According to the Post, Martin \u201csaid he \u2018went with the flow\u2019 as he approached the Capitol and testified that he saw a police officer wave him into the building.\u201d<\/p>\n<p>He was in the Capitol building for roughly 10 minutes on that day.<\/p>\n<div data-qa=\"article-body\">\n<blockquote>\n<p class=\"font-copy font--article-body gray-darkest ma-0 pb-md\" data-qa=\"drop-cap-letter\" data-el=\"text\"><em>Martin was charged with four misdemeanor counts: entering and remaining in a restricted building, disorderly and disruptive conduct in a restricted building, violent entry and disorderly conduct in a Capitol building and parading, demonstrating or picketing in a Capitol building.<\/em><\/p>\n<\/blockquote>\n<p data-qa=\"drop-cap-letter\" data-el=\"text\">Buzzfeed <a href=\"https:\/\/www.buzzfeednews.com\/article\/zoetillman\/capitol-riot-verdict-matthew-martin-not-guilty\">provided<\/a> more details behind McFadden\u2019s verdict:<\/p>\n<blockquote>\n<p><em>Announcing his decision from the bench, US District Judge Trevor McFadden said that although prosecutors argued there were numerous instances when Martin would have been aware that he wasn\u2019t allowed on Capitol grounds or inside the building \u2014 as he walked past fences with signs saying \u201cAREA CLOSED\u201d and recorded video of a broken window, blaring alarms, police in riot gear, and people who appeared to have encountered tear gas \u2014 those were outweighed by Martin\u2019s \u201cplausible\u201d belief that he had permission because officers didn\u2019t try to stop him from entering.<\/em><\/p>\n<p><em>McFadden said that Martin\u2019s conduct was as \u201cminimal and non-serious\u201das the judge could imagine for someone who went into the Capitol on Jan. 6. He said that Martin seemed to be a \u201csilent observer\u201d of the scene and didn\u2019t try to crowd the police, protest, or wave the \u201cTrump\u201d flag that he was carrying. Martin appeared \u201cquiet\u201d and \u201corderly\u201d as he walked inside the building, filmed video inside the Rotunda similar to how the media would behave, and didn\u2019t appear to interfere with officers as he filmed a clash with rioters later in the afternoon on a north terrace of the building.<\/em><\/p>\n<\/blockquote>\n<p>According to The Post, \u201cMore than 770 people have been charged with riot-related federal crimes.
