Let me tell you how I got there.\u201d Graham pointed out that he did vote for Jackson\u2019s confirmation to the D.C. Circuit Court of Appeals, because he expected a Democratic president to appoint liberal judges to the federal courts, but said that \u201cthe Supreme Court is different from the Circuit Court.\u201d<\/p>\n<p>\u201cNow that you\u2019re talking about the Supreme Court, you\u2019re <a href=\"https:\/\/www.dailywire.com\/news\/what-gives-them-the-right-to-do-that-cornyn-grills-jackson-on-unenumerated-rights-judicial-policy-making\">making policy<\/a>, not just bound by it,\u201d he said.<\/p>\n<p>Graham also pointed out that Judge Jackson\u2019s nomination had a \u201cpolitical moment.\u201d He expressed contentment with the decision to nominate a black woman to the court, saying it would make the Court \u201clook more like America.\u201d But Graham claimed Judge Jackson\u2019s nomination was \u201cembraced by the most radical people in the Democratic movement, to the exclusion of everybody else. After four days of hearings, I now know why the left likes her so much. It became obvious to me why she was their \u2018first,\u2019 and apparently, only, choice.\u201d<\/p>\n<p>Graham lamented the fact that the Biden administration could have picked a more appealing candidate who was still liberal but could have gotten more Republican support, but decided to appease the far left instead.<\/p>\n<p>\u201cSo why am I voting no?\u201d Graham continued. \u201cOn our side, we like judges to be bound by the written letter of the law.\u201d<\/p>\n<p>He then pointed to a decision made by Judge Jackson in a <a href=\"https:\/\/casetext.com\/case\/make-rd-ny-v-mcaleenan\">2019 lawsuit<\/a> against former President Trump\u2019s immigration policy. While the text of the law clearly favored the Trump administration, Jackson ruled for the plaintiffs, who Graham noted were funded by a left-wing <a href=\"https:\/\/www.dailywire.com\/news\/judge-jackson-prepped-for-her-hearings-by-a-former-demand-justice-member-denies-relationship-to-dark-money-groups-pushing-her-scotus-nomination\">dark money<\/a> group. The decision was subsequently overturned by the D.C. Circuit Court of Appeals.<\/p>\n<p>\u201cThat to me says everything I need to know about how she\u2019s going to govern. [If] she wants an outcome, she\u2019s gonna find it. She\u2019s gonna get it. Activist to the core,\u201d Graham said.<\/p>\n<p>He also pointed to Republican criticism that accused Jackson of lowering sentences for <a href=\"https:\/\/www.dailywire.com\/news\/wouldnt-you-want-to-deter-people-lindsey-graham-grills-ketanji-brown-jackson-on-child-porn-cases\">child pornography<\/a> cases, saying that \u201clost [him] completely,\u201d and pressed for the Judiciary Committee to debate mandatory minimum sentences for child porn cases.<\/p>\n<p>Finally, Graham turned to the prospect of Jackson being the first black woman on the Supreme Court.<\/p>\n<p>\u201cThat\u2019s true, and the reason that\u2019s true is because of what y\u2019all did to Janice Rogers Brown,\u201d Graham said, pointing to Democrats\u2019 2005 filibuster of Judge Brown to the D.C. Circuit because of her conservative views, and the scuttling of her nomination to the Supreme Court because of Democrats\u2019 threats to filibuster her again. \u201cYou made it that way,\u201d Graham said, pointing to the Democratic side of the Committee room. \u201cBecause when you had a chance to support an African-American conservative, you used her ideology against her, you blocked her from being considered by this Committee, and we\u2019re supposed to be like trained seals over here, clapping when you appoint a liberal. That\u2019s not gonna work. We live in an America today where your ideology is held against you if you\u2019re conservative, and when you\u2019re a liberal we\u2019re supposed to embrace everything about you and not ask hard questions.
