{"id":1402135,"date":"2022-03-26T20:59:37","date_gmt":"2022-03-27T00:59:37","guid":{"rendered":"https:\/\/www.conservativenewsdaily.net\/breaking-news\/?p=1402135"},"modified":"2022-03-26T20:59:42","modified_gmt":"2022-03-27T00:59:42","slug":"kavanaugh-joins-libs-setting-stage-for-biden-to-expel-unvaxed-seals-from-navy","status":"publish","type":"post","link":"https:\/\/www.conservativenewsdaily.net\/breaking-news\/kavanaugh-joins-libs-setting-stage-for-biden-to-expel-unvaxed-seals-from-navy\/","title":{"rendered":"Kavanaugh Joins Libs, Setting Stage for Biden to Expel Unvaxed SEALs from Navy"},"content":{"rendered":"<aside class=\"mashsb-container mashsb-main mashsb-stretched\"><div class=\"mashsb-box\"><div class=\"mashsb-count mash-medium\" style=\"&quot;\"><div class=\"counts mashsbcount\">26<\/div><span class=\"mashsb-sharetext\">SHARES<\/span><\/div><div class=\"mashsb-buttons\"><a class=\"mashicon-facebook mash-medium mash-nomargin mashsb-noshadow\" href=\"https:\/\/www.facebook.com\/sharer.php?u=https%3A%2F%2Fwww.conservativenewsdaily.net%2Fbreaking-news%2Fkavanaugh-joins-libs-setting-stage-for-biden-to-expel-unvaxed-seals-from-navy%2F\" target=\"_top\" rel=\"nofollow\"><span class=\"icon\"><\/span><span class=\"text\">Facebook<\/span><\/a><a class=\"mashicon-twitter mash-medium mash-nomargin mashsb-noshadow\" href=\"https:\/\/twitter.com\/intent\/tweet?text=&amp;url=https:\/\/www.conservativenewsdaily.net\/breaking-news\/?p=1402135&amp;via=ConservNewsDly\" target=\"_top\" rel=\"nofollow\"><span class=\"icon\"><\/span><span class=\"text\">Twitter<\/span><\/a><a class=\"mashicon-subscribe mash-medium mash-nomargin mashsb-noshadow\" href=\"#\" target=\"_top\" rel=\"nofollow\"><span class=\"icon\"><\/span><span class=\"text\">Subscribe<\/span><\/a><div class=\"onoffswitch2 mash-medium mashsb-noshadow\" style=\"display:none\"><\/div><\/div>\n            <\/div>\n                <div style=\"clear:both\"><\/div><\/aside>\n            <!-- Share buttons by mashshare.net - Version: 4.0.47--><div><\/div>\n<p class=\"subheading\">Justice Brett Kavanaugh joined the Supreme Court\u2019s majority decision in its vote to allow the Pentagon to consider Navy SEALs\u2019 vaccination status in making deployment decisions.<\/p>\n<p>Although conservative Justices Clarence Thomas, Samuel Alito, and Neil Gorsuch dissented, Kavanaugh joined the majority\u2019s decision to not intervene with the military\u2019s coronavirus vaccine mandate.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>Kavanaugh\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/21a477_1bo2.pdf#page=1\" target=\"_blank\" rel=\"noopener\">wrote<\/a>\u00a0in a concurring opinion:<\/p>\n<blockquote>\n<p>I concur in the Court\u2019s decision to grant the Government\u2019s application for a partial stay of the District Court\u2019s preliminary injunction for a simple overarching reason: Under Article II of the Constitution, the President of the United States, not any federal judge, is the Commander in Chief of the Armed Forces.<\/p>\n<\/blockquote>\n<p>Kavanaugh\u00a0claimed\u00a0the district court \u201cin effect inserted itself into the Navy\u2019s chain of command\u201d by halting the military vaccine mandate.<\/p>\n<p>Thirty-five Navy SEALs brought this lawsuit after President Joe Biden\u2019s administration mandated the coronavirus vaccine for all service members.<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>U.S. District Judge Reed O\u2019Connor of the Northern District of Texas\u00a0<a href=\"https:\/\/www.breitbart.com\/politics\/2022\/01\/04\/navy-seals-v-biden-ruling-military-vax-mandate-illegal\/\">issued<\/a> an order preventing the Navy from considering the vaccine status of SEALs when giving deployments and other operational assignments in January.<\/p>\n<p>Biden\u2019s administration appealed Judge O\u2019Connor\u2019s ruling to the U.S. Court of Appeals for the Fifth Circuit, which <a href=\"https:\/\/www.breitbart.com\/politics\/2022\/03\/01\/fifth-circuit-upholds-injunction-for-navy-seals-challenging-dod-vaccine-mandate\/\">refused<\/a> to\u00a0override O\u2019Connor\u2019s preliminary injunction blocking the military\u2019s mandate.<\/p>\n<p>The Supreme Court on Friday\u00a0issued\u00a0a stay on the district court\u2019s injunction, allowing the Navy to consider vaccination status for deployments while litigations surrounding the mandate continue.<\/p>\n<p>The SEALs alleged the Navy\u2019s vaccine mandate violated their First Amendment right to religious freedom. However, Kavanaugh claimed the Religious Freedom Restoration Act \u201cdoes not justify judicial intrusion into military affairs in this case.\u201d<\/p>\n<p>\u201cI see no basis in this case for employing the judicial power in a manner that military commanders believe would impair the military of the United States as it defends the American people,\u201d Kavanaugh\u00a0concluded in his dissent.<\/p>\n<figure id=\"M-ROS-B3\" class=\"a8d adSo\"><\/figure>\n<p>Justice Alito called the Court\u2019s decision \u201ca great injustice\u201d in a dissent joined by Justice Gorsuch.<\/p>\n<p>Justice Alito\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/21a477_1bo2.pdf#page=4\" target=\"_blank\" rel=\"noopener\">wrote<\/a>:<\/p>\n<blockquote>\n<p>By rubberstamping the Government\u2019s request for what it calls a \u201cpartial stay,\u201d the Court does a great injustice to the 35 respondents\u2014Navy Seals and others in the Naval Special Warfare community\u2014who have volunteered to undertake demanding and hazardous duties to defend our country. These individuals appear to have been treated shabbily by the Navy, and the Court brushes all that aside. I would not do so, and I therefore dissent.<\/p>\n<\/blockquote>\n<p>Although the Navy offers religious exemptions for the vaccine, Alito echoed Judge O\u2019Connor\u2019s sentiments that described the exemption program as \u201ctheater.\u201d<\/p>\n<p>\u201cLater Navy directives told service members that they could apply for religious exemptions, \u2026 but this program, as described by the District Court, was largely \u201ctheater\u201d designed to result in the denial of almost all requests,\u201d Alito wrote.<\/p>\n<p>As of Wednesday, the Navy has only <a href=\"https:\/\/www.navy.mil\/US-Navy-COVID-19-Updates\/\">granted<\/a> nine religious accommodations for Individual Ready Reserve members (who must be fully vaccinated prior to returning to service), and zero religious exemptions have been granted out of the 3,320 applications for accommodation by active service duty members.<\/p>\n<p>The case will now continue in federal court, which Alito noted could take years. But Kavanaugh\u2019s voting with the liberal justices does not bode well, and could mean that these warriors will soon be jettisoned from the military.<\/p>\n<p>The case is\u00a0<em>Austin v.
