Texa<\/em>s<\/a>\u00a0lawsuit. The review will take place one month before Biden and Mayorkas lift the Title 42 barrier on May 23 and open the borders to an unlimited inflow of asylum-claiming migrants.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>Federal law says any migrant on U.S. soil <a href=\"https:\/\/twitter.com\/ReichlinMelnick\/status\/1509956256722792454?s=20&#038;t=gwYg-c9vJliUslq1iAeu-A\" target=\"_blank\" rel=\"noopener\">can apply for asylum<\/a>. But the <a href=\"https:\/\/codes.findlaw.com\/us\/title-8-aliens-and-nationality\/8-usc-sect-1225.html\" target=\"_blank\" rel=\"noopener\">law<\/a>\u00a0also says:\u00a0 \u201cMandatory detention:\u00a0Any alien subject to the procedures under this clause shall be detained pending a final determination of credible fear of persecution and, if found not to have such a fear, until removed.\u201d<\/p>\n<p>\u201cThe [federal] <a href=\"https:\/\/codes.findlaw.com\/us\/title-8-aliens-and-nationality\/8-usc-sect-1225.html\" target=\"_blank\" rel=\"noopener\">statute<\/a> is very clear that aliens who show up at the border without documentation or a visa are supposed to be detained throughout their entire immigration court proceedings,\u201d said Rob Law, the director of regulatory affairs and policy for the Center for Immigration Studies.<\/p>\n<p>\u201cNon-U.S. nationals (aliens) apprehended by immigration authorities when attempting to unlawfully enter the United States \u2026 must be detained while awaiting removal,\u201d the Congressional Research Service <a href=\"https:\/\/crsreports.congress.gov\/product\/pdf\/LSB\/LSB10297\" target=\"_blank\" rel=\"noopener\">wrote<\/a>\u00a0on May 10, 2019.<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>But Mayorkas refuses to detain the migrants, despite the damage to Americans. Mayorkas also minimizes the use of the Migration Protection Protocols program, which effectively detains migrants in Mexico until their cases are complete.<\/p>\n<p>Instead, he releases about <a href=\"https:\/\/www.cbp.gov\/newsroom\/stats\/southwest-land-border-encounters\" target=\"_blank\" rel=\"noopener\">60,000 migrants each month<\/a> into the United States under a variety of legal claims, as an additional 40,000 job-seeking migrants sneak across the border.<\/p>\n<p>This catch-and-release policy allows the migrants to quickly get the jobs that they need to repay their debts to coyotes, cartels, and banks. So the policy fuels the cartels\u2019 conveyor belt of labor and cash, and it allows people from many countries in Africa, South America, and Asia to fund their illegal entry into Americans\u2019 labor and housing markets. The inflow of illegals skews\u00a0the national economy in favor of investors, employers, and the coastal states.<\/p>\n<p>Mayorkas is just one of numerous officials who have ignored the detention-until-completion law, according to the CRS report: \u201cFor many years, immigration authorities had construed governing statutes and regulations to \u2026 [ensure]\u00a0 alien could seek bond and potentially be released from custody during the pendency of those proceedings.\u201d<\/p>\n<p>The hands-off, no-enforcement policy was reversed by President Donald Trump\u2019s Attorney General, Bill Barr, the CRS report notes:<\/p>\n<figure id=\"M-ROS-B3\" class=\"a8d adSo\"><\/figure>\n<blockquote>\n<p>On April 16, 2019 in [a legal directive titled] <a href=\"https:\/\/www.justice.gov\/eoir\/file\/1154747\/download\" target=\"_blank\" rel=\"noopener\">Matter of M-S-<\/a>, however, Attorney General (AG) William Barr reversed this position, ruling instead that aliens apprehended between ports of entry and placed in formal removal proceedings following a credible fear determination remain ineligible for bond [and release].<\/p>\n<\/blockquote>\n<p>Barr <a href=\"https:\/\/www.justice.gov\/eoir\/file\/1154747\/download\" target=\"_blank\" rel=\"noopener\">wrote<\/a>:<\/p>\n<blockquote>\n<p>In conclusion, the statutory text, the implementing regulations, and the Supreme Court\u2019s decision in <em>Rodriguez<\/em> all lead to the same conclusion: that\u00a0all aliens transferred from expedited to full proceedings after establishing a credible fear are ineligible for bond. [release].<\/p>\n<\/blockquote>\n<p>Even pro-migration advocates concede the point. The American Immigration Council, for example, <a href=\"https:\/\/www.americanimmigrationcouncil.org\/research\/alternatives-immigration-detention-overview\" target=\"_blank\" rel=\"noopener\">said<\/a>\u00a0on March 17, 2022:<\/p>\n<figure id=\"D-ROS-B2\" class=\"a8d\"><\/figure>\n<blockquote>\n<p>The United States has broad authority to detain certain categories of immigrants, migrants, and others seeking humanitarian protection as their proceedings wind their way through the immigration legal system.<\/p>\n<\/blockquote>\n<p>The detention law has been\u00a0on the books since the 1996 reforms, said Law, adding:<\/p>\n<blockquote>\n<p>It was the George W. Bush\/Republican \u201c<a href=\"https:\/\/www.breitbart.com\/tag\/any-willing-worker\/\" target=\"_blank\" rel=\"noopener\">Any Willing Worker<\/a>\u201d [policy] that was the beginning of just disregarding the mandatory detention provision. That let economic migrants loose into the interior of the country [supposedly to] show up to their court hearings. But as word got out that this is how the United States was treating migrants, more and more and more [migrants] came and overloaded the [asylum] system.<\/p>\n<p>Trump tried to create a hard reset through [<a href=\"https:\/\/www.breitbart.com\/tag\/migrant-protection-protocols\/\" target=\"_blank\" rel=\"noopener\">Migrant Protection Protocols<\/a>] MPP and other deterrence and enforcement measures, but then Biden comes and just basically blows up the entire detention provisions of the [Immigration and Naturalization Act] INA.<\/p>\n<\/blockquote>\n<p>The lower court judges in the Biden v. Texas case directed Biden\u2019s deputies to either detain the migrants or keep them in Mexico until their asylum cases is resolved. So far, Mayorkas has sent only a few hundred migrants back to Mexico under MPP. In February, he <a href=\"https:\/\/www.cbp.gov\/newsroom\/stats\/southwest-land-border-encounters\" target=\"_blank\" rel=\"noopener\">released almost 73,480 migrants<\/a> and sent just <a href=\"https:\/\/www.cbp.gov\/newsroom\/stats\/migrant-protection-protocols\" target=\"_blank\" rel=\"noopener\">93 back to Mexico under MPP<\/a>.<\/p>\n<p>Some GOP politicians recognize the government-backed labor migration hidden inside the overloaded asylum process.<\/p>\n<figure id=\"M-ROS-B4\" class=\"a8d adSo\"><\/figure>\n<p>\u201cWe are telling people \u2018If you come to the border, and you claim asylum \u2026 You can come in,\u2019\u201d Sen. Bob Portman (R-PA) said on March 30. He continued:<\/p>\n<blockquote>\n<p>By the way, there\u2019s a 1.5 million person backlog for dealing with asylum claims \u2014 1.5 million! This means that when you are allowed into the country to await an immigration judge looking at your case, there will be anywhere from four to six years before your case is considered. While you\u2019re in the United States, \u2026 you\u2019re working, your [illegal migrant] kids are going to school, you\u2019re getting your health care, you\u2019re part of the community.<\/p>\n<p>And obviously a lot of these people don\u2019t show up for their [asylum] court case. Some do, some don\u2019t. But the point is this system is attracting people to the border.<\/p>\n<\/blockquote>\n<p>Federal immigration law exists to protect the American <a href=\"https:\/\/www.breitbart.com\/politics\/2020\/07\/25\/eric-weinstein-immigration-is-cannibalization-by-the-elite\/\" target=\"_blank\" rel=\"noopener\">right to a level playing field<\/a> in the labor economy from unscrupulous employers, <a href=\"https:\/\/www.breitbart.com\/economy\/2021\/02\/07\/report-joe-biden-cuts-ice-protection-us-labor-rights\/\" target=\"_blank\" rel=\"noopener\">officials<\/a>, and politicians \u2014 such as President George. W. Bush and his \u201c<a href=\"https:\/\/www.breitbart.com\/economy\/2021\/04\/24\/george-w-bush-leads-secret-push-amnesty-cheap-labor\/\" target=\"_blank\" rel=\"noopener\">Any Willing Worker<\/a>\u201d pitch.<\/p>\n<p>Under\u00a0<a class=\"x5l\" href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/8\/1324a\" target=\"_blank\" rel=\"noopener external\">8 U.S. Code \u00a7 1324a<\/a>, passed by Congress in 1952, employers are barred from hiring foreigners unless the foreigners have work permits:<\/p>\n<blockquote>\n<p><span class=\"num bold\">(1)\u00a0<\/span><span class=\"heading bold\">In general<\/span><\/p>\n<p><span class=\"chapeau indent1\">It is unlawful for a person or other\u00a0<a class=\"colorbox-load definedterm x5l\" href=\"https:\/\/www.law.cornell.edu\/definitions\/uscode.php?width=840&#038;height=800&#038;iframe=true&#038;def_id=8-USC-1298275357-2006845841&#038;term_occur=999&#038;term_src=\" target=\"_blank\" rel=\"noopener external\">entity<\/a>\u2014<\/span><\/p>\n<\/blockquote>\n<p>But three decades of legal and illegal migration has delivered roughly 45 million workers, consumers, and renters into the U.S. economy. That imported population has delivered a colossal windfall to CEOs, investors, and Wall Street.<\/p>\n<p>The mass inflow of legal and illegal immigrants has helped shift roughly <a href=\"https:\/\/www.breitbart.com\/economy\/2021\/09\/18\/white-house-amnesty-cuts-wages-but-not-for-the-longer-run\/\" target=\"_blank\" rel=\"noopener\">$500 billion a year<\/a>\u00a0in wages from American employees to investors, according to data in the 2016 report on immigration by the National Academies of Science.<\/p>\n<p>The white-collar visa programs have helped to <a href=\"https:\/\/www.breitbart.com\/politics\/2022\/03\/29\/bidens-commerce-chief-fights-mayorkas-to-get-jobs-for-americans\/\" target=\"_blank\" rel=\"noopener\">shrink salaries<\/a>\u00a0for American tech graduates and <a href=\"https:\/\/www.breitbart.com\/health\/2022\/03\/24\/republican-leaders-push-bill-import-nurses-not-train-americans\/\" target=\"_blank\" rel=\"noopener\">nurses<\/a>, and to inflate the stock value of Fortune 500 companies <a href=\"https:\/\/www.breitbart.com\/politics\/2021\/11\/23\/lawsuit-spotlights-anti-american-corruption-in-h-1b-outsourcing-program\/\" target=\"_blank\" rel=\"noopener\">by $100 billion<\/a>, according to migration advocates. Those programs have also helped the C-Suite in many Fortune 500 companies by pushing millions of\u00a0<a href=\"https:\/\/www.breitbart.com\/politics\/2019\/10\/02\/census-shows-indian-graduates-are-pushing-americans-out-of-the-tech-industry\/\" target=\"_blank\" rel=\"noopener\">outspoken American professionals<\/a> out of tech careers, according to data in a\u00a0<a class=\"x5l\" href=\"https:\/\/www.census.gov\/library\/stories\/2021\/06\/does-majoring-in-stem-lead-to-stem-job-after-graduation.html\" target=\"_blank\" rel=\"noopener external\">2021 study<\/a>\u00a0by the Census Bureau.<\/p>\n<p>The migration programs have also shifted wages, investment, and wealth <a href=\"https:\/\/www.breitbart.com\/politics\/2021\/08\/13\/zuckerbergs-data-says-amnesty-gives-economic-windfall-coastal-democratic-states\/\" target=\"_blank\" rel=\"noopener\">from interior cities and states<\/a>\u00a0 \u2014 Detroit and West Virginia, for example \u2014 to the migration-inflated coasts.<\/p>\n<p>The mass inflow of at least 20 million illegal migrant laborers has pushed many Americans into poverty. The March 22 report by the Oxfam anti-poverty group\u00a0<a class=\"x5l\" href=\"https:\/\/webassets.oxfamamerica.org\/media\/documents\/low_wage_report_2022_final.pdf\" target=\"_blank\" rel=\"noopener external\">said<\/a>:\u00a0\u201cmore than 31.9 percent of the US labor force, or 51.9 million workers, currently make less than $15 per hour, and many are stuck at the federal minimum wage, which is less than half of that hourly rate.\u201d<\/p>\n<p>The damage was sketched out by the <em>Washington Post<\/em>\u2018s <a href=\"https:\/\/www.washingtonpost.com\/nation\/2022\/03\/20\/intergenerational-wealth-middle-class-spiral\/\" target=\"_blank\" rel=\"noopener\">March 20 description<\/a> of\u00a0Dave Ramsey, in Lincoln Park, Mich.:<\/p>\n<blockquote>\n<p>He\u2019d modeled himself after his father, umpiring alongside him in high school and riding with him on private investigations to train as his apprentice. But if his father\u2019s middle class ambitions had fallen apart after 50 years, Dave Jr.\u2019s collapsed by the time he turned 20. He dropped out of school against his father\u2019s advice so he could make some quick money laying cable, got injured at work and then got addicted to the prescription fentanyl patches. He\u2019d gotten clean and stayed that way for the past nine years while taking care of his father and his daughters. He\u2019d even gone back to school at night to earn his diploma, but the life available to him didn\u2019t include the Masons, or a union job, or a thriving American middle class. Instead he\u2019d hustled his way through a series of contracting jobs that paid a living wage one week and nothing the next, until the family\u2019s monthly bills were so far beyond its means that Dave Sr. started burying them in the bottom of a box.<\/p>\n<\/blockquote>\n<p>Coastal business groups are cheering the Title 42 takedown.\u00a0<a href=\"https:\/\/twitter.com\/TheToddSchulte\/status\/1509962511071821824?s=20&#038;t=DXm5Crd78OQIh0u0kTTbBA\" target=\"_blank\" rel=\"noopener\">A statement<\/a> from the Zuckerberg-funded FWD.us advocacy group for West Coast investors said:<\/p>\n<blockquote>\n<p>The goal should be a functional migration system broader than asylum. This requires expanding legal immigration avenues \u2026 Ending Title 42 is only one tiny piece of building that functional migration system,\u201d said the group, whose <a href=\"http:\/\/web.archive.org\/web\/20190330182400\/https:\/\/www.fwd.us\/founders\/\" target=\"_blank\" rel=\"noopener\">wealthy founders gain<\/a>\u00a0more stock market wealth as the federal government extracts more <a href=\"https:\/\/www.breitbart.com\/politics\/2019\/06\/19\/new-york-democrats-gift-250000-illegal-alien-drivers-to-uber-delivery-companies\/\" target=\"_blank\" rel=\"noopener\">workers, consumers, and renters<\/a> for use in the U.S. economy.<\/p>\n<\/blockquote>\n<p>But D.C. reporters are oblivious to the law and the economics, in part, because most are pressured by editors to focus on the migrants\u2019 dramatic journeys.<\/p>\n<p>In a call with Department of Homeland Security officials on Friday, agency officials invited questions from at least six favored reporters. But none of the reporters questioned the legality of releasing economic migrants into Americans\u2019 labor market or the impact on Americans. Similarly, CNN\u2019s Jake Tapper interviewed Mayorkas on April 1 and did not<a href=\"https:\/\/www.breitbart.com\/\"> question the legality<\/a> of Mayorkas\u2019s open-borders policies.<\/p>\n<p>Many polls show the public wants to like immigration and immigrants \u2014 but it also wants to\u00a0<a href=\"http:\/\/60p3co1nax34ovc830mr2sak-wpengine.netdna-ssl.com\/wp-content\/uploads\/March-2022-Omnibus-EXTERNAL-TOPLINE.pdf\" target=\"_blank\" rel=\"noopener\">prioritize fellow Americans<\/a>.<\/p>\n<p>For example, a March 18-21 poll of 1,050 registered voters by Echelon Insights reported that 29 percent of Americans strongly agreed that \u201cAmerica should not increase the number of immigrants it lets in, as immigrants could lower wages, take jobs away from Americans, and be a drain on taxpayers.\u201d<\/p>\n<p>Just 21 percent strongly agreed that \u201cAmerica should increase the number of immigrants it lets in, as immigrants will help address labor market shortages, start businesses, and revitalize declining cities and towns.\u201d<\/p>\n<p>The government\u2019s operation of the nation\u2019s immigration system is designed to deceive the public and the media about the large-scale extraction of workers and consumers from poor countries, Law said.<\/p>\n<blockquote>\n<p>It\u2019s always \u201cCan you do just enough to deceive the public?\u201d \u2026\u00a0 Any removals that are done by the administration are simply [driven by] bad optics, such as the Haitians congregating under the [Del Rio] bridge, when they just can\u2019t get away from the bad publicity. [Then they] say, \u201cOh, we\u2019re not totally open borders, we\u2019re using our limited resources to get the worst actors.\u201d<\/p>\n<\/blockquote>\n<p>The government\u2019s cooperation with the cartels is hidden behind theatrical enforcement of borders laws and a curtain of legal complexity, he said:<\/p>\n<blockquote>\n<p>They are partners in this business transaction of importing people and workers into the United States. This is this is a mutually beneficial arrangement where the cartels are being enriched by all these people who are paying the money for the transport, and the Biden administration willingly welcomes them, helps process them, and places them wherever they want to be the inside of the country \u2026.
