Carter ruled Monday that former President Donald Trump \u201cmore likely than not\u201d tried to obstruct Congress on January 6, 2021, and that therefore lawyer John Eastman must hand over emails to a House inquiry.<\/p>\n<p>The case arose because Eastman had sued to block the release of about 100 emails that are based on the servers of Chapman University in Orange, California, citing attorney-client privilege. But attorney-client privilege does not cover attempts to commit fraud or a crime.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>Without ruling that such a crime had been committed, but that it was \u201cmore likely than not,\u201d the judge <a href=\"https:\/\/www.latimes.com\/politics\/story\/2022-03-28\/former-trump-lawyer-john-eastman-must-hand-over-documents-to-jan-6-committee-judge-rules\">ordered<\/a> Eastman to hand over all but 10 emails to the U.S. House committee examining the January 6 Capitol riot.<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<div id=\"attachment_20420372\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/media.breitbart.com\/media\/2022\/03\/John-Eastman-Getty-e1648487653248.jpg\"><\/a><\/p>\n<p class=\"wp-caption-text\"><em>John Eastman (Photo by Alex Wong\/Getty Images)<\/em><\/p>\n<\/div>\n<p>Judge Carter also declared: \u201cThe evidence shows that Dr. Eastman was aware that his plan violated the Electoral Count Act. Dr. Eastman likely acted deceitfully and dishonestly each time he pushed an outcome-driven plan that he knew was unsupported by the law.\u201d<\/p>\n<p>Eastman and other Trump allies have said that they did not intend to obstruct Congress, much less mount an \u201cinsurrection,\u201d but rather to use a peaceful protest to put public pressure on Congress and Vice President Mike Pence to decline to certify the results of the Electoral College vote in the 2020 presidential election in several states, claiming voting irregularities. Trump himself was acquitted in a controversial second impeachment trial in 2021 in which he was accused of inciting the riot.<\/p>\n<p>Judge Carter, a Bill Clinton appointee, recently made headlines by <a href=\"https:\/\/www.breitbart.com\/politics\/2021\/04\/20\/federal-judge-l-a-must-house-every-homeless-person-on-skid-row-by-oct-18\/\">ordering<\/a> the city and county of Los Angeles to house every homeless person, citing \u201csystemic racism\u201d in his ruling. He took the unusual step of going to homeless sites himself to investigate. His order was <a href=\"https:\/\/www.nbcnews.com\/news\/us-news\/u-s-court-order-house-l-skid-row-homeless-overturned-n1279983\">overturned<\/a> by the liberal Ninth Circuit, citing \u201cextensive error.\u201d<\/p>\n<p><em>Joel B.
