Though the ruling is huge for Republicans, the ruling will be appealed to the Court of Appeals, the state\u2019s top court.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>If the ruling is upheld on appeal, New York state lawmakers may miss the June primary deadline for the creation of a second map. The judge has ordered state legislators to draw new lines with bipartisan support by April 11.<\/p>\n<p>The\u00a0gerrymandered map was originally <a href=\"https:\/\/www.breitbart.com\/politics\/2022\/02\/05\/republican-lawsuit-accuses-ny-democrats-of-gerrymandering-maps-as-15-assembly-republicans-legitimized-brazen-process\/\">designed<\/a> with the help of 15 Assembly Republicans that may have legitimized the\u00a0process the court found illegal. In February,\u00a0lawsuit\u00a0<a href=\"https:\/\/www.democracydocket.com\/wp-content\/uploads\/2022\/02\/2022-02-03-Harkenrider-petition.pdf\">asserted<\/a>\u00a0the \u201cLegislature had no authority to enact the new map because the Legislature did not follow the\u00a0exclusive\u00a0process for enacting replacement maps that the People enshrined through the 2014 amendments, meaning that the congressional map is entirely void.\u201d<\/p>\n<p>The lawsuit was filed in the Supreme Court of Steuben County, New York, a Republican stronghold in the southwest part of the state. Judge Patrick McAllister sided with Republicans because the maps did not follow the state\u2019s constitutional process.<\/p>\n<p>\u201cThis court finds that the November, 2020 legislation which purported to authorize the legislature to act in the event the IRC failed to act was not a mere enactment of legislation to help clarify or implement the Constitution, but in fact substantially altered the Constitution,\u201d the judge wrote on page 10 of the 18-page ruling. \u201cTherefore the Court finds the recently enacted Congressional maps are unconstitutional.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Early read on NY lower court judge blocking Dems\u2019 22D-4R gerrymander: ruling likely to be stayed on appeal, so Dems believe map will remain in place, at least for 2022. <\/p>\n<p>Huge stakes here, as a \u201cneutral\u201d map could cost Dems 3-4 seats and erase their nationwide remap gains. <a href=\"https:\/\/t.co\/qeAjHeWZ5z\">pic.twitter.com\/qeAjHeWZ5z<\/a><\/p>\n<p>\u2014 Dave Wasserman (@Redistrict) <a href=\"https:\/\/twitter.com\/Redistrict\/status\/1509640172106833923?ref_src=twsrc%5Etfw\">March 31, 2022<\/a><\/p>\n<\/blockquote>\n<p>In January, the Democrats in New York were able to push forward and enact the now-unconstitutional map because\u00a015 state Assembly Republicans voted for the Democrat-drawn gerrymandered Assembly map to protect their own Assembly seats. These assemblymen likely legitimized the process the lawsuit alleged was illegal.<\/p>\n<figure id=\"M-ROS-B3\" class=\"a8d adSo\"><\/figure>\n<p>Gavin Wax, president of the New York Young Republican Club, told Breitbart News on Friday there \u201cwas no excuse\u201d for the 15 Republicans to enable the Democrat map.<\/p>\n<p>\u201cThat fact that a court in deep blue New York ruled that these maps were unconstitutional and illegal show how out of touch the 15 Assembly Republicans who voted for the state maps were,\u201d\u00a0Wax said. \u201cThere was no excuse for them to break party ranks and vote with the Democrats.\u201d<\/p>\n<p>\u201cI am now worried that their votes to support the maps will be used against us if this goes to appeal,\u201d Wax added about the 15 Assembly members that may have\u00a0legitimized the faulty redistricting process the lawsuit found illegal.<\/p>\n<p>These are the 15 State Assembly members who voted with the Democrats to legitimize the gerrymandering process:<\/p>\n<p>GOP Leader William Barclay<br \/>Michael Fitzpatrick NY8<br \/>Karl Brabenec 98<br \/>Brian Miller 101<br \/>Chris Tague 102<br \/>Kieran Michael Lalor 105<br \/>Joseph Angelino 122<br \/>John Lemondes 126<br \/>Philip Palmesano 132<br \/>Josh Jensen 134<br \/>Stephen Hawley 139<br \/>Michael Norris 144<br \/>Angelo Morinello 145<br \/>Andy Goodell 150<br \/>Joseph M. Giglio 148<\/p>\n<p>Overall, Republicans have struggled in redistricting.\u00a0According to David Wasserman, senior editor of the Cook Political Report, Democrats have\u00a0taken\u00a0a two- to three-seat advantage in the redistricting battle where Republicans were expected to dominate.<\/p>\n<p>The establishment media have even taken notice of how \u201c<a class=\"editor-rtfLink x5l\" href=\"https:\/\/nymag.com\/intelligencer\/2021\/12\/democrats-are-doing-weirdly-well-in-redistricting.html\" target=\"_blank\" rel=\"noopener external\">weirdly well<\/a>\u201d Democrats are performing in nationwide redistricting battles. \u201c[A]ccording to at least one analyst, there is actually an outside chance that the final map will be tilted, ever so slightly, in the\u00a0<em>Democrats\u2019<\/em>\u00a0favor,\u201d the\u00a0<em>New York Magazine\u00a0<\/em>reported in December.<\/p>\n<p>The case is<em>\u00a0Harkenrider<\/em>\u00a0v.\u00a0<em>Gov. Hochul<\/em>.
