Last year, Sussmann\u2019s lawyers attempted to argue there was no evidence that Sussmann lied to Baker. <\/p>\n<p>On Monday evening, however, Durham revealed Sussmann conveyed that lie in a text message to Baker on Sept. 18, 2016 \u2014 the night before their meeting at the bureau. <\/p>\n<p><b><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/john-durham-says-evidence-shows-michael-sussmann-lied-when-pushing-trump-russia-claims\" target=\"_blank\" rel=\"noopener\">DURHAM SAYS EVIDENCE SHOWS SUSSMANN LIED WHEN PUSHING TRUMP-RUSSIA CLAIMS<\/a><\/b> <\/p>\n<p>\u201cJim \u2013 it\u2019s Michael Sussmann. I have something time-sensitive (and sensitive) I need to discuss,\u201d Sussmann wrote to the FBI top lawyer. \u201cDo you have availibilty [sic] for a short meeting tomorrow? I\u2019m coming on my own \u2013 not on behalf of a client or company \u2013 want to help the Bureau. Thanks.\u201d <\/p>\n<p>\u201cThe Special Counsel has brought a false statement charge on the basis of a purported oral statement made over five years ago for which there is only a single witness, Mr. Baker; for which there is no recording; and for which there are no contemporaneous notes by anyone who was actually in the meeting,&#8221; Sussmann\u2019s lawyers claimed last year. <\/p>\n<p>Durham <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/former-top-fbi-lawyer-james-baker-to-take-stand-in-durhams-case-against-michael-sussmann\">revealed<\/a> in October that Baker, who served as general counsel at the bureau from 2014 to 2018, will take the stand in the upcoming trial. <\/p>\n<p>Sussmann denied wrongdoing, pleaded not guilty, and called upon a federal judge to dismiss the case against him, even <u><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/clinton-campaign-lawyer-bets-on-fired-fbi-agent-peter-strzok-to-fight-durham-case\">relying<\/a><\/u> in part on <u><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/strzok-attacks-durham-indictment-against-sussmann-and-chilling-effect-on-fisas\">legal analysis<\/a><\/u> by <u><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/you-deserve-to-be-divorced-not-fired-peter-strzok-quotes-wife-in-arguing-against-fbi-firing-for-anti-trump-texts\">fired FBI agent Peter Strzok<\/a><\/u>. <\/p>\n<p>Lawyers for Sussmann <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/policy\/courts\/sussmann-lawyers-move-to-toss-durham-indictment-say-even-if-he-lied-it-was-immaterial\">asked<\/a> a federal court to dismiss the false statements <u><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/hillary-clinton-denounces-fake-scandal-after-durham-snooping-revelations\">charge<\/a><\/u> against their client in March, arguing Sussmann did not lie to the <u><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/fbi\">FBI<\/a><\/u> when passing along Trump-Russia collusion claims and, even if he did, the lie was \u201cimmaterial.\u201d <\/p>\n<p>Durham <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/durham-argues-sussmann-lie-fbi-mattered-as-he-pushed-collusion-claims\">disagreed.<\/a> <\/p>\n<p>\u201cThe defendant\u2019s false statement to the FBI General Counsel was plainly material because it misled the General Counsel about, among other things, the critical fact that the defendant was disseminating highly explosive allegations about a then-Presidential candidate on behalf of two specific clients, one of which was the opposing Presidential campaign,\u201d Durham countered last month. \u201cThe defendant\u2019s efforts to mislead the FBI in this manner during the height of a Presidential election season plainly could have influenced the FBI\u2019s decision-making in any number of ways.\u201d <\/p>\n<p>In the <u><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/durham-grand-jury-indicts-lawyer-allegedly-lying-fbi-concealing-ties-clinton-campaign\">indictment<\/a><\/u>, Durham said Baker spoke with Bill Priestap, the assistant director of the FBI\u2019s counterintelligence division, after meeting with Sussmann. Priestap \u201ctook contemporaneous notes\u201d about the Sussmann meeting, including that Sussmann had said he was not doing his work &#8220;for any client,&#8221; according to the indictment. <\/p>\n<p>Durham said on Monday that Baker met with Priestap as well as FBI deputy general Trisha Anderson, and the special counsel sought the court\u2019s permission to admit as evidence notes taken by both. Durham said that \u201cin communicating with these officials, the General Counsel relayed the details of his meeting with the defendant, including defendant\u2019s specific representation that he was not there on behalf of any client.\u201d <\/p>\n<p>The FBI assistant director wrote in his notes that Baker said Sussmann \u201csaid not doing this for any client.\u201d The deputy general counsel\u2019s notes said in part, \u201cNo specific client but group of cyber academics talked with him about research.\u201d <\/p>\n<p>Durham said \u201cthe Government moves to admit the Assistant Director\u2019s and Deputy General Counsel\u2019s contemporaneous handwritten notes on two grounds: as prior consistent statements by the General Counsel and as past recorded recollection as to these witnesses.\u201d <\/p>\n<p>Sussmann&#8217;s lawyers on Monday told the court they were fighting to keep those notes out, repeating that Baker &#8220;did not record the meeting, take any notes of the meeting, create an official report of the meeting, or otherwise memorialize it.&#8221; <\/p>\n<p>&#8220;Now, in an improper attempt to bolster Mr. Baker\u2019s testimony, the Special Counsel seeks to publish or adduce evidence of notes that two people who were not even in the meeting took regarding what was allegedly said in the meeting, even though these two people&#8230; have no reliable memory of even speaking to Mr. Baker about the meeting,&#8221; Sussmann&#8217;s lawyers lamented. &#8220;The Special Counsel claims that the notes may be properly admitted as past recollections recorded of Mr. Baker\u2019s prior consistent statements. The Special Counsel is simply not correct, and Mr. Sussmann accordingly moves to preclude introducing the notes, eliciting any testimony about them, or publishing them.&#8221; <\/p>\n<p>Sussmann\u2019s lawyers have said Sussmann met with the FBI in September 2016 \u201cto pass along information that raised national security concerns\u201d and characterized this as simply \u201cto provide a tip.\u201d The lawyers contended that Sussmann was \u201ccharged with making a false statement about an entirely ancillary matter \u2014 about who his client may have been when he met with the FBI \u2014 which is a fact that even the Special Counsel\u2019s own indictment fails to allege had any effect on the FBI\u2019s decision to open an investigation.\u201d <\/p>\n<p>Durham countered that \u201cthe defendant made his false statement directly to the FBI General Counsel on a matter that was anything but ancillary: namely, the existence \u2026 of attorney-client relationships that would have shed critical light on the origins of the allegations at issue.\u201d <\/p>\n<p>\u201cThe defendant\u2019s false statement to the FBI General Counsel was plainly material because it misled the General Counsel about, among other things, the critical fact that the defendant was disseminating highly explosive allegations about a then-Presidential candidate on behalf of two specific clients, one of which was the opposing Presidential campaign,\u201d Durham wrote. <\/p>\n<p><b><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/\">CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/a><\/b> <\/p>\n<p>Durham has also said Sussmann told a U.S. government agency, believed to be the CIA, about the dubious Russian bank connection in a February 2017 meeting, in which Sussmann again allegedly misled about whom his client was.
