Jerry Nadler, removes the drug from a list created by the Controlled Substances Act, and creates an excise tax on marijuana and other cannabis products. Marijuana is currently <a href=\"https:\/\/www.dea.gov\/drug-information\/drug-scheduling\">listed<\/a> as a Schedule I drug under the Controlled Substances Act, meaning that it has \u201cno currently accepted medical use and a high potential for abuse.\u201d This classification has been heavily contested by advocates, who <a href=\"https:\/\/dailycaller.com\/2017\/03\/04\/federal-ban-is-barring-access-to-medical-marijuana-for-veterans\/\">argue<\/a> that it fails to take into account reported medicinal benefits.<\/p>\n<p>The legislation \u201cis long overdue\u2026 and would reverse decades of failed federal policies based on the criminalization of marijuana. It would also take steps to address the heavy toll these policies have taken across the country, particularly among communities of color,\u201d Nadler said in a floor speech.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">Criminal penalties for marijuana offenses, and the resulting collateral consequences, are unjust and harmful to our society. The <a href=\"https:\/\/twitter.com\/hashtag\/MOREAct?src=hash&#038;ref_src=twsrc%5Etfw\">#MOREAct<\/a> comprehensively addresses these injustices. Nadler (@RepJerryNadler) <a href=\"https:\/\/twitter.com\/RepJerryNadler\/status\/1509914343659511808?ref_src=twsrc%5Etfw\">April 1, 2022<\/a><\/p>\n<\/blockquote>\n<p>Although <a href=\"https:\/\/dailycaller.com\/2019\/03\/06\/medical-marijuana-georgia-2018\/\">support<\/a> for decriminalization has become <a href=\"https:\/\/www.politico.com\/news\/2021\/04\/20\/senate-democrats-weed-legalization-schumer-483747\">bipartisan<\/a> in recent years, only three Republicans voted with 217 Democrats to pass Nadler\u2019s bill. Republican South Carolina Rep. Nancy <a href=\"https:\/\/dailycaller.com\/2021\/11\/15\/republican-backed-bill-would-decriminalize-marijuana-controlled-substance-act-nancy-mace\/\">Mace<\/a>, who introduced a different legalization bill in November, told The Hill that Democrats\u2019 refusal to allow amendments to the legislation made it unattractive to Republicans.<\/p>\n<p>\u201cI have incentives for states not to sell to kids or market or advertise to kids,\u201d she <a href=\"https:\/\/thehill.com\/news\/house\/3255959-deep-doubts-on-legal-marijuana-remain-in-gop\/\">said<\/a> of her legislation. \u201cMy tax is a lot lower at 3 percent. Theirs is eight after three years, and we all know that you\u2019re going to guarantee illicit markets if you make taxes too high.\u201d<\/p>\n<p>The MORE Act also requires the Government Accountability Office and Small Business Administration to encourage marijuana sales by businesses run by \u201cs<span dir=\"ltr\" role=\"presentation\">ocially and economically disadvan<\/span><span dir=\"ltr\" role=\"presentation\">taged individuals [and] individuals adversely impacted by<\/span> <span dir=\"ltr\" role=\"presentation\">the War on Drugs,\u201d while considering \u201cthe racial, ethnic, eco<\/span><span dir=\"ltr\" role=\"presentation\">nomic and gender composition of the eligible State <\/span><span dir=\"ltr\" role=\"presentation\">locality.\u201d<\/span><\/p>\n<p>Republican Ohio Rep. David Joyce cited tax hikes, as well as the racial provisions, in a letter explaining his opposition.<\/p>\n<p>The MORE Act \u201cplac[es] an additional tax on legal operators to pay for the cost of industry access for illegal operators,\u201d he <a href=\"https:\/\/www.marijuanamoment.net\/pro-legalization-gop-congressmans-office-explains-opposition-to-marijuana-bill-and-offers-resources-to-colleagues\/\">wrote<\/a> to House GOP colleagues.<\/p>\n<p>Senate Majority Leader Chuck Schumer has proposed separate legislation to decriminalize marijuana. His bill would <a href=\"https:\/\/dailycaller.com\/2021\/07\/14\/chuck-schumer-cory-booker-joe-biden-marijuana-legalization-ron-wyden\/\">send<\/a> all regulatory decisions to the states, and expunge federal convictions for non-violent possession or distribution of the drug. <a href=\"https:\/\/dailycaller.com\/2021\/04\/20\/chuck-schumer-4-20-marijuana-weed-legalization\/\"><strong>(RELATED: Sen. Chuck Schumer Shares A Message For Those Celebrating 4\/20)<\/strong><\/a><\/p>\n<p>Both President Joe <a href=\"https:\/\/dailycaller.com\/2021\/04\/20\/biden-supports-federal-decriminalization-of-marijuana-and-legalization-of-medical-use-psaki-says\/\">Biden<\/a> and Vice President Kamala Harris support the federal decriminalization of marijuana, although both politicians have a <a href=\"https:\/\/dailycaller.com\/2019\/08\/16\/tulsi-gabbard-kamala-harris-weed\/\">history<\/a> of supporting legal crackdowns.
