The amendment modified the act to block taxpayer money from funding any activity or school material that may \u201cpromote or encourage sexual activity,\u201d according to <a href=\"https:\/\/thefederalist.com\/2022\/04\/05\/joe-bidens-reversal-on-sexual-exposure-for-kids-shows-just-how-extreme-the-democratic-party-has-become\/\">The Federalist<\/a>.<\/p>\n<p>\u201cNone of the funds authorize under this Act shall be used to develop materials or programs directed at youth that are designed to directly promote or encourage, sexual activity, whether homosexual or heterosexual,\u201d the <a href=\"https:\/\/webarchive.loc.gov\/congressional-record\/20160316130610\/http:\/thomas.loc.gov\/cgi-bin\/query\/D?r103:32:.\/temp\/~r103NHPJaT::\">amendment<\/a> said.<\/p>\n<p>An earlier draft of the amendment explicitly banned the promotion of homosexuality.<\/p>\n<p>\u201cNo local educational agency that receives funds under this Act shall implement or carry out a program or activity that has either the purpose or effect of encouraging or supporting homosexuality as a positive lifestyle alternative,\u201d the <a href=\"https:\/\/webarchive.loc.gov\/congressional-record\/20160316130608\/http:\/thomas.loc.gov\/cgi-bin\/query\/D?r103:31:.\/temp\/~r103NHPJaT::\">amendment<\/a>, first introduced by former Sen. Bob Smith (R-NH) said. The legislation further clarified: \u201cA program or activity, for purposes of this section, includes the distribution of instructional materials, instruction, counseling, or other services on school grounds, or referral of a pupil to an organization that affirms a homosexual lifestyle.\u201d<\/p>\n<p>In the nearly three decades since, Biden has apparently changed his stance on such legislation. In February, Biden <a href=\"https:\/\/www.dailywire.com\/news\/i-have-your-back-biden-blasts-hateful-florida-bill-that-would-ban-discussion-of-sexual-orientation-or-gender-identity-in-elementary-schools\">said<\/a> legislation that banned discussion of sexual orientation and gender identity in elementary schools is \u201chateful.\u201d<\/p>\n<p>\u201cI want every member of the LGBTQI+ community \u2014 especially the kids who will be impacted by this hateful bill \u2014 to know that you are loved and accepted just as you are. I have your back, and my Administration will continue to fight for the protections and safety you deserve,\u201d Biden said in a Twitter post as the legislation was working its way through the Florida legislature.<\/p>\n<p>Florida Governor Ron DeSantis ignored Democratic protests over the bill and signed the legislation into law late last month. As <a href=\"https:\/\/www.dailywire.com\/news\/desantis-signs-parental-notification-bill-shrugs-off-dont-say-gay-uproar\">The Daily Wire<\/a> reported at the time:<\/p>\n<blockquote>\n<p><em>The bill has been wildly misrepresented as \u201cDon\u2019t Say Gay\u201d legislation by critics who\u00a0<a href=\"https:\/\/www.dailywire.com\/news\/floridas-lgbtq-bill-is-being-wildly-misrepresented-here-are-the-facts\">most notably taken issue<\/a>\u00a0with HB 1557\u2019s statement that\u00a0\u201cclassroom instruction by school personnel or third parties on sexual orientation or gender identity may not occur in kindergarten through grade 3 or in a manner that is not age appropriate or developmentally appropriate for students in accordance with state standards.\u201d<\/em><\/p>\n<p><em>Students in kindergarten are typically five years old, while third graders generally are eight or nine years old.<\/em><\/p>\n<p><em>Nowhere in the legislation is the word \u201cgay\u201d mentioned, though the word \u201cparent\u201d is mentioned 32 times and the word \u201cparental\u201d is mentioned eight times.
