All three state legislatures have passed the bills on to their governors for approval (or possible veto) in the coming days.\u00a0<\/span><\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<h3><strong>Arizona\u2019s\u00a0\u201c<a href=\"https:\/\/www.azleg.gov\/legtext\/55leg\/2R\/bills\/SB1165S.pdf\">Save Women\u2019s Sports Act<\/a>\u201d\u00a0<\/strong><\/h3>\n<p>The GOP-dominated Arizona House <a href=\"https:\/\/apps.azleg.gov\/BillStatus\/BillOverview\/76637\">voted<\/a> 31\/24 to send SB 1165 to Gov. Doug Ducey\u2019s (R) desk. According to the <a href=\"https:\/\/apnews.com\/article\/arizona-gender-reassignment-surgery-ban-4f1b1a593d722edc5e856b5a4cfe9160\">Associated Press<\/a>, Ducey has not said whether he will sign the bill \u2014 the publication pointed to both Utah\u2019s governor and Indiana\u2019s, who in recent days vetoed similar bills in their states. (However, the Utah legislature voted to override Gov. Spencer Cox\u2019s veto, and the Indiana State Legislature says it <a href=\"https:\/\/www.wndu.com\/2022\/03\/24\/indiana-lawmakers-plan-override-veto-transgender-sports-ban\/\">plans<\/a> to do the same in May.)<\/p>\n<p>Arizona\u2019s ban would apply to both public schools and colleges, as well as private institutions that compete against public schools. The bill does specify that men and women can compete together in \u201ccoed\u201d or \u201cmixed\u201d events and does not restrict women from playing on teams designated for men.<\/p>\n<p>The bill lists several studies confirming the biological differences of men and women, and boys and girls, including the physiological advantages boys as young as six years old have in athletics, such as \u201ccardiovascular endurance, muscular strength, muscular endurance, and speed\/agility\u2026\u201d The bill also details how testosterone in men gives them a greater advantage over women, even after a year of testosterone suppression, which the Internal Olympics Committee requires for \u201ctransgender women\u201d participants.<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>Under the legislation, any student who is \u201cdeprived of an athletic opportunity or suffers any direct or indirect harm as a result of a school knowingly violating\u201d the bill has the right to sue the school for damages. The bill also prohibits schools, athletic associations, and organizations from retaliating against any student who reports a school violation, and it allows the student to sue any of those aforementioned entities if they do retaliate.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>Additionally, a school is allowed to sue government entities, athletic organizations and associations, and accrediting organizations, if it suffers damage because of a violation of the bill.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p><span class=\"Apple-converted-space\">The Arizona House on Thursday also <a href=\"https:\/\/www.fox10phoenix.com\/news\/arizona-legislature-oks-ban-on-gender-reassignment-surgery1\">approved<\/a> a bill that would ban irreversible gender-reassignment surgeries for minors.\u00a0<\/span><\/p>\n<h3><strong>Oklahoma\u2019s \u201c<a href=\"http:\/\/oklegislature.gov\/BillInfo.aspx?Bill=SB2\">Save Women\u2019s Sports Act<\/a>\u201c<\/strong><\/h3>\n<p>Oklahoma\u2019s <a href=\"http:\/\/webserver1.lsb.state.ok.us\/cf_pdf\/2021-22%20AMENDMENTS\/Amendment%20&#038;%20Engr\/SB2%20HASB%20&#038;%20ENGR.PDF\">SB2<\/a> <a href=\"http:\/\/webserver1.lsb.state.ok.us\/cf\/2021-22%20SUPPORT%20DOCUMENTS\/votes\/Senate\/SB2_VOTES.HTM\">passed<\/a> along party lines 37-7 and awaits a signature from Gov. Kevin Stitt (R), who has only a few days to decide whether to veto or pass the bill.<\/p>\n<p>The legislation is almost identical to Arizona\u2019s bill, mandating that \u201cteams\u00a0designated for \u2018females,\u2019 \u2018women,\u2019 or \u2018girls\u2019 shall not be open to students of the male sex,\u201d and allowing for students to sue a school if it violates the legislation and deprives that student of an athletic opportunity.<\/p>\n<figure id=\"M-ROS-B3\" class=\"a8d adSo\"><\/figure>\n<p>The bill differs in that it orders the parents or legal guardians of a student at the beginning of each school year to \u201csign an affidavit acknowledging the biological sex of the student at birth.\u201d<\/p>\n<p>While media reports have not confirmed whether Gov. Stitt has vocalized his support of the bill, Stitt has a history of favoring legislation rooted in biological reality. Stitt previously\u00a0<a href=\"https:\/\/www.newsweek.com\/oklahoma-state-rep-slams-governor-kevin-stitt-saying-no-such-thing-nonbinary-1641934\">said<\/a>\u00a0\u201cthere is no such thing as non-binary sex,\u201d and once issued an <a href=\"https:\/\/www.koco.com\/article\/stitt-executive-order-amending-birth-certificates\/38211067\">executive order<\/a> telling the Oklahoma State Department of Health that \u201cchanges in sex or gender on a birth certificate or a designation of nonbinary\u201d is \u201ccontrary\u201d to state law, a local ABC News affiliate reported.<\/p>\n<h3><strong>Kentucky\u2019s \u201c<a href=\"https:\/\/apps.legislature.ky.gov\/recorddocuments\/bill\/22RS\/sb83\/bill.pdf\">Save Women\u2019s Sports Act<\/a>\u201c<\/strong><\/h3>\n<p>Kentucky lawmakers passed SB83 26-9, which bans men who think they are women from participating in girls\u2019 and women\u2019s sports from sixth grade through college.<\/p>\n<p>The legislation would require students to have an original, unedited copy of their birth certificate or a signed affidavit from a medical practitioner. However, the bill does not restrict who can participate in coed or boys\u2019 or men\u2019s teams.<\/p>\n<p>While the law does not contain language that would give students the green light to sue their school for damages if it breaks the law, it mandates that governments, licensing or accrediting organizations, and athletic associations are barred from taking adverse action or opening investigations.<\/p>\n<p>According to the <a href=\"https:\/\/www.courier-journal.com\/story\/news\/politics\/ky-general-assembly\/2022\/03\/25\/transgender-sports-ban-bill-passes-kentucky-heres-what-know\/7084228001\/\"><em>Courier Journal<\/em><\/a>, Democrat Gov. Andy Beshear has not indicated whether he will pass or veto the bill.
