But almost all of the $500 billion in construction projects that will be authorized by the bill will fall under the government\u2019s Davis-Bacon rule \u2014 a New Deal-era rule that mandates \u201cprevailing wages\u201d be paid on federal construction projects.<\/p>\n<p>Until 1982, the \u201cprevailing wage\u201d was subject to the \u201c30 percent rule\u201d meaning that for any particular area, the prevailing wage would be based on the highest wages in that area, as long as they were paid to at least 30 percent of workers.<\/p>\n<p>Naturally, this meant that the \u201cprevailing wage\u201d was the \u201cunion wage,\u201d freezing many open shop contractors out of the bidding. Then the Labor Department eliminated the \u201c30 percent rule,\u201d and competition increased and costs went down.<\/p>\n<p><em><strong>For Our VIPs:<\/strong> <a href=\"https:\/\/pjmedia.com\/news-and-politics\/matt-margolis\/2022\/03\/09\/bidens-russian-oil-embargo-proves-he-has-no-strategy-for-dealing-with-putin-n1564984\" target=\"_blank\" rel=\"noopener\">Biden\u2019s Russian Oil Embargo Proves He Has No Strategy for Dealing With Putin<\/a><\/em><\/p>\n<p>Now, Biden\u2019s Labor Department wants to partially reinstate the 30 percent rule, which will be a boon to Biden\u2019s organized labor backers and raise costs significantly.<\/p>\n<p><a href=\"https:\/\/reason.com\/2022\/03\/23\/the-biden-administration-is-ignoring-how-its-policies-will-worsen-inflation-again\/?utm_medium=email\" target=\"_blank\" rel=\"noopener\">Reason.com:<\/a><\/p>\n<blockquote>\n<p>\u201cThe revisions seem ill-timed,\u201d\u00a0<a href=\"https:\/\/www.americanactionforum.org\/insight\/dol-proposes-updates-to-davis-bacon-act-regulations\/\" target=\"_blank\" rel=\"noopener\">writes<\/a>\u00a0Bosch, \u201cgiven the current high levels of inflation and a recently enacted infrastructure spending program. The increased labor costs that would result will contribute to higher inflation and reduce the number of infrastructure projects that can be pursued.\u201d<\/p>\n<p>The department is dismissing those concerns. The 1982 rule changes that eliminated the 30 percent rule, it\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2022\/03\/18\/2022-05346\/updating-the-davis-bacon-and-related-acts-regulations\" target=\"_blank\" rel=\"noopener\">claims<\/a>, \u201cwere based in part on a criticism of the [Davis-Bacon] Act itself,\u201d rather than on worries about inflation. \u201cEven if concerns about an inflationary effect on government contract costs or speculative effects on the national macroeconomy were used to justify eliminating the 30-percent rule, the department does not believe such reasoning now provides either a factual or legal basis to maintain the current majority rule.\u201d<\/p>\n<p>Of course, this wouldn\u2019t be the first time the Biden administration\u00a0<a href=\"https:\/\/reason.com\/2022\/03\/02\/bidens-protectionist-trade-agenda-will-increase-prices-in-fact-it-already-has\/\" target=\"_blank\" rel=\"noopener\">ignored warnings<\/a>\u00a0<a href=\"https:\/\/reason.com\/2022\/03\/15\/bidens-dishonest-attempt-to-pin-inflation-on-putin\/\" target=\"_blank\" rel=\"noopener\">about possible inflation<\/a>\u00a0in order to\u00a0<a href=\"https:\/\/reason.com\/video\/2022\/03\/18\/blame-biden-for-high-gas-prices\/\" target=\"_blank\" rel=\"noopener\">accomplish political objectives<\/a>. Labor unions may very well get their bigger payday\u2014the rest of us will keep paying more and getting less.<\/p>\n<\/blockquote>\n<p>The problem with reinstating the 30 percent rule is the way Davis-Bacon wage determinations are made. A worker in Chicago will make more per hour than a worker in a suburb just 50 miles away. And yet, the way that the law will interpret the \u201cprevailing wage,\u201d the suburban company will have to pay the worker as much as the Chicago worker. It\u2019s patently unfair to the non-union contractor and adds substantial cost to a project.<\/p>\n<p>Biden had a real opportunity to ignore the union\u2019s demands and try to control construction costs.
