The importance of this data was suggested in another filing (April 8, 2022), where Sussmann\u2019s lawyers provided to the Court <a href=\"https:\/\/www.scribd.com\/document\/569294193\/66-1-Letter-From-SCO-to-Sussmann-Atty-3-30-22\" rel=\"\">a March 30, 2022 letter from Special Counsel Durham<\/a> to Sussmann\u2019s attorneys.<\/p>\n<p>That letter addresses the Special Counsel\u2019s understanding that Sussmann\u2019s lawyers would not \u201coffer evidence, or engage in questioning, that would imply, assert, or seek to prove the authenticity of the relevant DNS data or the actual truth of the allegations at issue concerning a secret channel of communications between the Trump Organization and Alfa Bank.\u201d<\/p>\n<p>It also served as a warning. Should Sussmann\u2019s attorneys try to establish the accuracy of the Alfa Bank\/Trump data, the Special Counsel\u2019s expert would be ready to testify that the data was falsified:<\/p>\n<div class=\"captioned-image-container\">\n<figure><a class=\"image-link image2\" target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/cdn.substack.com\/image\/fetch\/f_auto,q_auto:good,fl_progressive:steep\/https%3A%2F%2Fbucketeer-e05bbc84-baa3-437e-9518-adb32be77984.s3.amazonaws.com%2Fpublic%2Fimages%2F1fe54b7d-9cfb-494f-9e1b-3f86f8f94c79_724x402.png\"><source type=\"image\/webp\" \/><img src width=\"724\" height=\"402\" data-attrs=\"{\" \/><\/a><\/figure>\n<\/div>\n<p>That statement is the strongest thus far that the Special Counsel has determined the Alfa Bank\/Trump data was spoofed in order to mislead the press and the FBI. A conspiracy, if you will.<\/p>\n<div class=\"subscription-widget-wrap\">\n<div class=\"subscription-widget show-subscribe\">\n<div class=\"preamble\">\n<p>The Reactionary is a reader-supported publication. To receive new posts and support my work, consider becoming a free or paid subscriber.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<p>Moving on &#8211; besides Alfa Bank, what else might these \u201cmatters\u201d referenced by Durham include?<\/p>\n<p>For starters, whether the Clinton Campaign or Hillary for America knew about, or directed the activities of, Charles Dolan (the longtime Clinton ally and the \u201csource\u201d of Steele dossier primary subsource Igor Danchenko). As <a href=\"https:\/\/technofog.substack.com\/p\/has-peter-strzok-testified-before?s=w\" rel=\"\">we noted back in January<\/a>, we believe that Dolan has testified before a grand jury on these issues.<\/p>\n<p>\u00a0<a href=\"https:\/\/technofog.substack.com\/p\/its-official-durham-is-investigating?s=w\" rel=\"\">Recall that Durham informed the Court<\/a> that the Igor Danchenko (Steele\u2019s primary subsource) trial might include the following issues:<\/p>\n<ol>\n<li>\n<p>The Clinton Campaign\u2019s knowledge or lack of knowledge concerning the veracity of information in the Fusion GPS reports sourced by Danchenko,<\/p>\n<\/li>\n<li>\n<p>The Clinton Campaign\u2019s awareness or lack of awareness of Dancehnko\u2019s collection methods and sub-sources,<\/p>\n<\/li>\n<li>\n<p>Meetings or communications between and among the Clinton Campaign, Fusion GPS, and\/or Steele regarding or involving Danchenko<\/p>\n<\/li>\n<li>\n<p>Danchenko knowledge or lack of knowledge regarding the Clinton Campaign\u2019s role in and activities surrounding the Fusion GPS reports, and<\/p>\n<\/li>\n<li>\n<p>The extent to which the Clinton Campaign and\/or its representatives directed, solicited, or controlled Danchenko\u2019s activities.<\/p>\n<\/li>\n<\/ol>\n<p>Let\u2019s go with a hypothetical and assume for a moment that the Clinton Campaign was involved in conspiracies to traffic false information to the FBI\/DOJ via the Steele dossier and the Alfa Bank allegations. (Still an assumption at this time \u2013 <em>beware the danger of false hope<\/em>. We saw the other side get trapped and humiliated with their promises of indictments.)<\/p>\n<p>Why go to those lengths \u2013 and why risk criminal exposure? Especially with polling predicting a near-certain Hillary win?<\/p>\n<p>Dare I suggest it all goes back to the DNC \u201chack\u201d.<\/p>\n<p><strong>Privilege Issues<\/strong><\/p>\n<p>One of the filings we discussed above (regarding Podesta) is Durham\u2019s <a href=\"https:\/\/www.scribd.com\/document\/569269484\/64-Gov-Motion-to-Compel\" rel=\"\">motion to compel the production of documents<\/a> against the Democratic National Committee (DNC), Hillary for America, Fusion GPS, and Perkins Coie. Each one of these entities has \u201cwithheld and\/or redacted documents and communications\u201d from the Special Counsel. Fusion GPS, for example has withheld 1,455 documents.<\/p>\n<p>Not to be outdone, Hillary for American and the DNC have asserted privilege over communications between Rodney Joffe (\u201cTech Executive-1\u201d in the Sussmann indictment) and Fusion GPS \u2013 despite the DNC or HFA not being attached to those e-mails. Rodney Joffe, according to Durham, \u201chas asserted his Fifth Amendment right against self-incrimination over any responsive documents within his personal possession, custody, or control.\u201d<\/p>\n<p>What exactly does Durham want from the Clinton Campaign, <em>et al<\/em>.? Here\u2019s some examples:<\/p>\n<ol>\n<li>\n<p>The unredacted contract between Perkins Coie and Fusion GPS. (<a href=\"https:\/\/www.scribd.com\/document\/569269898\/64-Fusion-Perkins-Coie-Contract\" rel=\"\">View the redacted version here<\/a>.)<\/p>\n<\/li>\n<li>\n<p>\u201c38 emails and attachments between and among\u201d Perkins Coie, Rodney Joffe, and\/or Fusion GPS employees.<\/p>\n<\/li>\n<li>\n<p>Communications between Fusion GPS and Rodney Joffe relating to the Alfa Bank allegations.<\/p>\n<\/li>\n<\/ol>\n<p>The primary basis of the privilege asserted by the DNC, et al., is that the work-product from Fusion GPS or Rodney Joffe was done in anticipation of litigation. When asking whether a document is prepared \u201cin anticipation of litigation,\u201d courts will look to whether \u201cthe document can fairly be said to have been prepared or obtained because of the prospect of litigation.\u201d <em>FTC v. Boehringer<\/em>, 778 F.3d 142, 147 (D.C. Cir. 2015).<\/p>\n<p>\u00a0The protects afforded by the work-product doctrine are the very reason why Perkins Coie referenced \u201cpotential and\/or on-going litigation\u201d in its contract with Fusion GPS. In other words, they planned ahead for the possibility that this privilege might need to be asserted. (This is the privilege Fusion GPS was asserting when it was sued by the owners of Alfa Bank.)<\/p>\n<div class=\"captioned-image-container\">\n<figure><a class=\"image-link image2\" target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/cdn.substack.com\/image\/fetch\/f_auto,q_auto:good,fl_progressive:steep\/https%3A%2F%2Fbucketeer-e05bbc84-baa3-437e-9518-adb32be77984.s3.amazonaws.com%2Fpublic%2Fimages%2F17e838f4-9956-47bb-8541-24d40c94a369_746x356.png\"><source type=\"image\/webp\" \/><img src width=\"746\" height=\"356\" data-attrs=\"{\" \/><\/a><\/figure>\n<\/div>\n<p>The good news? <\/p>\n<p><strong>The DNC, Hillary for America, Fusion GPS, and Perkins Coie will likely be compelled by the Court to produce the documents requested by Durham.<\/strong> Their arguments of \u201cprivilege\u201d are weak for a number of reasons, including: (1) the work was of a political nature and did not involve legal advice; (2) the work was not done in anticipation of litigation; (3) any privilege was waived, as Fusion GPS, the DNC\/HFA, and Perkins Coie all did their part to distribute the information to the press, government officials, etc.<\/p>\n<p><strong>Dates of Interest<\/strong><\/p>\n<p>Finally, the latest filings provides dates of the Fusion\/Perkins contract and the grand jury subpoenas:<\/p>\n<p><strong>April 1, 2016:<\/strong> Fusion GPS enters into a <a href=\"https:\/\/www.scribd.com\/document\/569269898\/64-Fusion-Perkins-Coie-Contract\" rel=\"\">contract<\/a> with Perkins Coie.<\/p>\n<p><strong>March 22, 2021:<\/strong> The Special Counsel serves Fusion GPS with a grand jury subpoena to produce documents relating to (1) the Alfa Bank hoax, and (2) the use of Russian phones \u201cby Donald Trump and\/or individuals affiliated with Donald Trump.\u201d The Russian phone allegations were those brought by Sussmann to the CIA in February 2017.<\/p>\n<p><strong>July 9, 2021:<\/strong> The Special Counsel requests Fusion GPS produce its retention contracts\/agreements with the DNC and Hillary for America.<\/p>\n<p><strong>September 16, 2021<\/strong>: The Special Counsel issued grand jury subpoenas to Perkins Coie and Fusion GPS, \u201crequiring them to produce \u2013 in redacted form \u2013 the documents previously listed on privilege logs prepared by counsel for those entities so that such documents would be available for admission into evidence.\u201d<\/p>\n<p>As to the reason to provide the \u201cprivilege\u201d arguments, one can\u2019t help but think that the DNC, the Clinton Campaign, and the rest of them are trying to hid the most damning evidence and incriminating communications.<\/p>\n<div class=\"footnote\" id=\"footnote-1\"><a href=\"https:\/\/technofog.substack.com\/p\/special-counsel-john-durham-continues?s=w#footnote-anchor-1\" class=\"footnote-number\" contenteditable=\"false\" rel=\"\">1<\/a><\/p>\n<div class=\"footnote-content\">\n<p>\u201cClinton Campaign Chair\u201d denotes John Podesta. Some have suggested this is Robby Mook. I disagree. Mook was the Campaign Manager.
