The tactful naming made the bill radioactive to oppose, which is why 422 congressmen voted in favor while only\u00a0<a href=\"https:\/\/news.yahoo.com\/3-house-republicans-voted-against-175101917.html\">three opposed<\/a>. <\/p>\n<p>Rep. Thomas Massie, one of the three who voted against the bill, <a href=\"https:\/\/mobile.twitter.com\/RepThomasMassie\/status\/1498451874340610049?ref_src=twsrc%5Etfw%7Ctwcamp%5Etweetembed%7Ctwterm%5E1498451874340610049%7Ctwgr%5E%7Ctwcon%5Es1_&#038;ref_url=https%3A%2F%2Fwww.businessinsider.com%2F3-house-republicans-vote-against-lynching-hate-crime-2022-3\">expressed<\/a> a handful of concerns, including that there are a limited number of constitutionally specified federal crimes, that lynching is already criminalized, and that \u201cAdding enhanced penalties for \u2018hate\u2019 [on top of existing criminal punishments] tends to endanger other liberties such as freedom of speech.\u201d<\/p>\n<p>He also highlighted another potential pitfall of the legislation: \u201cThe bill creates another federal crime of \u2018conspiracy,\u2019 which I\u2019m concerned could be enforced overbroadly on people who are not perpetrators of a crime.\u201d Here\u2019s the section Massie is referring to:<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>Whoever conspires to commit any offense under paragraph (1), (2), or (3) shall, if death or serious bodily injury (as defined in section 2246 of this title) results from the offense, or if the offense includes kidnapping or an attempt to kidnap, aggravated sexual abuse or an attempt to commit aggravated sexual abuse, or an attempt to kill, be imprisoned for not more than 30 years, fined in accordance with this title, or both.<\/p>\n<\/blockquote>\n<p>The bill amends the\u00a0<a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/18\/249\">Hate Crimes Prevention Act<\/a>, passed in 2009, which defines and criminalizes hate crimes. The minimum qualification is an attempt \u201cto cause bodily injury\u201d due to the victim\u2019s race, sexual orientation, nationality, gender, religion, or disability.\u00a0<\/p>\n<p><a href=\"https:\/\/www.law.cornell.edu\/definitions\/uscode.php?height=800&#038;def_id=18-USC-64633832-849253638&#038;term_occur=2&#038;term_src=title:18:part:I:chapter:65:section:1365\">Bodily injury<\/a> can be defined as \u201cphysical pain\u201d or \u201cany other injury to the body, no matter how temporary.\u201d Sensibly, the 2009 law requires an attempt at violence to be made, which is a crime itself regardless of prejudiced motives.\u00a0The new \u201cantilynching\u201d law takes this a step further by criminalizing \u201cconspiracy\u201d to commit certain hate crimes.<\/p>\n<p>I\u2019m sure someone will retort:\u00a0<em>conspiracy to commit a federal crime is already a federal crime.<\/em>\u00a0This is not a universally accepted interpretation of\u00a0<a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/18\/371\">conspiracy law<\/a>,\u00a0nor does the law\u2019s language or\u00a0<a href=\"https:\/\/en.m.wikipedia.org\/wiki\/Conspiracy_against_the_United_States\">historical precedent<\/a>\u00a0justify such a broad interpretation \u2014 hence the ostensible necessity for the new antilynching law. Criminalized conspiracies are those plotting \u201cagainst the United States\u201d \u2013 like the Volkswagen executives who\u00a0<a href=\"https:\/\/en.m.wikipedia.org\/wiki\/Volkswagen_emissions_scandal\">attempted to defraud<\/a>\u00a0the Environmental Protection Agency by faking emission results and, more recently, the leader of the Oath Keepers who\u00a0<a href=\"https:\/\/www.justice.gov\/opa\/pr\/leader-alabama-chapter-oath-keepers-pleads-guilty-seditious-conspiracy-and-obstruction\">plead guilty<\/a>\u00a0to seditious conspiracy for his part in the Jan. 6, 2021 riot.\u00a0<\/p>\n<p>So as of last Tuesday, it is illegal to simply \u201cagree\u201d to participate in an act if it falls under the categories highlighted above. One can imagine dark political humor venturing into these categories (a comment such as \u201cI hate so-and-so so much I could kill him,\u201d for example) being interpreted as \u201cconspiring to lynch.\u201d <\/p>\n<p>The key issue here is that\u00a0<em>intent<\/em>\u00a0should not be the sole subject of a court case. The purpose of courts is for a neutral arbiter to determine whether someone\u2019s rights were violated during an encounter between two parties.\u00a0Conspiracy, if no action is taken in pursuit of it, involves only one party: the conspirators. Therefore, it alone constitutes no crime as it couldn\u2019t have possibly violated someone else\u2019s rights.\u00a0<\/p>\n<p>With this new law, the U.S. government has further expanded into the realm of policing thought crimes. Ominously, this law comes on the heels of the Department of Homeland Security\u2019s\u00a0<a href=\"https:\/\/www.dhs.gov\/news\/2022\/03\/11\/dhs-releases-report-internal-review-domestic-violent-extremism\">attempt<\/a> to\u00a0broaden the \u201cdomestic terrorism\u201d category and expand methods for identifying \u201cthreats.\u201d <\/p>\n<p>For those unaware, killings attributed to domestic extremists in 2020 and 2021 were each\u00a0far lower than in the previous five years. Overall there were only\u00a029 such killings\u00a0in 2021. Despite this, we continue to hear fearmongering from those in power.<\/p>\n<p>FBI Director Christopher Wray\u00a0went before Congress last year to <a href=\"https:\/\/www.theguardian.com\/us-news\/2021\/sep\/08\/post-911-domestic-terror\">declare<\/a> \u201cThe problem of domestic terrorism has been metastasizing across the country for a number of years.\u201d Attorney General Merrick Garland adopted a similar tone, <a href=\"https:\/\/www.huffpost.com\/entry\/white-supremacists-top-threat-merrick-garland_n_609c8424e4b014bd0ca77b6b\">warning<\/a> \u201cDomestic violent extremists pose an elevated threat in 2021, and in the FBI\u2019s view, the top domestic violent extremist threat we face comes from racially or ethnically motivated violent extremists, specifically those who advocate for the superiority of the white race.\u201d<\/p>\n<p>\u201cDomestic violent extremism poses the most lethal and persistent terrorism-related threat to our country today,\u201d <a href=\"https:\/\/www.dhs.gov\/news\/2021\/04\/26\/secretary-mayorkas-announces-domestic-violent-extremism-review-dhs\">claimed<\/a> Homeland Security Secretary Alejandro Mayorkas last spring. A White House press release\u00a0<a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/\">added<\/a>: \u201cThe two most lethal elements of today\u2019s domestic terrorism threat are (1) racially or ethnically motivated violent extremists who advocate for the superiority of the white race and (2) anti-government or anti-authority violent extremists, such as militia violent extremists.\u201d<\/p>\n<p>It\u2019s a mountain-out-of-a-molehill on par with the \u201cDon\u2019t Say Gay\u201d hysteria.\u00a0But this one may have far greater consequences down the road as texts, emails, social media posts, and everyday speech are monitored and analyzed by various three-letter agencies to establish the\u00a0<em>intent<\/em>\u00a0of our discourse.
