It came about due to COVID-19 and has been continued under the Biden administration. Biden is gearing up to end the policy, <a href=\"https:\/\/archive.ph\/9Ofec\">according<\/a> to a pending draft of an order from the CDC reviewed by The Wall Street Journal.<\/p>\n<p>\u201cThis is a decision that we have long deferred to CDC, Title 42 is a public health directive, it is not an immigration or migration enforcement measure. So, the decision on when to lift Title 42, we defer to the CDC,\u201d White House Communications Director Kate Bedingfield said Wednesday in a briefing.<\/p>\n<p>Bedingfield noted that the administration is \u201cplanning for multiple contingencies\u201d and that \u201cthere will be an influx of people to the border\u201d when Title 42 is rescinded. The order obtained by The Wall Street Journal says Title 42 would be rescinded in late May.<\/p>\n<p>While Bedingfield characterized the number of people potentially headed to the southern border as an \u201cinflux,\u201d Mark Morgan, the former acting commissioner for the U.S. Customs and Border Protection under Trump, told The Daily Wire differently.<\/p>\n<p>\u201cIt\u2019s not going to be just another \u2018surge.\u2019\u201d said Morgan, <a href=\"https:\/\/www.dailywire.com\/news\/trump-cbp-head-slams-biden-as-more-interested-in-ukraine-border-than-u-s-border\">who also said<\/a> in a Daily Wire interview on Monday that Biden is more focused on securing Ukraine\u2019s border than America\u2019s.\u00a0\u201cIt\u2019s going to be a crushing tidal wave of illegal immigration.\u201d<\/p>\n<p>Upon Title 42 being officially repealed, the administration would be tasked with evaluating asylum claims. Title 42 outlines that migrants seeking protection in the U.S. could still face deportation with no consideration of claims.<\/p>\n<p>Democrats have put pressure on Biden to end Title 42 in recent weeks. California Rep. Juan Vargas, a Democrat whose district represents the entire state\u2019s border with Mexico, claimed that the policy \u201cwas never about public health and safety\u201d and \u201cimplemented to deny due process to people seeking refuge and protection.\u201d However, Arizona Democratic Sens. Mark Kelly and Kyrsten Sinema <a href=\"https:\/\/www.kelly.senate.gov\/press-releases\/kelly-sinema-to-biden-keep-title-42-in-place-until-prepared-to-act-on-a-comprehensive-replacement-plan\/\">urged<\/a> Biden last week to keep Title 42 in place \u2014 calling it a \u201ccommon-sense policy.\u201d<\/p>\n<p>\u201cGiven the impacts that changes to Title 42 could have on border communities, border security, and migrants, we urge your Administration not to make any changes to Title 42 implementation until you are completely ready to execute and coordinate a comprehensive plan that ensures a secure, orderly, and humane process at the border,\u201d the senators wrote.<\/p>\n<p>Texas Republican Sen. John Cornyn has been <a href=\"https:\/\/twitter.com\/JohnCornyn\/status\/1509116936231309314?s=20&#038;t=6O3w6QXpxds4y8Zz8EQu-g\">vocal<\/a> about his notion that the policy\u2019s rollback will lead to a \u201ctsunami\u201d of migrants and drugs. On his first day in office, Biden unveiled the U.S. Citizenship Act of 2021 to supplement border resources with technology to track illicit activity. The bill was introduced by Rep. Linda S\u00e1nchez (D-CA), and never passed, while drugs like methamphetamine and <a href=\"https:\/\/www.dailywire.com\/news\/more-fentanyl-seized-at-u-s-borders-than-heroin-for-first-time-in-u-s-history?fbclid=IwAR3DN8Ok_rAl9FK9zdF2J0DklOV8jE4uL3uC5v6RFNeRmWqX43OGl0GT4Mo\">fentanyl<\/a> continue to enter the U.S. in record numbers.<\/p>\n<p>The advancement of Title 42\u2019s repeal comes as the Biden administration plans to enforce a new border policy that will <a href=\"https:\/\/www.foxnews.com\/politics\/biden-administration-asylum-cases-immigration-officers-judges\">lessen<\/a> the amount of time that migrants await asylum decisions. It was announced in August 2021 and allows officers for U.S. Citizenship and Immigration Services to examine asylum applicants that potentially qualify for expedited removal from their country.
