The Biden Admin has already chosen to eliminate enforcement as much as possible.\u201d<\/p>\n<p>Roy also <a href=\"https:\/\/twitter.com\/RepChipRoy\/status\/1508901591583178755?s=20&#038;t=uKvz-t-xfGwF5bnVHm_hXA\">added<\/a>,\u00a0\u201cMayorkas has long REFUSED to FULLY enforce Title 42. Fewer than 60% of illegal encounters have been turned away under Title 42 since Mayorkas took office. Before he took office, 80% were turned away.\u201d<\/p>\n<p>Yet even with that comparison, Roy also told Mayorkas in the letter sent Tuesday, \u201cS<span>adly, the use of Title 42 authority has been the lone vestige of southern border security policy the United States has conducted under your leadership.\u201d<\/span><\/p>\n<p><span>\u201cIn fact, since you became Secretary, your Department has used Title 42 as the basis for almost ALL of those refused entry,\u201d Roy continued. \u201cThough, prior to your assumption of the post of DHS Secretary more than 80% were turned away and now only 50% \u2013 at least there was some brake.\u201d<\/span><\/p>\n<p>Roll Call <a href=\"https:\/\/rollcall.com\/2022\/03\/25\/sinema-kelly-want-border-plan-ready-before-title-42-ends\/\">recently reported <\/a>that \u201cborder agents have expelled migrants more than 1.7 million times since the directive was implemented, including more than a million times last year alone.\u201d<\/p>\n<p>Democratic Senators Kyrsten Sinema and Mark Kelly, both of Arizona, are also calling for the Biden administration to extend Title 42. According to Roll Call, the pair sent a letter to Mayorkas last Thursday as well:<\/p>\n<div class=\"\">\n<blockquote>\n<p><em>Title 42 \u201cshould not be in effect indefinitely,\u201d Kelly and Sinema said in their letter, noting the dangerous conditions to which the policy subjects expelled migrants. But at the same time, chaos at the border \u201calso negatively affects migrants\u2019 safety and could further strain an already overwhelmed health care system at the border,\u201d they wrote.<\/em><\/p>\n<\/blockquote>\n<div class=\"\">\n<blockquote>\n<p><em>An abrupt policy change without a comprehensive plan ready to replace it \u201cwould significantly increase the strain on DHS, border communities, and local nonprofits that are already near or at capacity,\u201d they said.<\/em><\/p>\n<\/blockquote>\n<p>As The Daily Wire has <a href=\"https:\/\/www.dailywire.com\/news\/record-breaking-surge-of-migrants-cnn-admits-crisis-coming-on-border\">previously reported<\/a>, the Biden administration is currently dealing with one of the worst illegal immigration crises in history.<\/p>\n<p>\u201cBorder encounters in February were up <a href=\"https:\/\/news4sanantonio.com\/news\/nation-world\/encounters-at-southern-border-increased-63-since-last-year-350-since-2020-data-shows\">63%<\/a> from the same month last year as nearly 165,000 illegal immigrants flooded into the U.S. last month. \u201cOur southern border is still totally uncontrolled,\u201d The Daily Wire\u2019s Ben Johnson also<a href=\"https:\/\/www.dailywire.com\/news\/as-midterms-approach-dems-suddenly-want-more-border-security\"> said on an episode<\/a> of The Daily Wire\u2019s podcast \u201cMorning Wire.\u201d<\/p>\n<p>\u201cThe number of encounters at the border in February <a href=\"https:\/\/news4sanantonio.com\/news\/nation-world\/encounters-at-southern-border-increased-63-since-last-year-350-since-2020-data-shows\">increased 63%<\/a> compared to last year, which was the largest in U.S. history,\u201d Johnson explained.<\/p>\n<p>\u201cJohnson pinned the blame on the Biden administration for the drastic increase in border crossings and the decrease in deportations since President Donald Trump left office in January 2021,\u201d The Daily Wire explained:<\/p>\n<blockquote>\n<p><em>\u201cAll in all, ICE has reported 2.5 million border encounters during the Biden presidency,\u201d he said. \u201cOf course, that includes a <a href=\"https:\/\/www.dailywire.com\/news\/3-stories-the-media-ignored-this-week\">record-breaking 1.7 million<\/a> known illegal entries in 2021. As the number of border crossings hit a record high last fiscal year, deportations fell by 30% \u2014 and they look to be even lower this year.\u201d<\/em><\/p>\n<\/blockquote>\n<p>Johnson also added that \u201cthings will only get worse when the Biden administration rescinds Title 42.\u201d<\/p>\n<p>Roy\u2019s full letter to Mayorkas can be seen here:<\/p>\n<blockquote>\n<p><em><span>Dear Secretary Mayorkas,\u00a0\u00a0<\/span><\/em><\/p>\n<p><em><span>Your job as Secretary of the Department of Homeland Security \u2014 carried out under your oath to defend the Constitution \u2014 is to secure the United States of America. Yet, you have purposefully failed to do so,\u00a0 and in the process you have empowered criminal drug cartels, impaired the health of Americans, damaged\u00a0 America\u2019s economic health, allowed illegal migrants to destroy private property, and placed American citizens at imminent risk of physical harm. These actions represent acts of impeachable conduct as Secretary\u00a0 \u2014 which we have documented in part \u2014 and represent a call to action for Congress to hold you to account.<\/span><\/em><\/p>\n<p><em><span>However, even if Congress were to set aside all these previous actions representing a breach of your duty and were to focus solely on the imminent decision you are purportedly planning to take \u2014 halting,\u00a0 particularly at this moment, the enforcement of 42 U.S. Code \u00a7 265 (Title 42) authority at the U.S. southern border \u2014 we would still be duty bound to impeach you. Sadly, the use of Title 42 authority has been the lone vestige of southern border security policy the United States has conducted under your leadership. In fact, since you became Secretary, your Department has used Title 42 as the basis for almost ALL of those refused entry. Though, prior to your assumption of the post of DHS Secretary more than 80% were turned away and now only 50% \u2013 at least there was some brake.\u00a0\u00a0<\/span><\/em><\/p>\n<p><em><span>Your decision to discontinue use of Title 42 policies will cause an immediate flood of illegal migration at our southern border, as well as the release of innumerable illegal migrants into the interior. You are doing this even as there remain serious restraints on Americans and serious questions about communicable disease throughout the globe. In sum, if your Department stops enforcing Title 42, you will knowingly cause irrevocable, catastrophic damage to the people and the security of the United States.
