It has remained on the books for decades despite the 1973\u00a0<i>Roe\u00a0<\/i>decision rendering it unenforceable and establishing the right to abortion nationally.\u201d<\/p>\n<p class=\"p1\">The law is one of multiple across the country that was in place before the Supreme Court ruled in <i>Roe v. Wade, <\/i>and one that could go back into effect if the Supreme Court Justices decide to overturn <i>Roe.<\/i><\/p>\n<p class=\"p1\">As the Guttmacher Institute <a href=\"https:\/\/www.guttmacher.org\/article\/2021\/10\/26-states-are-certain-or-likely-ban-abortion-without-roe-heres-which-ones-and-why\"><span class=\"s1\">reported<\/span><\/a> in October, \u201cBy the time the Supreme Court hears oral arguments in the Mississippi case, there will be nine states with an abortion ban still on the books from before<i>\u00a0Roe v. Wade<\/i>, 12 states with a trigger ban tied to\u00a0<i>Roe<\/i>\u00a0being overturned\u2026\u201d<\/p>\n<p class=\"p1\">On Twitter, Whitmer <a href=\"https:\/\/twitter.com\/GovWhitmer\/status\/1512052414773436418?ref_src=twsrc%5Egoogle%7Ctwcamp%5Eserp%7Ctwgr%5Etweet\"><span class=\"s1\">said<\/span><\/a>, \u201cToday I\u2019m filing a lawsuit to keep abortion legal in Michigan. With SCOTUS\u2019 willingness to overturn <i>Roe v Wade<\/i>, I\u2019m using my authority as governor to go directly to Michigan\u2019s Supreme Court to urge them to decide if abortion is constitutional. It\u2019s bold but necessary.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Today I\u2019m filing a lawsuit to keep abortion legal in Michigan. Here&#8217;s why:<\/p>\n<p>\u2014 Governor Gretchen Whitmer (@GovWhitmer) <a href=\"https:\/\/twitter.com\/GovWhitmer\/status\/1512052414773436418?ref_src=twsrc%5Etfw\">April 7, 2022<\/a><\/p>\n<\/blockquote>\n<p class=\"p1\">ABC News <a href=\"https:\/\/abcnews.go.com\/US\/michigan-gov-whitmer-sues-protect-abortion-rights-case\/story?id=83908705\"><span class=\"s1\">reported<\/span><\/a>, \u201cWhitmer filed the lawsuit, which names the elected prosecutors of 13 counties that have abortion clinics as defendants, to undo the statute.\u201d<\/p>\n<p class=\"p1\">\u201cNo matter what happens to <i>Roe<\/i>, I am going to fight like hell and use all the tools I have as governor to ensure reproductive freedom is a right for all women in Michigan,\u201d Whitmer said in a <a href=\"https:\/\/www.michigan.gov\/whitmer\/news\/press-releases\/2022\/04\/07\/whitmer-files-lawsuit-and-uses-executive-authority-to-protect-legal-abortion-in-michigan\"><span class=\"s1\">statement<\/span><\/a>. \u201cIf the U.S. Supreme Court refuses to protect the constitutional right to an abortion, the Michigan Supreme Court should step in. We must trust women \u2014 our family, neighbors, and friends \u2014 to make decisions that are best for them about their bodies and lives.\u201d<\/p>\n<p class=\"p1\">\u201cIf <i>Roe<\/i> is overturned,\u00a0abortion could become illegal\u00a0in Michigan in nearly any circumstance \u2014 including in cases of rape and incest \u2014 and deprive Michigan women of the ability to make critical health care decisions for themselves.\u00a0This is no longer theoretical: it is reality.\u00a0That\u2019s why\u00a0I am filing a lawsuit and using my executive authority to urge the Michigan Supreme Court to immediately resolve whether Michigan\u2019s state constitution\u00a0protects\u00a0the\u00a0right to abortion,\u201d she noted.<\/p>\n<p class=\"p1\">\u201cHowever we personally feel about abortion, a woman\u2019s health, not politics, should drive important medical decisions,\u201d Whitmer said in the statement. \u201cA woman must be able to make her own medical decisions with the advice of a healthcare professional she trusts \u2014 politicians shouldn\u2019t make that decision for her.\u201d<\/p>\n<p class=\"p1\">Planned Parenthood of Michigan and Dr. Sarah Wallett, an abortion provider, filed another lawsuit against the law on Thursday.<\/p>\n<p class=\"p1\"><span class=\"s2\">\u201cI joined this suit because it is fundamental to my oath as a physician to do no harm \u2014 and being forced to deny abortion care and violating the basic rights of my patients would cause them immense, irreversible harm,\u201d Wallett said in a statement.<\/span><\/p>\n<p class=\"p1\">As The Daily Wire previously\u00a0<a href=\"https:\/\/www.dailywire.com\/news\/florida-passes-15-week-abortion-ban\"><span class=\"s1\">reported<\/span><\/a>, the high court heard oral arguments late last year in the\u00a0<i>Dobbs v. Jackson Women\u2019s Health Organization<\/i>\u00a0case out of Mississippi over a law that doesn\u2019t allow abortions after 15 weeks of pregnancy.<\/p>\n<p class=\"p1\">The court could choose to uphold the Mississippi law, cutting away at the precedent established by\u00a0<i>Planned Parenthood v. Casey\u00a0<\/i>and\u00a0<i>Roe v. Wade.\u00a0<\/i>The justices could also decide to overturn\u00a0<i>Roe\u00a0<\/i>entirely or to strike down the Mississippi law. If\u00a0<i>Roe v. Wade\u00a0<\/i>is overturned, the decisions regarding abortion would be returned to the states rather than made legal on a broad scale across the country.<\/p>\n<p class=\"p1\">Several states have taken action to pass pro-life or pro-abortion legislation.
