The ball was thrown by pitcher Keynan Middleton \u2014 a pitcher for the Los Angeles Angels \u2014 during warmups, and struck Galaz on the left side of his head after he had found his way close to the field on the third baseline.\u00a0<\/span><\/p>\n<p><span>\u201cFor three days, we didn\u2019t know if my son was going to live or die,\u201d Bryson\u2019s mother, Beatrice Galaz, <\/span><a href=\"https:\/\/www.latimes.com\/sports\/angels\/story\/2022-04-07\/angels-lawsuit-boy-fractured-skull-foul-ball-angel-stadium\"><span>said<\/span><\/a><span> in a statement. \u201cWe were relieved that he survived, but since that day he has struggled in school. He\u2019s simply not the same.\u201d\u00a0<\/span><\/p>\n<p><span>On Thursday, as reported by the Los Angeles Times, the young boy\u2019s family announced that they are suing the Angels for negligence.\u00a0<\/span><\/p>\n<p><span>\u201cThe [stadium] presented risks to spectators at the [stadium] prior to the beginning of scheduled baseball game, including Plaintiff, beyond those inherent to the sport of baseball because it failed to provide any warnings to spectators of the risk of regarding any dangers to spectators,\u201d <\/span><a href=\"https:\/\/voiceofoc.org\/2022\/04\/oc-fan-injury-lawsuit-against-the-la-angels-expects-to-test-the-baseball-rule-in-court\/\"><span>reads<\/span><\/a><span> the lawsuit.<\/span><\/p>\n<p><span>According to the Times, Scott says that the MLB franchise \u201ccould have protected themselves and their fans simply by asking the players to throw parallel to the third-base line,\u201d especially since the Angels had not extended the protective netting all the way down the foul lines.\u00a0<\/span><\/p>\n<p><span>\u201cAll they had to do was change their formation,\u201d attorney Kyle Scott <\/span><a href=\"https:\/\/archive.ph\/fyT7t\"><span>said<\/span><\/a><span>. \u201cIt\u2019s not unforeseeable that somebody is going to miss a ball, and it\u2019s going to be thrown hard enough to hurt somebody.\u201d<\/span><\/p>\n<p><span>Per reports, the lawsuit is challenging the so-called \u201c<\/span><a href=\"https:\/\/www.nfhs.org\/articles\/the-baseball-rule-liability-to-spectators-for-foul-ball-injuries\/\"><span>Baseball Rule<\/span><\/a><span>,\u201d which is a \u201clong standing legal doctrine that the operators of baseball facilities have a limited duty to protect fans from the risk of being hit by a foul ball and that spectators assume that risk because it is an inherent danger associated with attending a ballgame.\u201d<\/span><\/p>\n<p><span>\u201cThis is not a foul ball,\u201d Scott <\/span><a href=\"https:\/\/archive.ph\/fyT7t\"><span>said<\/span><\/a><span>. \u201cIt\u2019s not a thrown bat. This is not a risk inherent to the sport of baseball. The game is not going on.\u201d<\/span><\/p>\n<p><span>While the young boy survived, the family says he has struggled since the accident, causing the family to <\/span><a href=\"https:\/\/www.latimes.com\/sports\/angels\/story\/2022-04-07\/angels-lawsuit-boy-fractured-skull-foul-ball-angel-stadium\"><span>seek<\/span><\/a><span> \u201cunspecified damages, including compensation for medical costs and loss of future earnings.\u201d<\/span><\/p>\n<p><span>The issue of fan safety at Major League Baseball ballparks has become a hot-topic issue over the past several years.\u00a0<\/span><\/p>\n<p><span>On August 25, 2018, Linda Goldbloom \u2014 a 79-year-old woman \u2014 was struck in the head by a foul ball at Dodgers Stadium in Los Angeles. She died four days later from head injuries.<\/span><\/p>\n<p><span>Her husband, Erwin Goldbloom, reached an agreement with the Dodgers organization for a wrongful-death lawsuit.<\/span><\/p>\n<p><span>\u201cMy family\u2019s goal is to never have this happen to anybody again,\u201d Goldbloom said. \u201cNobody ever thinks it\u2019s going to happen to them, and a lot of foul balls, you can easily get out of the way of. But this one wasn\u2019t. I was sitting right next to her, and she was hit in the head.\u201d\u00a0<\/span><\/p>\n<p><span>The Angels have said that \u201cNo parties have reached out to us regarding this lawsuit.\u201d<\/span><\/p>\n<p><i>Joe Morgan is the Sports Reporter for The Daily Wire.
