Torrico asked the student leader about outreach he was doing for a middle school leadership event. In the chat, Torrico wrote: \u201coutreach is very key for equity.\u201d The student president asked Torrico for his email.\u00a0<\/span><\/p>\n<p><span>The next day, Jackson, a high school football and lacrosse referee, wrote on Twitter, \u201cIt was very disturbing seeing you exhibit \u2018grooming\u2019 behavior. I do work with children and I get background checks, I suggest you do the same because last night was creepy.\u201d<\/span><\/p>\n<p><span>TJ Principal Ann Bonitatibus also expressed concerns about Torrico\u2019s interaction with the student in a November 23, 2020, email: \u201cthe original question that was posed by the parent about selection for the leadership summit would have been best addressed to a middle school principal, not to our SGA students\u2026 An exchange such as what happened on the Zoom meeting, while all within the public eye, is proof positive why FCPS has clear guidelines for which platforms are used for adults to interact with students.\u201d<\/span><\/p>\n<p><span>Torrico did not immediately return a request for comment filed through the TJ Alumni Action Group. <\/span><\/p>\n<p><span>The charges come even as Fairfax County, Virginia, prosecutor Steve Descano \u2014 a progressive who narrowly won his primary election with the help of funding from George Soros \u2014 has pledged not to prosecute minor crimes that \u201cdisproportionately hurt people of color,\u201d and routinely<\/span><a href=\"https:\/\/www.washingtonpost.com\/opinions\/the-fairfax-prosecutors-decision-to-sit-out-many-misdemeanor-cases-is-a-mistake\/2021\/04\/23\/5ea92bda-a3c0-11eb-a774-7b47ceb36ee8_story.html\"> <span>declines<\/span><\/a><span> to pursue crimes he deems minor.<\/span><\/p>\n<p><span>Last month, Descano\u2019s office let off a woman who allegedly violently abused an infant. On March 18, the office told the judge it would not pursue the woman because \u201cthere are no ACA\u2019s [prosecutors] available for a four-day jury trial beginning on March 21, 2022.\u201d<\/span><\/p>\n<p><span>Descano did not immediately return a Daily Wire request for comment.<\/span><\/p>\n<p><span><\/span><\/p>\n<p><span>Fairfax\u2019s all-Democrat school board ultimately abolished the entrance test in early 2021. Jackson and other parents, through a group called Coalition for TJ, filed a lawsuit alleging that the move was illegal and discriminated against Asians. Torrico and the TJ Alumni Action Group supported the school board.<\/span><\/p>\n<p><span>On September 23, 2021, Torrico went before a Fairfax County magistrate and filed two criminal complaints against Jackson. He called attention to Jackson\u2019s role in suing the school district, writing, \u201cHarry R. Jackson is a plaintiff on two lawsuits against FCPS.\u201d<\/span><\/p>\n<p><span>Magistrate Richard M. Miller issued two misdemeanor summons against Jackson citing<\/span><a href=\"https:\/\/law.lis.virginia.gov\/vacodefull\/title18.2\/chapter9\/article3\/\"> <span>Section 18.2-417<\/span><\/a><span>, an obscure law enacted in 1950 making it illegal to \u201cslander and libel\u201d the chastity of a woman. In the 1970s, the U.S. Supreme Court ruled against the criminalization of speech protected by the First Amendment, but the Virginia statute has remained in code. In 2020, the Democrat-controlled Virginia legislature<\/span><a href=\"https:\/\/lis.virginia.gov\/cgi-bin\/legp604.exe?201+ful+CHAP0900\"> <span>changed the language<\/span><\/a><span> to make <\/span>it illegal to express \u201cwords derogatory\u201d about a \u201cperson\u2019s character for virtue and chastity,\u201d instead of a \u201cfemale\u2019s character.\u201d<\/p>\n<p><span>The summons said Jackson\u2019s words could break the law by being insults that \u201ctend to violence and breach of the peace.\u201d<\/span><\/p>\n<p><span><img loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-363742 size-large\" src=\"https:\/\/www.dailywire.com\/wp-content\/uploads\/2022\/04\/harry-jackson-summons-745x576.jpg\" alt=\"\" width=\"745\" height=\"576\" srcset=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/04\/harry-jackson-summons-745x576-1.jpg 745w, https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/04\/harry-jackson-summons-300x232-1.jpg 300w, https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/04\/harry-jackson-summons-768x593-1.jpg 768w, https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/04\/harry-jackson-summons-1536x1187-1.jpg 1536w, https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/04\/harry-jackson-summons.jpg 1584w\" \/><\/span><\/p>\n<p><span>Jackson\u2019s attorney argued that amounted to \u201cthe criminalization of protected writings or statements, First Amendment speech \u2014 ignoring the face-to-face fighting words requirement of constitutionally-permissible criminalization.\u201d<\/span><\/p>\n<p><span>In January 2022, two Fairfax County police officers served Jackson at his home. Jackson recorded a video of himself receiving the summons.\u00a0<\/span><\/p>\n<p><span>On February 23, an attorney for Jackson asked a Fairfax County Circuit Court judge to dismiss the case. But Assistant Commonwealth Attorney Paul Vitali sought a continuance and received a hearing date for April 22.\u00a0<\/span><\/p>\n<p><span>Two days later, federal judge Claude Hilton ruled in favor of Jackson\u2019s group on the TJ admissions lawsuit, deciding that the new admissions policy is discriminatory to Asian American students.<\/span><\/p>\n<p><span>Two weeks after that, on March 14, 2022, Torrico filed two more criminal complaints, alleging that Jackson appeared on a local cable show and said Torrico had \u201cexhibited grooming behavior,\u201d and that nearly a year prior, he had tweeted \u201cPoor attempt at character assassination from a person who stalks kids online.\u201d A Fairfax County magistrate again issued two misdemeanor summons\u2019 against Jackson.<\/span><\/p>\n<p><span>The school board has said it will appeal the ruling that its abolishing of the TJ admissions test discriminates against Asians, and on March 31, a federal court agreed to let the new admissions sy<\/span>stem remain in place while the appeal is pending.<\/p>\n<p><span>Jackson\u2019s attorney Marina Medvin filed a<\/span><a href=\"https:\/\/medvinlaw.com\/wp-content\/uploads\/2022\/04\/Motion-to-Dismiss-First-Amendment.pdf\"> <span>motion to dismiss<\/span><\/a><span> his cases on Friday, arguing that they are unconstitutional.
