However, the Navy still cannot discharge them.<\/p>\n<p>O\u2019Connor stated in his decision:<\/p>\n<blockquote>\n<p>The Court also GRANTS Plaintiffs\u2019 Motion for Class-Wide Preliminary Injunction, but immediately STAYS the injunction \u201cinsofar as it precludes the Navy from considering respondents\u2019 vaccination status in making deployment, assignment, and other operational decisions.<\/p>\n<\/blockquote>\n<div class=\"page\" title=\"Page 1\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p>O\u2019Conner\u2019s latest ruling will likely be appealed by the Pentagon, and\u00a0after the Fifth Circuit federal appeals court, the case could end up in Supreme Court again.<\/p>\n<p>Defense Secretary Lloyd Austin, in August 2021, ordered that all service members must be fully-vaccinated against the coronavirus after the FDA approved the Pfizer vaccine.<\/p>\n<p>However, 16,000 or more service members have refused or filed for an exemption. Service members could file for permanent or temporary exemptions for medical reasons, administrative reasons such as a pending separation from the military, or religious exemptions.<\/p>\n<p>So far, out of thousands of requests for religious exemptions, the military granted about two dozen. Rep. Darrell Issa (R-CA) discovered that three cases he inquired about were granted only because the service members were already leaving the military.<\/p>\n<p>The military services have already separated now more than 1,500 service members for not complying with the vaccine mandate, and there are thousands more awaiting separation or a decision on their requests for exemption, as <a href=\"https:\/\/www.breitbart.com\/politics\/2022\/03\/03\/nearly-1500-service-members-discharged-over-bidens-military-vaccine-mandate\/\">previously reported<\/a> by Breitbart News.<\/p>\n<p>The case is <i>U.S. Navy SEALs 1-26 v.
