Professor Klein did not accept their arguments and responded in an email that gained him the ire of students.<\/p>\n<p>\u201cThanks for your suggestion in your email below that I give black students special treatment, given the tragedy in Minnesota,\u201d Klein wrote back to the students.<\/p>\n<p>\u201cDo you know the names of the classmates that are black?\u201d he asked them. \u201cHow can I identify them since we\u2019ve been having online classes only?\u201d<\/p>\n<p>Klein went on to ask about students who \u201cmay be of mixed parentage, such as half black-half Asian?\u201d<\/p>\n<p>\u201cWhat do you suggest I do with respect to them? A full concession or just half?\u201d he asked.<\/p>\n<p>Klein also suggested \u201ca white student from [Minneapolis] might be possibly even more devastated by this, especially because some might think that they\u2019re racist even if they are not. My TA is from Minneapolis, so if you don\u2019t know, I can probably ask her.\u201d<\/p>\n<p>Klein ended his email with a quote from Martin Luther King Jr. about not evaluating people based on the color of their skin.<\/p>\n<p>Klein was eventually suspended and denounced by UCLA. It later reinstated him, but as Cornell professor William Jacobson noted, \u201cnot before his reputation and career were severely damaged.\u201d<\/p>\n<p>Klein is <a href=\"https:\/\/www.dailywire.com\/news\/professor-sues-ucla-after-he-was-suspended-for-refusing-to-grade-black-students-differently-than-white-students\">now suing<\/a>, alleging he was punished for treating students equally, as required by California law. He also alleges that UCLA\u2019s Anderson School of Management disregarded a broader UCLA directive\u00a0<em>not<\/em>\u00a0to punish him over student complaints. Klein also alleged that the incident caused him to lose clients where he was paid to be an expert witness.<\/p>\n<p>Klein wrote that he \u201cbrings this action not only to redress the wrongful conduct he has endured but also to protect academic freedom.\u201d<\/p>\n<p>On March 30, 2022, Los Angeles County Superior Court Judge H. Jay Ford III ruled against UCLA when it attempted to have Klein\u2019s lawsuit dismissed. Ford ruled that Klein provided sufficient evidence to \u201csupport judgment in his favor\u201d for several of his claims.
