\u2013 in some cases, even in relation to their own uses of terms such as &#8220;women&#8217;s health&#8221; \u00a0\u2013 \u00a0when asked by Fox News Digital.<\/p>\n<p class=\"speakable\">The Biden administration&#8217;s Department of Justice (DOJ), Department of Education, Department of Housing and Urban Development (HUD) and the Federal Bureau of Prisons were all contacted by Fox News Digital requesting a definition of &#8220;woman.&#8221; None of the agencies provided their definition or criteria for an individual to be categorized as a &#8220;woman,&#8221; despite each boasting entire initiatives aimed at helping women and DOJ declined to comment.<\/p>\n<p>Fox News Digital also reached out to the National Institutes of Health (NIH) to request the organization&#8217;s definition of &#8220;woman&#8221; in relation to terms such as &#8220;women&#8217;s rights&#8221; and &#8220;women&#8217;s healthcare.&#8221; NIH <a href=\"https:\/\/www.nih.gov\/about-nih\/what-we-do\/nih-almanac\/about-nih\" target=\"_blank\" rel=\"nofollow noopener\">describes itself<\/a> as &#8220;the steward of medical and behavioral research for the Nation,&#8221; refers to biological differences between females and males, including chromosomes, sex organs, and endogenous hormonal profiles,&#8221; the NIH claims on their website. &#8220;&#8216;Gender&#8217; refers to socially constructed and enacted roles and behaviors which occur in a historical and cultural context and vary across societies and over time. All individuals act in many ways that fulfill the gender expectations of their society. With continuous interaction between sex and gender, health is determined by both biology and the expression of gender.&#8221;<\/p>\n<p>However, the literature provided by the NIH did not address the meaning of &#8220;woman&#8221; or &#8220;women&#8221; in relation to sex and gender. Despite using the word frequently in their writing, no explanation is given on whether the word &#8220;women&#8221; \u2013 as used by the NIH \u2013 is descriptive of sex or gender.<\/p>\n<p>Asked for clarification, the NIH refused to comment further.<\/p>\n<p>&#8220;Glad the page was somewhat useful,&#8221; the NIH replied, but continued, &#8220;We don\u2019t have anything else to add.&#8221;<\/p>\n<p>Fox News Digital also reached out directly to the <a href=\"https:\/\/www.hhs.gov\/\" target=\"_blank\" rel=\"noopener\">Department of Health and Human Services<\/a> (HHS) for comment on the issue. After two days and multiple replies stating that the inquiry would be addressed, the HHS failed to provide an answer.<\/p>\n<p>The HHS&#8217; Office of Population Affairs released a <a href=\"https:\/\/opa.hhs.gov\/sites\/default\/files\/2022-03\/gender-affirming-care-young-people-march-2022.pdf\" target=\"_blank\" rel=\"nofollow noopener\"><u>document<\/u><\/a> Thursday titled &#8220;Gender Affirming Care and Young People.&#8221; The same day, the Substance Abuse and Mental Health Services Administration&#8217;s National Child Traumatic Stress Network \u2013 another subset of the HHS \u2013 released a <a href=\"https:\/\/www.nctsn.org\/sites\/default\/files\/resources\/fact-sheet\/gender-affirming-care-is-trauma-informed-care.pdf\" target=\"_blank\" rel=\"nofollow noopener\"><u>parallel document<\/u><\/a> titled, &#8220;Gender-Affirming Care Is Trauma-Informed Care.&#8221;<\/p>\n<p>The HHS documents describe what it calls appropriate treatments for transgender adolescents, including: &#8220;&#8216;Top&#8217; surgery \u2013 to create male-typical chest shape or enhance breasts;&#8221; and &#8220;&#8216;Bottom&#8217; surgery \u2013 surgery on genitals or reproductive organs, facial feminization or other procedures.&#8221;<\/p>\n<div class=\"image-ct inline\">\n<div class=\"m\"><source media=\"(max-width: 767px)\" \/><source media=\"(min-width: 767px)\" \/><img decoding=\"async\" src=\"https:\/\/a57.foxnews.com\/static.foxnews.com\/foxnews.com\/content\/uploads\/2021\/11\/640\/320\/GettyImages-1235605133.jpg?ve=1&#038;tl=1\" alt=\"WASHINGTON, DC - SEPTEMBER 30: \u00a0Secretary of Health and Human Services Xavier Becerra answers questions at a Senate Health, Education, Labor, and Pensions Committee hearing to discuss reopening schools during Covid-19 at Capitol Hill on September 30, 2021 in Washington, DC. (Photo by Greg Nash- Pool\/Getty Images)<br \/>\n      <span class=\"copyright\">(Greg Nash- Pool\/Getty Images)<\/span><\/p>\n<\/div>\n<\/div>\n<p>The RAND Corporation \u2013 a think tank <a href=\"https:\/\/www.rand.org\/about\/how-we-are-funded.html\" target=\"_blank\" rel=\"nofollow noopener\">almost entirely funded by the U.S. government<\/a> for the purposes of consultation on military policy \u2013 also stated that they did not have a definition for the word &#8220;woman,&#8221; despite extensive research into women&#8217;s rights, health and fitness.<\/p>\n<p>&#8220;You are correct in that RAND has done a number of studies related to gender and women specifically, but our reports are mostly focused on the impacts to women of various policies or circumstances,&#8221; a RAND spokesperson told Fox News Digital. &#8220;I don\u2019t believe your question is one that we have ever explicitly researched, thus I don\u2019t have anyone who can speak to it. Sorry we can\u2019t be more help.&#8221;<\/p>\n<p>Asked how RAND is able to measure or research the impacts to women of various policies without a definition of the word, RAND did not respond.<\/p>\n<p>RAND receives approximately $68.4 million in funds from the HHS, and more than 70% of their funds are from U.S. government agencies.<\/p>\n<p>Kara Dansky, U.S. president of Women&#8217;s Declaration International, told Fox News Digital on a press call hosted by Independent Women&#8217;s Voice &#038; Independent Women&#8217;s Law Center Thursday that &#8220;President Biden began to obliterate sex as a distinct category immediately upon taking office when he signed Executive Order 13988 on preventing and combating discrimination on the basis of so-called gender identity and sexual orientation.&#8221;<\/p>\n<div class=\"image-ct inline\">\n<div class=\"m\"><source media=\"(max-width: 767px)\" \/><source media=\"(min-width: 767px)\" \/><img decoding=\"async\" src=\"https:\/\/a57.foxnews.com\/static.foxnews.com\/foxnews.com\/content\/uploads\/2022\/03\/640\/320\/GettyImages-1239274442.jpg?ve=1&#038;tl=1\" alt=\"ATLANTA, GA - MARCH 17: \u00a0Members of Young Women For America protest transgender swimmer Lia Thomas at the NCAA Swimming and Diving Championships on March 17th, 2022 at the McAuley Aquatic Center in Atlanta Georgia.\" \/><\/div>\n<div class=\"caption\">\n<p>\n      ATLANTA, GA &#8211; MARCH 17: \u00a0Members of Young Women For America protest transgender swimmer Lia Thomas at the NCAA Swimming and Diving Championships on March 17th, 2022 at the McAuley Aquatic Center in Atlanta Georgia.<br \/>\n      <span class=\"copyright\">(Rich von Biberstein\/Icon Sportswire via Getty Images)<\/span><\/p>\n<\/div>\n<\/div>\n<p>She said that Biden administration agencies including DOJ, HHS, HUD and others &#8220;have all announced that women no longer exist as a coherent category as a matter of federal administrative law.&#8221;<\/p>\n<p>On Thursday, Independent Women\u2019s Voice, Independent Women\u2019s Law Center, Women\u2019s Liberation Front and other advocates introduced a &#8220;Women&#8217;s Bill of Rights&#8221; to &#8220;reserve biological sex as a distinct legal category.&#8221;<\/p>\n<p>A press release accompanying the announcement stated that dictionaries commonly define &#8220;woman&#8221; as an &#8220;adult female human being.&#8221; The advocacy groups are concerned by &#8220;activists&#8221; who are distorting and disputing the &#8220;biological basis of womanhood.&#8221;<\/p>\n<p>The issue has intensified as controversial female transgender swimmer, Lia Thomas, was allowed to compete in the NCAA women&#8217;s swimming championship last month. She beat out biological females in many of her races, which many say can be attributed to her larger size and stature as a biological male.\u00a0<\/p>\n<p><a href=\"https:\/\/foxnews.onelink.me\/xLDS?pid=AppArticleLink&#038;af_dp=foxnewsaf%3A%2F%2F&#038;af_web_dp=https%3A%2F%2Fwww.foxnews.com%2Fapps-products\" target=\"_blank\" rel=\"noopener\"><strong><u>CLICK HERE TO GET THE FOX NEWS APP<\/u><\/strong><\/a>\u00a0<\/p>\n<p>During the Senate hearings for Supreme Court nominee Judge Ketanji Brown Jackson last week, the prospective justice was asked by Sen. Marsha Blackburn, R-Tenn., to define the term &#8220;woman.&#8221; After a short back-and-forth, Jackson told the senator that she could not provide a definition because she is &#8220;not a biologist.&#8221;\u00a0<\/p>\n<p>&#8220;Can you provide a definition for the word \u2018woman?\u2019&#8221; the senator asked.<\/p>\n<p>&#8220;Can I provide a definition? No,&#8221; Jackson responded. &#8220;I can&#8217;t.&#8221;<\/p>\n<p>&#8220;You can&#8217;t?&#8221; Blackburn asked.<\/p>\n<p>&#8220;Not in this context, I&#8217;m not a biologist,&#8221; the judge replied.<\/p>\n<p>Jackson&#8217;s inability to define the word caused major backlash from conservatives, who questioned how she would handle topics explicitly related to gender differences if confirmed as a Supreme Court justice.<\/p>\n<p><i>Fox News&#8217; Kelly Laco contributed to this report.<\/i><\/p>\n","protected":false},"excerpt":{"rendered":"<p>NEWYou can now listen to Fox News articles!
