The law bans classroom instruction on gender identity and sexual orientation for children in grades kindergarten through third grade in the state while providing legal recourse for parents who suspect teachers or school administrators may be in violation of the law.<\/p>\n<p>The Associated Press <a href=\"https:\/\/abcnews.go.com\/Politics\/wireStory\/lgbtq-group-sues-florida-called-dont-gay-law-83785168\">reported<\/a> that Equality Florida as well as Family Equality filed the suit in federal court, \u201calleging that the law violates the constitutionally protected rights of free speech, equal protection and due process of students and families.\u201d<\/p>\n<p>\u201cThis effort to control young minds through state censorship \u2014 and to demean LGBTQ lives by denying their reality \u2014 is a grave abuse of power,\u201d the lawsuit says, according to the AP.<\/p>\n<p>\u201cThe United States Supreme Court has repeatedly affirmed that LGBTQ people and their families are at home in our constitutional order. The State of Florida has no right to declare them outcasts, or to treat their allies as outlaws, by punishing schools where someone dares to affirm their identity and dignity,\u201d the lawsuit added.<\/p>\n<p>As The Daily Wire has previously <a href=\"https:\/\/www.dailywire.com\/news\/florida-democrats-chant-gay-to-protest-a-bill-that-doesnt-ban-anybody-from-saying-gay\">reported<\/a>, critics have incorrectly labeled the law the \u201cDon\u2019t Say Gay Bill.\u201d The Left has branded the proposal in a way that has given some people the false impression that it bans teachers and school kids from even mentioning the word \u201cgay\u201d in public schools at all.<\/p>\n<p>But as\u00a0<a href=\"https:\/\/www.npr.org\/2022\/02\/24\/1082969036\/florida-house-passes-controversial-measure-dubbed-the-dont-say-gay-bill-by-criti\">pointed<\/a> out recently by NPR, what the law actually does is prohibit instruction on LGBTQ topics for kindergarten through third-graders, provides parents more transparency by requiring schools to notify them of any change in mental, physical, or emotional well being, and allows schools to opt-out of that if there is a reasonable fear that notifying a parent would result in abuse.<\/p>\n<p>Nonetheless, the lawsuit filed on Thuesday claims that the law \u201cdeliberately employs broad terms and invites arbitrary and discriminatory enforcement, empowering parents to be roving censors who can sue school boards for damages based on any perceived violation,\u201d according to the AP.<\/p>\n<p>The AP also\u00a0<a href=\"https:\/\/abcnews.go.com\/Politics\/wireStory\/lgbtq-group-sues-florida-called-dont-gay-law-83785168\">reported<\/a> that the law actually states, \u201cClassroom instruction by school personnel or third parties on sexual orientation or gender identity may not occur in kindergarten through grade 3 or in a manner that is not age appropriate or developmentally appropriate for students in accordance with state standards.\u201d It also grants parents the option to sue.<\/p>\n<p>The law has gained national attention, even drawing the ire of the Walt Disney World Corporation, based in Florida.<\/p>\n<p>On Wednesday, The Daily Wire <a href=\"https:\/\/www.dailywire.com\/news\/video-appears-to-show-lgbtq-activist-suggesting-to-some-disney-employees-that-desantis-gop-want-to-take-your-kids\">reported<\/a> that a recent video that went viral online appeared to show the head of Equality Florida suggesting to Disney employees that lawmakers enacting legislation protecting the innocence of children are eventually trying to \u201ccriminalize\u201d gay parents and \u201ctake your kids.\u201d (Disclosure: The Daily Wire has announced plans for kids entertainment content.)<\/p>\n<p>\u201cWhen we react to this,\u201d Equality Florida\u00a0<a href=\"https:\/\/www.eqfl.org\/nadine-smith\">Nadine Smith<\/a> apparently tells Disney employees in a virtual meeting, according to a video posted by City Journal writer Chris Rufo, \u201ca lot of us are reacting from the pain we experienced being isolated and stigmatized in school, but we are also reacting from the reality that when they can erase you, when they can criminalize your existence when they can demonize who you are, the next step is to criminalize you and take your kids.\u201d<\/p>\n<p>During the signing ceremony for the law last week, DeSantis promised citizens that Florida\u2019s government \u201cwill make sure that parents can send their kids to school to get an education, not an indoctrination.\u201d<\/p>\n<p><em>The Daily Wire is one of America\u2019s fastest-growing conservative media companies for breaking news, investigative reporting, sports, podcasts, in-depth analysis, books, and entertainment for a reason: because we believe in what we do.
