Silveira was arrested last year for making a YouTube video criticizing the STF, Brazil\u2019s highest court; the ankle monitor was a requirement of his tentative release.<\/p>\n<p>Silveira, a conservative aligned with President Jair Bolsonaro, agreed to leave his office \u2013 where legislative immunity would protect him from arrest \u2013 and wear the ankle monitor after STF Justice Alexandre de Moraes, who initially ordered his arrest, imposed a daily penalty of\u00a015,000 reais ($3,163.89) for not complying. Silveira told reporters he could not, in good conscience, allow such a financial penalty on his family.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>Brazil\u2019s STF is its highest court \u2013 the equivalent of the United States Supreme Court \u2013 and has the power to order arrests and interpret the constitution. De Moraes is one of the majority of justices on the bench (referred to in Portuguese as \u201cministers\u201d) appointed by socialist or left-aligned presidents \u2014 Bolsonaro\u2019s three predecessors Luiz In\u00e1cio Lula da Silva, Dilma Rousseff, and Michel Temer. The court has aggressively expanded its campaign against the free speech of conservatives in the country since Bolsonaro became president. De Moraes himself has spearheaded the <a href=\"https:\/\/oantagonista.uol.com.br\/brasil\/terca-livre-pede-que-stf-derrube-decisao-que-suspendeu-redes-sociais-do-canal\/\">shutdown<\/a> of conservative news site Ter\u00e7a Livre, Silveira\u2019s arrest, and an alarming series of <a href=\"https:\/\/www.breitbart.com\/latin-america\/2020\/05\/29\/fake-news-brazilian-court-orders-raids-on-pro-bolsonaro-comedians-journalists\/\">raids<\/a> in 2020 against comedians, YouTubers, and journalists perceived to be aligned with Bolsonaro, on \u201cfake news\u201d grounds.<\/p>\n<p>Silveira, serving his rookie term in Congress after serving in the Brazilian police force, was initially <a href=\"https:\/\/www.breitbart.com\/latin-america\/2021\/02\/17\/brazil-supreme-court-arrests-congressman-insulting-youtube-tirade\/\">arrested<\/a> in February 2021 after publishing a Youtube video commentary featuring a profanity-laced tirade against the STF in which he accused most of the court\u2019s justices of having \u201cno character, no scruples, no morals.\u201d De Moraes called the language itself a \u201cflagrant crime\u201d and accused Silveira in the arrest warrant of\u00a0\u201cincitement of the population to the subversion of the political and social order.\u201d<\/p>\n<p>Silveira was <a href=\"https:\/\/www.cnnbrasil.com.br\/politica\/deputado-federal-daniel-silveira-deixa-presidio-depois-de-cinco-meses\/\">released<\/a> from prison in November on the condition that he is not allowed any form of expression on social media, cannot interact with anyone else being investigated for alleged crimes of political dissent, and cannot travel freely except for visits to Brasilia for congressional business. He spent five months behind bars, having lost house arrest rights after defying similar ankle monitor orders.<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>De Moraes <a href=\"https:\/\/www.france24.com\/en\/live-news\/20220330-pro-bolsonaro-deputy-holes-up-in-brazil-congress-defying-court\">found<\/a> this week that Silveira had violated the provisions of his freedom by allegedly disrespecting the supreme court yet again and issued an order that he wear an ankle bracelet. Silveira refused to comply and went to Congress, where police could not legally arrest him.<\/p>\n<p>\u201cI have no respect for the order, I have the respect for the judiciary that Alexandre de Moraes has for the legislative,\u201d Silveira <a href=\"https:\/\/noticias.uol.com.br\/politica\/ultimas-noticias\/2022\/03\/31\/daniel-silveira-tornozeleira.htm\">declared<\/a>. \u201cSo that respect \u2026 you see that he has no limits now. He\u2019s a runaway train. Several lawmakers joined him for a breakfast of bread with butter and mortadella and coffee. The outlet named at least two lawmakers who arrived early in the morning on Thursday to join Silveira in solidarity:\u00a0Carla Zambelli and\u00a0Luiz Lima. Several other lawmakers joined later for morning prayers, many of them identified with Brazil\u2019s Evangelical conservative movement. Senator Flavio Bolsonaro, the president\u2019s son, also arrived, calling Silveira a \u201cgood guy\u201d and expressing opposition to the court\u2019s order.<\/p>\n<p dir=\"ltr\">\u201cIn our Bolsonaro government and among <em>bolsonaristas\u00a0<\/em>\u2026 no one gets left behind,\u201d Zambelli wrote on social media before her departure to visit Silveira in the morning.<\/p>\n<p dir=\"ltr\">De Moraes responded to Silveira\u2019s refusal by imposing the daily fine of 15,000 reais and accusing Silveira of \u201coffending the very dignity of Congress.\u201d He also opened a new criminal investigation into Silveira for <a href=\"https:\/\/noticias.uol.com.br\/ultimas-noticias\/redacao\/2022\/03\/31\/moraes-vai-a-caca-de-daniel-silveira.htm\">contempt<\/a>.<\/p>\n<figure id=\"M-ROS-B4\" class=\"a8d adSo\"><\/figure>\n<p dir=\"ltr\">\u201cIt\u2019s a strange and bizarre situation \u2026 not only strange and bizarre, but also the defendant\u2019s option is of dubious intelligence,\u201d de Moraes <a href=\"https:\/\/oglobo.globo.com\/politica\/moraes-manda-daniel-silveira-comparecer-pf-as-15h-de-hoje-para-instalar-tornozeleira-eletronica-1-25456579\">said<\/a>. \u201cHe himself restricted his freedoms to the architectural limits of the Chamber of Deputies, which is much more drastic than what the judicial decision called for.\u201d<\/p>\n<p>Silveira conceded to wearing the ankle monitor and was scheduled to appear before the police to be fitted on Thursday, lamenting in an interview with Jovem Pan that the fines were an unacceptable attack on his family and he would not deprive them of the money.<\/p>\n<p>\u201cThe decision [of imposing a fine] is that of a weak, frustrated person who has no resources to win the battle constitutionally,\u201d Silveira said. \u201cWhen he seizes assets, when he freezes accounts, 15000 reais a day \u2026 if it\u2019s going to affect my family, I\u2019m not going to submit to that anymore.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"pt\" dir=\"ltr\"><a href=\"https:\/\/twitter.com\/hashtag\/ExclusivoJP?src=hash&#038;ref_src=twsrc%5Etfw\">#ExclusivoJP<\/a> | Daniel Silveira fala \u00e0 Jovem Pan News, confirma que vai voltar para casa e aguarda Pol\u00edcia Federal para instalar tornozeleira: <\/p>\n<p>&#8220;Vou colocar a tornozeleira, mas ele deveria usar [\u2026] O Brasil tem que entender que ele \u00e9 um inimigo em comum da na\u00e7\u00e3o.&#8221; <a href=\"https:\/\/t.co\/fLBzBj1ZnY\">pic.twitter.com\/fLBzBj1ZnY<\/a><\/p>\n<p>\u2014 Jovem Pan News (@JovemPanNews) <a href=\"https:\/\/twitter.com\/JovemPanNews\/status\/1509337455325061120?ref_src=twsrc%5Etfw\">March 31, 2022<\/a><\/p>\n<\/blockquote>\n<p>Silveira also branded de Moraes an \u201cenemy of the state.\u201d<\/p>\n<p>President Bolsonaro condemned the STF justice on Thursday, calling Silveira\u2019s situation unacceptable.<\/p>\n<p>\u201cI can\u2019t accept what is happening passively,\u201d Bolsonaro said in public remarks at a departure event for outgoing ministers. \u201cI am not stronger or more macho than anyone. When I was in the military, I vowed to give my life for the military.
