California\u2019s pro-abortion legislators now seemingly agree,\u201d said Jonathan Keller, president of <a href=\"https:\/\/www.californiafamily.org\/\">California Family Council<\/a>, which mobilized to\u00a0educate about the bill. \u201cCalifornia lawmakers have crossed a red line by seeking to legitimize the killing of hours-old and even week-old infants,\u201d agreed Matthew McReynolds of the <a href=\"https:\/\/pacificjustice.org\/\">Pacific Justice Institute<\/a>.<\/p>\n<p>In a statement, Wicks <a href=\"https:\/\/www.sacbee.com\/news\/politics-government\/capitol-alert\/article260105090.html\">accused<\/a> opponents of her proposal of \u201cpeddling an absurd and disingenuous argument that this bill is about killing newborns.\u201d She also stated that the intent of the bill not to allow infanticide.<\/p>\n<p>\u201cA judge would be hard-pressed to interpret that language as protecting a person who kills their baby up to seven days after birth intentionally,\u201d she said <a href=\"https:\/\/www.politifact.com\/factchecks\/2022\/apr\/06\/facebook-posts\/no-california-bill-wouldnt-allow-mothers-kill-thei\/\">according<\/a> to PolitiFact. \u201cOne of the tools judges would use in that case is legislative intent.\u201d<\/p>\n<p>But the California Assembly Committee on Judiciary released an <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billAnalysisClient.xhtml?bill_id=202120220AB2223\">official analysis<\/a> of the bill on April 3 which specifically states the original legislation would have the \u201cunintended\u201d effect of legalizing the murder of newborns:<\/p>\n<blockquote>\n<p><em>[T]he \u201cperinatal death\u201d language could lead to an unintended and undesirable conclusion. As currently in print, it may not be sufficiently clear that \u201cperinatal death\u201d is intended to be the consequence of a pregnancy complication. Thus, the bill could be interpreted to immunize a pregnant person from all criminal penalties for all pregnancy outcomes, including the death of a newborn for any reason during the \u201cperinatal\u201d period after birth, including a cause of death which is not attributable to pregnancy complications, which clearly is not the author\u2019s intent. <\/em><\/p>\n<\/blockquote>\n<p>The analysis says that, while the bill does not define the term \u201cperinatal,\u201d it applies \u201cup to 7 completed days of life.\u201d One provision in California state Welfare and Institutions code\u00a0<a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?lawCode=WIC&#038;sectionNum=14134.5.&#038;article=4.&#038;highlight=true&#038;keyword=PERINATAL\">states<\/a>: \u201c\u2018Perinatal\u2019 means the period from the establishment of pregnancy to one month following delivery.\u201d Yet another <a href=\"https:\/\/www.cdph.ca.gov\/Programs\/CFH\/DMCAH\/CPSP\/CDPH%20Document%20Library\/CPSP-Title22CPSPRegulations.pdf?TSPD_101_R0=087ed344cfab20006a7ce9a4d7f9d31fb7b3a90d9c58772bc6bb06ff5b116bbe34f4692ae26e2a860820fe7812143000058e4c7d7e778ee4460eb2ad96858448aaf6014898dd6bc8e22eac506b02b8c5cd33edc06327855f107a89922d2f035f\">portion<\/a> of state law extends the term \u201ccomprehensive perinatal services\u201d to \u201c60 days following delivery,\u201d the analysis adds.<\/p>\n<p>After the committee released its official analysis, Wicks added the\u00a0\u201cperinatal death due to a pregnancy-related cause\u201d \u00a0amendment to the legislation. The amended bill <a href=\"https:\/\/www1.cbn.com\/cbnnews\/us\/2022\/march\/hearing-date-set-for-proposed-ca-measure-that-pro-life-advocates-call-the-infanticide-bill\">passed<\/a> the Assembly Judiciary Committee \u00a0Tuesday by a <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billHistoryClient.xhtml?bill_id=202120220AB2223\">7-2<\/a>, <a href=\"https:\/\/lifelegaldefensefoundation.org\/life-legal-spokeswoman-blasts-california-infanticide-bill-in-hearing\/\">party-line<\/a> vote. But state and national pro-life leaders say the bill remains insufficient to protect unborn children from death by neglect or abuse.<\/p>\n<p>\u201cThe amendment does nothing to solve the perinatal, post-birth \u2018abortion\u2019 issue, what we know to be infanticide,\u201d Katie Glenn of <a href=\"https:\/\/aul.org\/\">Americans United for Life<\/a>, who testified against the bill, told The Daily Wire. \u201cThe bill extends far beyond protecting women from criminal liability. It explicitly also protects anyone who \u2018aids her\u2019 in making a pregnancy decision, which could include a partner, parent, abuser, or even a doctor who\u2019s performing an otherwise illegal abortion.\u201d<\/p>\n<p>Some are worried that AB 2223 might chill law enforcement investigations because it proscribes not merely police investigation but the \u201cthreat of investigation\u201d into perinatal deaths due to pregnancy in most cases.<\/p>\n<p>\u201cThe bill still prevents law enforcement from investigating \u2018perinatal death,\u2019 and the amendments Ms. Wicks proposed this week are woefully inadequate and will not protect any innocent children from death by neglect,\u201d Keller told The Daily Wire.<\/p>\n<p>Under the amended bill, the coroner need not \u201chold inquests for deaths related to or following known or suspected self-induced or criminal abortion,\u201d and a coroner\u2019s findings cannot be used to \u201cestablish, bring, or support a criminal prosecution \u2026 against any person, whether or not they were the person who was pregnant with the fetus.\u201d This would mean coroner\u2019s statements could not be used to prosecute abortionists.<\/p>\n<p>Glenn added, \u201cThe bill analysis says that law enforcement can investigate, but only until they find evidence of wrongdoing. Then they need to drop the case or they may face liability for \u2018interfering\u2019 with her so-called \u2018rights.\u2019\u201d<\/p>\n<p>The proposal would give anyone involved in a pregnancy-related death the right to sue any government agency, inspector, or police officer who investigates a purported \u201cstillbirth\u201d or \u201cmiscarriage\u201d for $25,000, plus punitive damages, lawyer\u2019s fees, and \u201cexpert witness fees\u201d for testimony, which could include testimony from Planned Parenthood employees.<\/p>\n<p>A court could also issue a restraining order against any officer deemed to have violated the law.<\/p>\n<p>\u201cThe reality is that already overburdened law enforcement agencies will look the other way to avoid the trouble of litigation,\u201d Glenn said.<\/p>\n<p>The bill has been referred to the Assembly Health Committee.<\/p>\n<p><em>The Daily Wire is one of America\u2019s fastest-growing conservative media companies and counter-cultural outlets for news, opinion, and entertainment.
