Mitt Romney announced plans Monday to confirm the same judge for the nation\u2019s highest court he opposed less than a year ago for a seat on the D.C. Circuit.<\/p>\n<p>President Joe Biden\u2019s pick to replace retiring Justice Stephen Breyer, Circuit Court Judge Ketanji Brown Jackson, is expected to reach successful confirmation after the Senate Judiciary Committee voted 11-11 to approve her nomination. Jackson\u2019s consideration is headed for a full-chamber vote pending a discharge petition.<\/p>\n<p>\u201cAfter reviewing Judge Jackson\u2019s record and testimony, I have concluded that she is a well-qualified jurist and a person of honor,\u201d Romney wrote in a statement after the nominee\u2019s confirmation hearings unearthed an <a href=\"https:\/\/thefederalist.com\/2022\/03\/18\/yes-the-senate-should-investigate-ketanji-brown-jacksons-leniency-towards-sex-predators\/\">extensive record<\/a> of leniency for individuals convicted of child sex crimes. <\/p>\n<p>\u201cShe more than meets the standard of excellence and integrity,\u201d Romney added.  Jackson\u2019s record is not only extremely weak on child sex offenders but also shows contempt for the Constitution.<\/p>\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\">\n<div class=\"wp-block-embed__wrapper\">\n<span class=\"ymuoXBherlx5TtHdLFOz7ScnW\"><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Romney opposed KBJ&#8217;s nomination to a lower federal court less than a year ago, which means he didn&#8217;t decide to support her for SCOTUS until *after* he learned of her horrifying history of going easy on child molesters and pedophiles. <a href=\"https:\/\/t.co\/w2DipvNg19\">https:\/\/t.co\/w2DipvNg19<\/a> <a href=\"https:\/\/t.co\/EVQ0nIRkGY\">pic.twitter.com\/EVQ0nIRkGY<\/a><\/p>\n<p>\u2014 Sean Davis (@seanmdav) <a href=\"https:\/\/twitter.com\/seanmdav\/status\/1511114324621901827?ref_src=twsrc%5Etfw\">April 4, 2022<\/a><\/p><\/blockquote>\n<p><\/span>\n<\/div>\n<\/figure>\n<p>In June last year, however, Romney <a href=\"https:\/\/www.govtrack.us\/congress\/votes\/117-2021\/s231\">voted no<\/a> on Jackson\u2019s nomination to the U.S. Court of Appeals for the District of Columbia Circuit. Jackson had served as a federal judge on the U.S. District Court for the District of Columbia since 2013 following an appointment from President Barack Obama. <\/p>\n<p>At her confirmation hearings last month, Republican senators pressed Jackson on issuing sentences well below federal guidelines in every child pornography case for which records are available, while Democrats <a href=\"https:\/\/thefederalist.com\/2022\/03\/31\/democrats-are-overlooking-the-seriousness-of-child-sex-crimes-to-protect-jackson\/\">looked the other way<\/a>. In one case, Jackson sentenced Wesley Keith Hawkins, arrested for possession of child pornography that included 17 videos, to three months in prison. She did so despite prosecutors seeking two years while the 2003 PROTECT Act recommended anywhere between 97 to 121 months. <a href=\"https:\/\/www.realclearinvestigations.com\/articles\/2022\/03\/29\/in_depth_ketanji_brown_jacksons_soft_spot_for_drug_dealers_pedophiles_and_terrorists_823900.html\">According<\/a> to Real Clear Investigations, Hawkins \u201ccontinued to seek out sexually arousing images of underage boys,\u201d years after his 2013 conviction.<\/p>\n<p>\u201cI am questioning your discretion, your judgment,\u201d said Missouri Republican Sen. Josh Hawley after <a href=\"https:\/\/www.youtube.com\/watch?v=l7yyd_LzElo&#038;t=1394s\">pressing<\/a> Jackson on the case. <\/p>\n<p>Jackson, who also served on the bipartisan U.S. Sentencing Commission, defended her constant sentencing below federal guidelines by claiming the recommendations are outdated. <\/p>\n<p>\u201cI impose a significant sentence and all of the additional restraints that are available in the law,\u201d Jackson told senators. \u201cThese people are looking at 20, 30, 40 years of supervision. They can\u2019t use their computers in a normal way for decades.\u201d<\/p>\n<p>In a later exchange with GOP Tennessee Sen. Marsha Blackburn, Jackson was unable to define the term \u201cwoman.\u201d<\/p>\n<p>\u201cI\u2019m not a biologist,\u201d Jackson <a href=\"https:\/\/thefederalist.com\/2022\/03\/23\/judge-nominated-to-supreme-court-on-the-basis-of-her-sex-cant-define-woman\/\">said<\/a>, even though Biden openly declared he nominated Jackson on the basis of her sex. <\/p>\n<p>Romney\u2019s declared support for Jackson is merely the latest episode of the Utah Republican deliberately splitting from the GOP in defining moments to self-righteously cast himself above the fray. While it is not uncommon for senators to vote in favor of judges for lower courts but deny support for higher chambers, it is exceedingly rare, if ever, that a senator gives a nominee the green light for the Supreme Court after a vote of rejection for a lower bench.<\/p>\n<p>In 2020, Romney <a href=\"https:\/\/www.dailywire.com\/news\/mitt-romney-marches-with-black-lives-matter-protesters-dems-praise-trump-mocks\">endorsed<\/a> the Black Lives Matter movement as he continued to carve out a reputation of a betrayer of GOP voters on pivotal issues. Romney was the only GOP senator to support Democrats\u2019 two impeachments of President Donald Trump and has enthusiastically endorsed Wyoming Rep. Liz Cheney\u2019s weaponization of House Speaker Nancy Pelosi\u2019s Jan. 6 Committee against political dissidents. <\/p>\n<p>The Utah senator, who has refused to endorse his Utah Republican colleague Sen. Mike Lee in the upcoming midterms, has even gone as far to <a href=\"https:\/\/thefederalist.com\/2022\/01\/26\/mitt-romney-to-fundraise-for-liz-cheney-at-vaccine-mandated-event\/\">fundraise<\/a> for Cheney at a vaccine-mandated event amid her highly competitive primary challenge in Wyoming. <\/p>\n<hr class=\"wp-block-separator\" \/>\n<p>\n  Tristan Justice is the western correspondent for The Federalist.
