Liz Cheney, who serves as vice chair of the select committee on a crusade to persecute political dissidents.<\/p>\n<p>The panel, ostensibly established to probe the Capitol riot, cited recent court decisions overruling President Trump\u2019s claims of executive privilege to shield documents from congressional review by lawmakers in pursuit of an ideologically motivated witch hunt. Trump\u2019s White House successor, Joe Biden, <a href=\"https:\/\/www.washingtonpost.com\/politics\/2022\/03\/01\/navarro-flynn-jan-6-committee\/\">waived<\/a> Republican claims of executive privilege for those subpoenaed by the panel. <\/p>\n<p>Navarro was subpoenaed by lawmakers in <a href=\"https:\/\/january6th.house.gov\/news\/press-releases\/select-committee-subpoenas-peter-navarro\">February<\/a>. Scavino was subpoenaed in <a href=\"https:\/\/january6th.house.gov\/news\/press-releases\/select-committee-subpoenas-individuals-tied-former-president-days-surrounding\">September<\/a>. <\/p>\n<p>According to a series of correspondence obtained by The Federalist between Scavino\u2019s legal team and the Jan. 6 Committee since last fall, the House probe (which lacks any Republican appointments) dismissed good faith efforts to comply with lawmaker requests within the scope of legal challenges presented by executive privilege. While the Supreme Court <a href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/21a272_9p6b.pdf\">denied<\/a> a motion to block Trump\u2019s appeal to maintain executive privilege in January, the Jan. 6 Committee expanded the scope of its inquiry ahead of demands for a sit-down deposition under <a href=\"https:\/\/thefederalist.com\/2021\/11\/10\/j6-committee-misleading-witnesses-about-republican-staff-presence\/\">questionable authority<\/a> to include topics beyond the \u201cmatters of inquiry\u201d stated in the initial subpoena. <\/p>\n<p>In a Nov. 18 letter to Chairman Bennie Thompson, D-Miss., Scavino\u2019s attorney, Stan Brand, wrote the expansion \u201cmake[s] it difficult for us to sufficiently prepare Mr. Scavino to present competent testimony or to ensure that he has adequate representation at such a deposition.\u201d<\/p>\n<p>\u201cAlthough we invited your staff to engage with us so as to \u2018hone in on a subset of topics that can be prioritized,\u2019 we received no response to this invitation,\u201d Brand added. Such topics included knowledge of \u201ccoded language\u201d and the potential invocation of the 25th Amendment.<\/p>\n<p>The Supreme Court\u2019s decision to reject Trump\u2019s claims of executive privilege, Scavino\u2019s counsel argued in a February letter to Thompson, \u201cdoes not resolve the issue of President Trump\u2019s directive.\u201d<\/p>\n<p>Brand explained (emphasis his): <\/p>\n<blockquote class=\"wp-block-quote\">\n<p>As the Circuit Court articulated in its opinion, \u2018[t]his preliminary injunction appeal <em><strong>involves only a subset of those requested documents<\/strong> <\/em>over which former President Trump has claimed executive privilege, but for which President Biden has expressly determined that asserting a claim of executive privilege to withhold the documents from the January 6th Committee is not warranted.\u2019 <\/p>\n<\/blockquote>\n<p>In other words, Scavino\u2019s legal team claims the former senior Trump adviser is unable to lawfully comply with the committee\u2019s requests without the risk of compromising executive privilege. That very inability now may land Scavino 12 months behind bars pending action from the Biden Justice Department if the Democrat-controlled House votes to affirm the panel\u2019s unanimous recommendation for contempt. <\/p>\n<p>The pair of contempt referrals follow a trio of other former officials in the Trump administration who\u2019ve similarly been recommended for contempt charges by the panel including Steve Bannon, former White House Chief of Staff Mark Meadows, and former Acting Assistant Attorney General Jeffrey Clark. <\/p>\n<p>Since it was established, the Jan. 6 Committee has remained laser-focused on prosecuting former President Trump, Trump\u2019s aides, and Trump\u2019s supporters, as opposed to probing House Speaker Nancy Pelosi\u2019s <a href=\"https:\/\/thefederalist.com\/2021\/12\/16\/nancy-pelosi-owns-january-6\/\">negligent management <\/a>of the congressional complex and security failures leading up to the riot. According to a Federalist analysis of the 96 subpoenas issued by the committee to date, only eight are targeted at those associated with the riot at the Capitol. The rest seek the records of either government officials or private individuals in a doxing campaign to criminalize political dissent. <\/p>\n<p>Earlier this month, Democrats on the committee admitted to The Washington Post that the panel\u2019s work, complete with prime-time show trials, was <a href=\"https:\/\/thefederalist.com\/2022\/03\/19\/democrats-admit-jan-6-committee-is-all-about-midterms\/\">all about the midterms<\/a> as inflation, high energy prices, and global turmoil tarnish the reputation of Democrats in power. <\/p>\n<hr class=\"wp-block-separator\" \/>\n<p>\n  Tristan Justice is the western correspondent for The Federalist.
