Gretchen Whitmer (D) announced Thursday she preemptively filed a lawsuit to make certain women could obtain abortions in Michigan ahead of a key U.S. Supreme Court decision expected this summer.<\/p>\n<p>Whitmer filed the suit with the Oakland County Circuit Court and, according to a press release from Whitmer\u2019s office, the governor is using her executive authority to request that the Michigan Supreme Court intervene and \u201cimmediately resolve\u201d her case.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>Whitmer\u2019s lawsuit comes in anticipation of a U.S. Supreme Court decision on\u00a0<em>Dobbs v. Jackson Women\u2019s Health Organization<\/em>, a major abortion case\u00a0<a title=\"This external link will open in a new window\" href=\"https:\/\/www.breitbart.com\/politics\/2021\/11\/30\/supreme-court-set-to-hear-biggest-challenge-to-roe-v-wade-in-decades\/\" target=\"_blank\" rel=\"noopener noreferrer\">challenging<\/a>\u00a0a Mississippi law that would prohibit most abortions after 15 weeks of pregnancy.<\/p>\n<p>The\u00a0<em>Dobbs<\/em>\u00a0case\u00a0prompted the Supreme Court to revisit the landmark 1973\u00a0<em>Roe v. Wade<\/em>\u00a0decision that declared abortion constitutional, and many pro-life advocates have expressed optimism that the court, which has a conservative majority, could overturn\u00a0<em>Roe<\/em>\u00a0and flip control of abortion laws back to individual states.<\/p>\n<p>\u201cIf Roe is overturned,\u00a0abortion could become illegal\u00a0in Michigan in nearly any circumstance\u2014including in cases of rape and incest\u2014and deprive Michigan women of the ability to make critical health care decisions for themselves,\u201d Whitmer claimed in a statement. \u201cThis is no longer theoretical: it is reality.\u201d<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>Whitmer cited a 1931 state law that makes performing an abortion a criminal act except when a mother\u2019s life is in danger. The law became unenforceable after\u00a0<em>Roe<\/em>\u00a0was decided, and Whitmer contended it could become enforceable again in the event that\u00a0<em>Roe<\/em>\u00a0is overturned.<\/p>\n<p>\u201cA near total abortion ban would rob women of their reproductive freedom and the ability to decide whether and when to have a child,\u201d Whitmer said.<\/p>\n<div id=\"attachment_14800177\" class=\"wp-caption alignnone\"><a href=\"https:\/\/media.breitbart.com\/media\/2020\/10\/50505676361_306884a620_o.jpg\"><\/a><\/p>\n<p class=\"wp-caption-text\">Joe Biden and Gretchen Whitmer (Adam Schultz \/ Biden for President)<\/p>\n<\/div>\n<p>The Michigan Democrat also warned that a ban on abortions poses a threat to a woman\u2019s \u201ceconomic freedom.\u201d<\/p>\n<p>Whitmer said, \u201cIt also would rob women of their economic freedom and their right to decide whether to become a parent: the biggest economic decision a woman will make in her lifetime.\u201d<\/p>\n<figure id=\"M-ROS-B3\" class=\"a8d adSo\"><\/figure>\n<p>\u201cNo matter what happens to\u00a0<em>Roe<\/em>, I am going to fight like hell and use all the tools I have as governor to ensure reproductive freedom is a right for all women in Michigan,\u201d Whitmer added.<\/p>\n<p>The governor\u2019s lawsuit occurred \u201calmost in tandem\u201d with a lawsuit filed in the Michigan Court of Claims by Planned Parenthood, the nation\u2019s largest abortion vendor,\u00a0<a class=\"x5l\" title=\"This external link will open in a new window\" href=\"https:\/\/www.detroitnews.com\/story\/news\/local\/michigan\/2022\/04\/07\/gretchen-whitmer-seeks-overturn-michigan-1931-abortion-ban\/9494945002\/\" target=\"_blank\" rel=\"noopener noreferrer\">seeking<\/a>\u00a0to deem abortions constitutionally sound under Michigan\u2019s constitution and prevent prosecutors from enforcing the 1931 law that criminalizes performing abortions, according to the\u00a0<em>Detroit News<\/em>.<\/p>\n<p>Whitmer, who is facing a competitive reelection race this year,\u00a0<a class=\"x5l\" title=\"This external link will open in a new window\" href=\"https:\/\/michiganrisingaction.org\/wp-content\/uploads\/2022\/04\/Gmail-Im-taking-action-right-now-to-protect-abortion-rights-in-Michigan.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">sent out<\/a>\u00a0a fundraising email right after her announcement soliciting campaign donations, according to a copy of the email shared by the conservative group Michigan Rising Action.<\/p>\n<p>The group called Whitmer\u2019s lawsuit a \u201cchoreographed publicity stunt\u201d and noted that Whitmer ally Dana Nessel, the state\u2019s attorney general, also made a \u201cstunning admission\u201d Thursday morning that she would not\u00a0<a class=\"x5l\" title=\"This external link will open in a new window\" href=\"https:\/\/twitter.com\/dananessel\/status\/1512123084022681606?s=20&#038;t=2UMM9iNEM2b3TlvShVLb3w\" target=\"_blank\" rel=\"noopener noreferrer\">defend<\/a>\u00a0the 1931 Michigan abortion law unless forced to by a court.<\/p>\n<p>Nessel reasoned in a statement, \u201cI didn\u2019t become attorney general so I could head an office that put women in a position in which some of them would likely die.\u201d<\/p>\n<p>Red states like\u00a0<a title=\"This external link will open in a new window\" href=\"https:\/\/www.breitbart.com\/border\/2022\/02\/10\/abortions-in-texas-fall-60-percent-under-first-month-of-new-law\/\" target=\"_blank\" rel=\"noopener noreferrer\">Texas<\/a>,\u00a0<a title=\"This external link will open in a new window\" href=\"https:\/\/www.breitbart.com\/politics\/2022\/02\/10\/lawmakers-in-tennessee-advance-resolution-to-honor-millions-of-aborted-babies\/\" target=\"_blank\" rel=\"noopener noreferrer\">Tennessee<\/a>,\u00a0<a title=\"This external link will open in a new window\" href=\"https:\/\/www.breitbart.com\/politics\/2022\/04\/06\/oklahoma-legislature-passes-near-total-abortion-ban\/\" target=\"_blank\" rel=\"noopener noreferrer\">Oklahoma<\/a>, and others have moved to protect the unborn with legislation placing limitations on abortion, but Democrat governors, now including Whitmer, have sought the opposite.<\/p>\n<p>Colorado Gov. Jared Polis (D) used his authority this week to\u00a0<a title=\"This external link will open in a new window\" href=\"https:\/\/www.breitbart.com\/politics\/2022\/04\/05\/colorado-codifies-fundamental-right-abortion-denies-any-rights-for-unborn\/\" target=\"_blank\" rel=\"noopener noreferrer\">codify<\/a>\u00a0unrestricted access to abortion in his state, while California Gov.
