The vague \u201cright to choose\u201d mantra is quickly morphing into the right to kill a full-term baby after birth, with no questions asked.<\/p>\n<p>A California bill <a href=\"https:\/\/www.lifenews.com\/2022\/04\/05\/california-assembly-committee-passes-bill-that-would-legalize-infanticide\/\">passed last week<\/a> by the state Assembly Judiciary Committee and now on its way to the Assembly Health Committee could permit infanticide, opponents <a href=\"https:\/\/www.californiafamily.org\/2022\/04\/assembly-judiciary-committee-to-vote-on-infanticide-bill\/\">warn<\/a>. The bill, <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=202120220AB2223\">AB 2223<\/a>, is brought to citizens by the <a href=\"https:\/\/www.cafabcouncil.org\/\">Future of Abortion Council<\/a>, a group of more than 40 abortion advocacy groups organized at the urging of Gov. Gavin Newsom to help make California an \u201c<a href=\"https:\/\/apnews.com\/article\/abortion-california-sanctuary-625a118108bcda253196697c83548d5b\">abortion sanctuary<\/a>\u201d state.<\/p>\n<p>The bill\u2019s sponsor, Assemblywoman <a href=\"https:\/\/a15.asmdc.org\/\">Buffy Wicks<\/a>, <a href=\"https:\/\/californiaglobe.com\/articles\/infanticide-or-pregnancy-loss-abortion-bill-passes-assembly-judiciary-committee\/\">claims<\/a> it does not legalize infanticide but \u201cprotects reproductive freedom by clarifying that the Reproductive Privacy Act prohibits pregnancy criminalization.\u201d\u00a0<\/p>\n<p>However, the text prohibits investigations into deaths \u201crelated to or following known or suspected self-induced or criminal abortion\u201d and would \u201cdelete the requirement that an unattended fetal death be handled as a death without medical attendance.\u201d The bill also removes criminal liability for \u201cactions or omissions\u201d with respect to pregnancy and pregnancy outcomes.\u00a0<\/p>\n<h2>\u2018Perinatal Death\u2019 Is Frighteningly Broad <\/h2>\n<p>The biggest problem is found in Section 7, where the bill provides broad protection in the case of \u201cperinatal death due to a pregnancy-related cause.\u201d The bill text states:<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>The Legislature finds and declares that every individual possesses a fundamental right of privacy with respect to personal reproductive decisions, which entails the right to make and effectuate decisions about all matters relating to pregnancy, including prenatal care, childbirth, postpartum care, contraception, sterilization, abortion care, miscarriage management, and infertility care. \u2026<\/p>\n<p>Notwithstanding any other law, a person shall not be subject to civil or criminal liability or penalty, or otherwise deprived of their rights under this article, based on their actions or omissions with respect to their pregnancy or actual, potential, or alleged pregnancy outcome, including miscarriage, stillbirth, or abortion, or perinatal death due to a pregnancy-related cause.<\/p>\n<\/blockquote>\n<p>Legal experts <a href=\"https:\/\/www.californiafamily.org\/2022\/03\/newsoms-abortion-council-opens-the-door-to-infanticide\/\">explain<\/a> the word \u201cperinatal\u201d is not clearly defined, meaning it could be used to justify killing a baby weeks after birth, depending on how it is interpreted by courts. According to multiple <a href=\"https:\/\/www.wordnik.com\/words\/perinatal\">dictionaries<\/a>, \u201cperinatal\u201d means \u201cthe period around childbirth, especially the five months before and one month after birth.\u201d <\/p>\n<p>The California Family Council <a href=\"https:\/\/www.californiafamily.org\/2022\/04\/assembly-judiciary-committee-to-vote-on-infanticide-bill\/\">notes<\/a> that definitions of the word all include the period from 22 weeks of gestation to at least seven days post-birth. The World Health Organization also <a href=\"https:\/\/apps.who.int\/iris\/bitstream\/handle\/10665\/42980\/9241546530_eng.pdf\">holds<\/a> to this definition. <\/p>\n<p>Existing California law expands the period. In California\u2019s Welfare and Institutions Code, \u201cperinatal\u201d <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?lawCode=WIC&#038;sectionNum=14134.5.&#038;article=4.&#038;highlight=true&#038;keyword=PERINATAL\">refers<\/a> to the period \u201cfrom the establishment of pregnancy to one month following delivery.\u201d Elsewhere, the term \u201cperinatal services\u201d <a href=\"https:\/\/www.cdph.ca.gov\/Programs\/CFH\/DMCAH\/CPSP\/CDPH%20Document%20Library\/CPSP-Title22CPSPRegulations.pdf?TSPD_101_R0=087ed344cfab20006a7ce9a4d7f9d31fb7b3a90d9c58772bc6bb06ff5b116bbe34f4692ae26e2a860820fe7812143000058e4c7d7e778ee4460eb2ad96858448aaf6014898dd6bc8e22eac506b02b8c5cd33edc06327855f107a89922d2f035f\">encompasses<\/a> 60 days after delivery.<\/p>\n<p>Cases of babies <a href=\"https:\/\/www.sba-list.org\/born-alive-abortion-survivors-documented-cases\">surviving<\/a> abortion attempts have been extensively documented. But this bill permits abortionists to allow infants born alive to die by neglect.<\/p>\n<p>\u201cIn California under AB 2223, former Philadelphia abortionist Kermit Gosnell, who murdered three infants born alive after botched abortions, could not be prosecuted,\u201d <a href=\"https:\/\/righttolifeleague.org\/california-bill-will-legalize-infanticide\/\">explained<\/a> Susan Arnall, an attorney and director of outreach for the Right to Life League. \u201cAnd incredibly, someone like Gosnell who helped a California mother kill her newborn after birth will actually have a cause of action to sue police for investigating the matter if AB 2223 becomes law.\u201d<\/p>\n<h2>Don\u2019t Let the Vague Amendment Fool You<\/h2>\n<p>AB 2223 was amended on April 6 to add \u201cdue to a pregnancy-related cause\u201d at the end of \u201cperinatal death.\u201d But Arnall told me the addition is meaningless and does \u201cabsolutely nothing to address the justifiable concerns relating to infanticide\u201d or change what constitutes a perinatal death.<\/p>\n<p>\u201cTo date, AB 2223 as amended will decriminalize infanticide \u2014 the death of a baby born alive, whether as a result of a failed abortion (which is already exempted from prosecution by CA Penal Code Section 187) or for some other reason like neglect or harm by the mother or a third party during the perinatal period,\u201d Arnall said.<\/p>\n<p>Arnall believes the amended bill also still discourages investigation into infant deaths.<\/p>\n<p>\u201cWhile the April 6 amendments attempt to address problems concerning immunity for government investigations, the bill will likely chill investigation of infant deaths since it empowers mothers and <em>anyone <\/em>connected with the death of a newborn to bring a private cause of action for damages ($25,000 penalty), including the threat of attorney fees upon motion to a judge, against people who inquire into a newborn\u2019s death,\u201d she said. \u201cWhat impact will this bill have on private health care providers, doctors or nurses who report a perinatal death?\u201d<\/p>\n<p>Pro-lifers often highlight the absurdity of pro-choice arguments by pointing out there is no practical difference between a baby just before birth and just after birth. Once upon a time, this challenge gave some abortion advocates pause. Not anymore.<\/p>\n<p>As California Family Council President Jonathan Keller <a href=\"https:\/\/www1.cbn.com\/cbnnews\/us\/2022\/march\/free-abortions-and-infanticide-newsom-greenlights-coverage-next-bill-would-legalize-killing-babies-born-alive\">told<\/a> CBN, AB 2223 opens the door to \u201copen season on unwanted newborns.\u201d<\/p>\n<p>\u201cFor years, pro-life advocates have argued there is no moral difference between ending a child\u2019s life days before birth or days after birth,\u201d Keller said. \u201cCalifornia\u2019s pro-abortion legislators now seemingly agree.\u201d<\/p>\n<h2>It\u2019s Not Just California<\/h2>\n<p>A similar bill in Maryland, <a href=\"https:\/\/mgaleg.maryland.gov\/2022RS\/bills\/sb\/sb0669f.pdf\">SB 669<\/a>, entirely <a href=\"https:\/\/www.liveaction.org\/news\/maryland-decriminalize-infanticide-birth\/\">strips<\/a> pre-born babies of all rights, declaring that nothing \u201cshall be construed to confer personhood or any rights on the fetus.\u201d It also bans investigations or criminal charges for death by neglect during the perinatal period.<\/p>\n<p>\u201cOne blue-state bill that would allow a born baby to be neglected to death might be an anomaly,\u201d <a href=\"https:\/\/www.lifenews.com\/2022\/03\/25\/california-bill-would-legalize-infanticide-babies-could-be-left-to-die-up-to-6-weeks-after-birth\/\">said<\/a> author Wesley J. Smith in response to the Maryland bill. \u201cA second that does that \u2014 and perhaps could be interpreted to allow infanticide, also \u2014 is a pattern,\u201d he continued. \u201cThe cultural Left is blazing new grounds of depravity.\u201d<\/p>\n<p>In Colorado, Gov. Jared Polis last week <a href=\"https:\/\/www.rmpbs.org\/blogs\/news\/colorado-abortion-protection-new-law\/\">signed<\/a> HB 1279, which will specifically strip unborn babies of any rights as human beings, as well as \u201cpermit abortion-on-demand for any reason in Colorado, permit abortion discrimination based on sex or race or ability level,\u201d <a href=\"https:\/\/ccdenver.org\/coloradans-pray-as-radical-abortion-bill-heads-to-co-governors-desk\/\">according<\/a> to the Catholic Charities Archdiocese of Denver.<\/p>\n<p>The progression should not come as a total surprise, as <a href=\"https:\/\/slate.com\/technology\/2012\/03\/after-birth-abortion-the-pro-choice-case-for-infanticide.html\">academics<\/a>, most notably Princeton University ethics professor <a href=\"https:\/\/www.washingtonpost.com\/archive\/opinions\/1999\/09\/11\/a-professor-who-argues-for-infanticide\/cce7dc81-3775-4ef6-bfea-74cd795fc43f\/\">Peter Singer<\/a>, have been discussing the case for infanticide for years. Three years ago, Virginia Democrat Gov. Ralph Northam made headlines for <a href=\"https:\/\/www.cnn.com\/2019\/01\/31\/politics\/ralph-northam-third-trimester-abortion\/index.html\">suggesting<\/a> that a baby who survived an abortion could be killed by doctors at the mother\u2019s direction. The law is just catching up.<\/p>\n<p>AB 2223 is one of many pieces of legislation <a href=\"https:\/\/www.cafabcouncil.org\/checklist\">supported<\/a> by California\u2019s Future of Abortion Council. In January, Governor Newsom also <a href=\"https:\/\/www.ebudget.ca.gov\/2022-23\/pdf\/BudgetSummary\/HealthandHumanServices.pdf\">allocated<\/a> $20 million of the state budget proposal to loan repayments and scholarships for medical students and healthcare providers who \u201ccommit to providing reproductive health care services.\u201d<\/p>\n<p>As the final touch on an already radical bill, AB 2223 erases the fact that pregnancy is a uniquely female gift, replacing all references to \u201cwomen\u201d with \u201cpregnant people.\u201d<\/p>\n<hr class=\"wp-block-separator\" \/>\n<p>\n  Katelynn Richardson is an English major at the University of Nevada, Las Vegas.
