Gretchen Whitmer announced Thursday that she is asking the state\u2019s Supreme Court to decide on the constitutionality of abortion. She filed a lawsuit challenging Michigan\u2019s 1931 law banning abortion in the event that the U.S. Supreme Court overturns landmark case <em>Roe v. Wade<\/em>.\u00a0<\/p>\n<p dir=\"ltr\">\u201cIf <em>Roe<\/em> is overturned, abortion could become illegal in Michigan in nearly any circumstance \u2013 including in cases of rape and incest \u2013 and deprive Michigan women of the ability to make critical health care decisions for themselves,\u201d Whitmer said in a statement to reporters, according to <a href=\"https:\/\/thehill.com\/news\/state-watch\/3261365-whitmer-asks-state-supreme-court-to-decide-whether-abortion-is-constitutional\/\">The Hill<\/a>.\u00a0<\/p>\n<p dir=\"ltr\">\u201cThis is no longer theoretical: it is reality. That\u2019s why I am filing a lawsuit and using my executive authority to urge the Michigan Supreme Court to immediately resolve whether Michigan\u2019s state constitution protects the right to abortion,\u201d she added.<\/p>\n<p dir=\"ltr\">On Dec. 1, the U.S. Supreme Court\u00a0<a href=\"https:\/\/townhall.com\/tipsheet\/madelineleesman\/2021\/12\/01\/pro-abortion-activists-urge-supreme-court-to-uphold-roe-v-wade-amid-mississippi-n2599916\">heard oral arguments<\/a> for the case <em>Dobbs v. Jackson Women\u2019s Health Organization<\/em>. The case surrounds a 15 week abortion ban in Mississippi. Mississippi\u2019s Attorney General Lynn Fitch asked the court directly to <a href=\"https:\/\/townhall.com\/tipsheet\/madelineleesman\/2021\/12\/02\/leftists-lose-it-over-possible-roe-v-wade-overturn-n2599985\">overturn<\/a> <em>Roe<\/em> and <em>Planned Parenthood v. Casey<\/em> in her amicus brief. A Dobbs decision is <a href=\"https:\/\/townhall.com\/tipsheet\/madelineleesman\/2021\/07\/26\/mississippi-attorney-general-urges-supreme-court-overturn-roe-wade-n2593104\">expected<\/a> next summer.\u00a0<\/p>\n<p dir=\"ltr\">In the meantime, other states, such as\u00a0<a href=\"https:\/\/townhall.com\/tipsheet\/madelineleesman\/2022\/03\/07\/desantis-expected-to-sign-15-week-abortion-ban-into-law-n2604214\">Florida<\/a>,\u00a0<a href=\"https:\/\/townhall.com\/tipsheet\/madelineleesman\/2022\/03\/24\/idaho-governor-signs-texas-style-abortion-ban-into-law-n2604984\">Idaho<\/a>,\u00a0<a href=\"https:\/\/townhall.com\/tipsheet\/madelineleesman\/2022\/02\/10\/report-shows-impact-of-texas-heartbeat-abortion-law-one-month-after-it-took-eff-n2603131\">Texas<\/a>,\u00a0<a href=\"https:\/\/townhall.com\/tipsheet\/landonmion\/2021\/09\/07\/kristi-noem-issues-executive-order-banning-telemedicine-abortions-n2595501\">South Dakota<\/a>, and\u00a0<a href=\"https:\/\/townhall.com\/tipsheet\/madelineleesman\/2022\/03\/31\/arizona-gov-ducey-signs-bills-limiting-abortion-and-protecting-womens-sports-n2605312\">Arizona<\/a> have created legislation restricting abortion and saving unborn lives.<\/p>\n<p>Whitmer, on the other hand, said she is going to \u201cfight like hell\u201d to maintain \u201creproductive freedom\u201d in her state, as <a href=\"https:\/\/www.politico.com\/news\/2022\/04\/07\/whitmer-sues-abortion-law-governors-00023649\" rel=\"noopener noreferrer\" target=\"_blank\">Politico<\/a> noted. If <em>Roe<\/em> is overturned, the 1931 law could become enforceable.<\/p>\n<blockquote>\n<p dir=\"ltr\">\u201cWhitmer, one of the most vulnerable Democratic governors up for reelection this fall, is using an extraordinary power afforded to Michigan governors to ask the state Supreme Court to take up the abortion case directly, without winding its way through lower courts. By challenging the nearly century-old law, Whitmer hopes to establish a proactive right to an abortion under the state constitution, regardless of developments at the national level.<\/p>\n<p dir=\"ltr\">\u2018No matter what happens to Roe, I am going to fight like hell and use all the tools I have as governor to ensure reproductive freedom is a right for all women in Michigan,\u2019 Whitmer said in a statement. \u2018If the U.S. Supreme Court refuses to protect the constitutional right to an abortion, the Michigan Supreme Court should step in.\u2019\u201d<\/p>\n<\/blockquote>\n<p dir=\"ltr\">In January, I <a href=\"https:\/\/townhall.com\/tipsheet\/madelineleesman\/2022\/01\/08\/pro-abortion-organizations-are-working-to-affirm-abortion-access-in-michigan-rep-n2601565\">reported<\/a> how a coalition of pro-abortion advocates were working toward compiling enough signatures to change the state\u2019s constitution to guarantee the right to abortion.\u00a0<\/p>\n<p dir=\"ltr\">The Detroit Free Press reported that pro-abortion advocates would need to collect over 400,000 signatures and have them verified by the state before their constitutional amendment petition goes on the November ballot.
