Sussmann filed a motion to dismiss the case in February. A subsequent filing from Durham <a href=\"https:\/\/dailycaller.com\/2022\/03\/04\/durham-filing-clinton-sussmann-indictment\/\">called<\/a> the motion to dismiss \u201cabsurd.\u201d<\/p>\n<p>U.S. District Judge Christopher Cooper, in Wednesday\u2019s court <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.235638\/gov.uscourts.dcd.235638.67.0_13.pdf\">filing<\/a>, outlined the charges Sussmann is facing and ultimately ruled that he failed to offer \u201clegal authority\u201d proving he did not give a <a href=\"https:\/\/dailycaller.com\/2022\/04\/08\/durham-questions-clinton-campaigns-privilege-claims-demands-court-review-them\/\">materially<\/a> false statement.<\/p>\n<p>\u201cWhile Sussmann is correct that certain statements might be so peripheral or unimportant to a relevant agency decision or function to be immaterial under \u00a7 1001 as matter of law, the Court is unable to make that determination as to this alleged statement before hearing the government\u2019s evidence. Any such decision must therefore wait until trial,\u201d Cooper ruled.<\/p>\n<div class=\"page\" title=\"Page 5\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<div id=\"attachment_7004833\" class=\"wp-caption aligncenter\">\n<p id=\"caption-attachment-7004833\" class=\"wp-caption-text\">U.S. Attorney John Durham (Youtube screen capture\/Fox News)<\/p>\n<\/div>\n<p><span class=\"gmail_default\">\u200b<\/span>Durham has <a href=\"https:\/\/dailycaller.com\/2022\/02\/16\/jen-psaki-dodges-durham-report-questions-doj\/\">accused<\/a> Sussmann of lying \u201cabout the capacity in which he was providing\u201d his accusations made to the FBI, Business Insider <a href=\"https:\/\/www.businessinsider.com\/judge-rejects-michael-sussmann-request-dismiss-durham-indictment-2022-4\">reported<\/a>. Sussmann claimed the Trump organization and a Russian bank had a \u201csecret communications channel,\u201d and the indictment accuses Sussmann of lying to the FBI regarding whom he was working for, the news agency added.<\/p>\n<p>Records of Sussmann\u2019s billing history show he \u201crepeatedly\u201d <a href=\"https:\/\/dailycaller.com\/2022\/02\/15\/daily-mail-confronts-hillary-clinton-spied-trump-campaign\/\">charged<\/a> the Clinton Campaign for work regarding the \u201cRussian Bank-1\u201d allegations, according to Durham. <strong><a href=\"https:\/\/dailycaller.com\/2022\/02\/14\/jim-jordan-democrats-trump-spying-durham-clinton-campaign\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: \u2018As Wrong As It Gets\u2019: Rep. Jim Jordan Calls Out Liberal Media And Democrats For Denying That Trump Was Spied On)<\/a><\/strong><\/p>\n<p>Durham also alleges that Sussmann met with the CIA in 2017 and offered up computer data that purportedly sought to link Trump and Russia.
