Martin argued that police let him enter the Capitol and that he was waved into the building, The Daily Wire <a href=\"https:\/\/www.washingtonpost.com\/politics\/man-who-testified-at-his-capitol-riot-trial-awaits-verdict\/2022\/04\/06\/38b91c54-b5cc-11ec-8358-20aa16355fb4_story.html\">reported<\/a>.<\/p>\n<p>Brady Knowlton, who Dershowitz is representing, spent 18 minutes in the Capitol on January 6 after he and others passed several police officers walking in their opposite direction, <a href=\"https:\/\/www.dailywire.com\/news\/hes-facing-over-20-years-for-january-6-charges-his-lawyers-say-he-just-went-to-protest\">The Daily Wire<\/a> reported. Knowlton told The Daily Wire that an officer said, \u201cYou can go in as long as you don\u2019t break anything,\u201d before watching police and protestors shaking hands.<\/p>\n<p>Dershowitz said that \u201cthe subjective intent of the defendant is key,\u201d noting that the judge took Martin\u2019s word over that of the police and the prosecution. The courts \u201chave to look at the state of mind of the defendant,\u201d he said.<\/p>\n<p>\u201cIf that\u2019s the rule, we will win,\u201d he said. \u201cBecause it\u2019s clear Brady honestly and reasonably believed that he was not violating any rules or laws \u2014 that he was being welcomed \u2014 as long as he didn\u2019t do any damage.\u201d<\/p>\n<p>There are now three January 6 defendants who have resolved their cases in a trial \u2014 but Martin is the first to be acquitted of all charges. The defendant was charged with entering and remaining in a restricted building, disorderly and disruptive conduct in a restricted building, violent entry and disorderly conduct in a Capitol building, and parading, and demonstrating or picketing in a Capitol building.<\/p>\n<p>Knowlton has been <a href=\"https:\/\/www.justice.gov\/usao-dc\/case-multi-defendant\/file\/1389206\/download\">charged<\/a> with similar misdemeanors to Martin. He faces about 20 years in prison, as the DOJ uses statute 1512 in the U.S. code to prosecute him for obstruction of a congressional \u201cproceeding.\u201d<\/p>\n<p>Knowlton\u2019s attorneys, who include Harvard Law School professor Ronald Sullivan, say his law degree has been withheld by The University of Denver. Around the same time, Airbnb banned him and his wife, and U.S. Customs and Border Protection removed his Global Entry access, according to emails <a href=\"https:\/\/www.dailywire.com\/news\/hes-facing-over-20-years-for-january-6-charges-his-lawyers-say-he-just-went-to-protest\">obtained<\/a> by The Daily Wire.<\/p>\n<p>There was a status hearing for Knowlton\u2019s case in March.
