Ted Budd (R-NC).<\/p>\n<p>In a <a href=\"https:\/\/budd.house.gov\/uploadedfiles\/budd_letter_--_opposing_biden_charter_school_regulations.pdf\">letter<\/a> to Secretary of Education Miguel Cardona on Monday, Budd brought up a <a href=\"https:\/\/www.federalregister.gov\/documents\/2022\/03\/14\/2022-05463\/proposed-priorities-requirements-definitions-and-selection-criteria-expanding-opportunity-through\">proposed rule<\/a>\u00a0that would require new charter schools to demonstrate \u201csufficient demand\u201d in a community to be eligible for federal grant money.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>Budd told Cardona that, for many families, charter schools are \u201can escape from mismanaged school systems\u201d and can \u201ccater to students left behind by public school systems,\u201d adding that the creation of such institutions should not be discouraged by policy.<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>The congressman and U.S. Senate candidate continued:<\/p>\n<blockquote>\n<p>DOE\u2019s false assumption that prospective charter schools must demonstrate a need within a given<br \/>community represents a backdoor attempt to limit choice for parents and students,\u201d \u201cThese sorts of burdensome requirements would never be applied to school systems beholden to powerful teachers unions that organize against the interests of families and students.<\/p>\n<\/blockquote>\n<p>Under the policy, which was published on March 14, new charter schools would also be required to detail \u201ctargeted student and staff demographics\u201d and how the applicant \u201cplans to establish and maintain racially and socioeconomically diverse student and staff populations\u2026, \u201d the policy language states.<\/p>\n<p>\u201c\u2026Including proposed strategies (that are consistent with applicable legal requirements) to recruit, enroll, and retain a diverse student body and to recruit, hire, develop, and retain a diverse staff and talent pipeline at all levels (including leadership positions),\u201d the policy continues.<\/p>\n<p>The proposed policy adds that if promoting \u201cdiverse\u201d student and staff populations is not possible because of community demographics, the federal government could still fund those applications. However, the policy does state that those schools would have to submit a plan detailing how they \u201cwould not increase racial or socio-economic segregation or isolation in those schools.\u201d<\/p>\n<div class=\"\">\n<p class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">In a March 21 <em>Washington Post<\/em> <a href=\"https:\/\/www.washingtonpost.com\/education\/2022\/03\/21\/biden-charter-schools-funding\/\">report<\/a>, the National Alliance for Public Charter Schools said it was \u201cunhappy with several provisions of the proposal.\u201d<\/p>\n<\/div>\n<p>\u201cIt\u2019s unclear why the department and the administration are trying to limit charter school opportunities,\u201d spokeswoman Jennifer Diaz said.<\/p>\n<p>According to the <em>Post<\/em>, the biggest proposed change is charter schools would be ineligible for federal funding if they are operated by for-profit management companies. The report states:<\/p>\n<blockquote>\n<p>Nonprofits could outsource particular tasks \u2014 such as payroll, for instance \u2014 to for-profit companies. But arrangements in which for-profit companies run the entire operation under contracts known as \u201csweeps\u201d would be ineligible for the start-up grants. The proposal specifically bars arrangements under which a for-profit management company \u201cexercises full or substantial administrative control over the charter school \u2026 or over programmatic decisions.\u201d<\/p>\n<\/blockquote>\n<p>President of the conservative Thomas B.
