This is 100% illegal.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Hi! This is 100% illegal.  <a href=\"https:\/\/t.co\/Saad6QO18b\">https:\/\/t.co\/Saad6QO18b<\/a><\/p>\n<p>\u2014 Megyn Kelly (@megynkelly) <a href=\"https:\/\/twitter.com\/megynkelly\/status\/1508873159143051267?ref_src=twsrc%5Etfw\">March 29, 2022<\/a><\/p>\n<\/blockquote>\n<p>On March 14, the Clover Park School District board approved the policy in a 3-2 vote. \u201cThe district in the suburbs of Tacoma will now use \u2018culturally responsive discipline\u2019 that encourages school staff to impose disciplinary policies that \u2018may be adapted to individual student needs in a culturally responsive manner,\u201d <a href=\"https:\/\/www.dailymail.co.uk\/news\/article-10663977\/Clover-Park-school-district-passes-policy-consider-race-punishing-students.html\">The Daily Mail<\/a>reported, adding, \u201cCritics say the new approach is in effect a race-based disciplinary policy that will encourage harsher or lighter punishments based on a student\u2019s race, with white students being disciplined more severely.\u201d<\/p>\n<p>KTTH host Jason Rantz <a href=\"https:\/\/mynorthwest.com\/3399911\/rantz-wa-schools-adopt-race-based-discipline-white-students-get-harsher-punishment\/\">wrote<\/a>, \u201cThe Clover Park School District debated its new \u2018culturally responsive\u2019 student discipline policy. It means student discipline would not be consistent based on conduct. Instead, a school considers a student\u2019s race and background. It would likely offer harsher punishments to white students, even if the conduct is identical to that of a Black or Hispanic student.\u201d<\/p>\n<p>Board President Alyssa Anderson Pearson insisted in a statement to The Daily Mail, \u201cContrary to recent inaccurate news coverage and social media posts, Clover Park School District\u2019s Student Discipline Policy does not make race a determining factor for administering discipline. It contains no such provision. \u2026 The recent update of our policy is based on a Washington State School Directors Association model policy. It has been adopted by multiple school districts and is in alignment with state law.\u2019<\/p>\n<p>John Arbeeny, a former deputy mayor of Lakewood, countered in the <a href=\"https:\/\/thesubtimes.com\/2022\/03\/24\/letter-cpsd-discipline-policy-a-recipe-for-chaos\/\">Suburban Times<\/a>, \u201cSo \u2018culturally responsive discipline\u2019 is merely a deceptive cover term for \u2018racially\/ethnically based discipline\u2019 which seeks to \u2018even out\u2019 the numbers of disciplinary incidents based upon racial\/ethnic populations or some other undefined criteria. It has little to do with group or individual cultural differences (the determination of which is problematic), discipline generally or creating a safe academic environment. I wonder what the public would think if this were explained in plain language: \u2018a discipline policy based upon race\/ethnicity\u2019?\u201d<\/p>\n<p>He added, \u201cIf indeed \u2018culturally responsive discipline\u2019 is nothing more than more favorable treatment of some over others based upon race\/ethnicity are we not treading upon the US Constitution 14th Amendment, Section 1?\u201d<\/p>\n<p>\u201cNo state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.\u201d<\/p>\n<p>Rantz echoed, \u201cThe state officially\u00a0<a href=\"https:\/\/app.leg.wa.gov\/WAC\/default.aspx?cite=392-400-025\">defines<\/a>\u00a0\u2018culturally responsive\u2019 as \u2018knowledge of student cultural histories and contexts, as well as family norms and values in different cultures; knowledge and skills in accessing community resources and community and parent outreach; and skills in adapting instruction to students\u2019 experiences and identifying cultural contexts for individual students.\u2019 In practice, it means favorable treatment of racial minorities. It would likely offer harsher punishments to white students, even if the conduct is identical to that of a Black or Hispanic student.\u201d<\/p>\n<p>Pearson issued a statement saying, \u201cOur district has high standards for student behavior.
