers are &#8220;just guys who are walking around with guns calling themselves law enforcement.&#8221; <a href=\"https:\/\/t.co\/YbNHrMcOHS\">https:\/\/t.co\/YbNHrMcOHS<\/a> The men and women of ICE receive a hell of a lot more training than <a href=\"https:\/\/twitter.com\/CarmenMariaRey?ref_src=twsrc%5Etfw\">@CarmenMariaRey<\/a> ever will in her new gig. <a href=\"https:\/\/t.co\/AAmIK2GcW4\">https:\/\/t.co\/AAmIK2GcW4<\/a> <a href=\"https:\/\/t.co\/BmPmd3eDxe\">pic.twitter.com\/BmPmd3eDxe<\/a><\/p>\n<p>\u2014 Jon Feere \ud83c\uddfa\ud83c\uddf8 (@JonFeere) <a href=\"https:\/\/twitter.com\/JonFeere\/status\/1507788544449859586?ref_src=twsrc%5Etfw\">March 26, 2022<\/a><\/p>\n<\/blockquote>\n<p>Caldas, per a Twitter screenshot, explicitly agreed in 2020 with the statement that some immigration enforcement is \u201cpointless.\u201d In a local NY1 television appearance in 2019, Caldas <a href=\"https:\/\/www.ny1.com\/nyc\/all-boroughs\/inside-city-hall\/2019\/08\/10\/after-ice-raids-mississippi-immigrant-communities-on-edge\" target=\"_blank\" rel=\"noopener\">described<\/a> ICE as an \u201carbitrary deportation force\u201d whose agents were \u201cjust guys who are walking around with guns calling themselves law enforcement.\u201d<\/p>\n<figure id=\"D-ROS-B2\" class=\"a8d\"><\/figure>\n<p>The congressmembers wrote:<\/p>\n<blockquote>\n<p>Appointing a judge who has encouraged jurisdictions to not comply with a federal law enforcement agency is a disgrace. Her decisions will undoubtedly impact the safety of communities across our country, as violent felons, rapists, and murderers are included among the 1.2 million final removal orders in the United States.<\/p>\n<p>\u2026<\/p>\n<p>Judge Rey Caldas has even gone as far as to degrade ICE officers in a television appearance.\u00a0\u2026 By definition, ICE is a federal law enforcement agency under the Department of Homeland Security. ICE officers are respected, brave individuals, who spend several months preparing to serve our country. This statement should have been an automatic disqualifier for appointing her to our immigration court system.<\/p>\n<\/blockquote>\n<p>Immigration judges work within the Department of Justice (DOJ) and preside over proceedings that determine if foreign nationals can be removed from the United States. These proceedings, which happen within an increasingly overwhelmed immigration court system, frequently involve hearing cases for illegal migrants who have claimed asylum.<\/p>\n<p>Asylum cases alone are currently so backlogged that a recent study <a href=\"https:\/\/trac.syr.edu\/immigration\/reports\/675\/\" target=\"_blank\" rel=\"noopener\">found<\/a>\u00a0an illegal migrant\u2019s average wait time for their case has grown to 58 months. During the wait time, the federal government often grants the migrants authorization to live and work in the United States, despite the legal argument \u2014 currently\u00a0<a href=\"https:\/\/www.breitbart.com\/economy\/2022\/04\/02\/joe-biden-faces-supreme-court-review-of-his-catch-and-release-policy\/\" target=\"_blank\" rel=\"noopener\">awaiting<\/a> a Supreme Court review \u2014 that migrants claiming asylum must be detained until their case has reached a final conclusion.<\/p>\n<figure id=\"M-ROS-B4\" class=\"a8d adSo\"><\/figure>\n<p>Releasing rather than detaining asylum-seeking migrants into the U.S. works to perpetuate crisis-level migration flow because it allows the migrants to get American jobs that they need to pay off their smuggling debts, which they typically\u00a0<a href=\"https:\/\/www.breitbart.com\/economy\/2022\/03\/04\/joe-biden-delivers-flood-of-cheap-migrant-labor-to-new-york\/\" target=\"_blank\" rel=\"noopener\">take on<\/a>\u00a0when smugglers assist them with border crossing.<\/p>\n<p>The study also observed that under Biden, who has an open borders posture that has contributed to record-breaking numbers of illegal migrant encounters at the southern border, pending immigration cases have reached their largest number on record and are \u201caccelerating at a breakneck pace.\u201d<\/p>\n<p>The congressmembers urged Biden to remove Caldas as an immigration judge, concluding, \u201cAs we face the worst border crisis in history, it is essential that the IJs at our border are willing to uphold our country\u2019s immigration laws.\u201d<\/p>\n<p>Breitbart News reached out to DOJ\u2019s Executive Office for Immigration Review to inquire on if it approves of Caldas\u2019s past remarks but did not receive a response by the time of this publishing.<\/p>\n<p><em>Write to Ashley Oliver at <a href=\"mailto:aoliver@breitbart.com\" target=\"_blank\" rel=\"noopener\">aoliver@breitbart.com<\/a>.
