Dick Durbin.<\/p>\n<p>It\u2019s a strategy that\u2019s going to work because as chairman, Durbin holds the gavel. And he\u2019s been using it liberally to silence Republican questioners.<\/p>\n<p>Take the issue of Republicans requesting several pre-sentencing reports from the cases of sex offenders that crossed Judge Jackson\u2019s desk before she issued her sentences. These would be vital to understanding the judge\u2019s reasoning for giving some sex offenders lighter sentences.<\/p>\n<p>Durbin says he \u201cwouldn\u2019t want it on his conscience.\u201d<\/p>\n<p><a href=\"https:\/\/nypost.com\/2022\/03\/23\/gop-accuses-dems-wh-of-holding-back-ketanji-brown-jackson-documents\/\" target=\"_blank\" rel=\"noopener\"><em>New York Post:<\/em><\/a><\/p>\n<blockquote>\n<p>\u201cThis information was not requested before, it\u2019s never been requested by this committee,\u201d Durbin said. \u201cAnd I think we ought to think long and hard about whether or not we even consider going into pre-sentence reports.\u201d<\/p>\n<p>Cruz insisted that Jackson herself had told the senators that the reports were \u201crelevant to understanding those cases,\u201d while Lee suggested that members could view redacted versions of the reports or look at them in a classified setting. Durbin was unmoved.<\/p>\n<p>\u201cI do not want it weighing on my conscience that I gave the green light to release this information, so that it might endanger the lives of innocent victims,\u201d he said. \u201cI\u2019m sorry, that\u2019s a bridge too far for me.\u201d<\/p>\n<\/blockquote>\n<p>Durbin has also been interrupting the examination of Jackson by some Republicans, trying to deflect difficult questions from having to be answered. Not coincidentally, this tactic also ate up a large part of the 20 minutes allotted to each Senator for questioning.<\/p>\n<p>Senator Ted Cruz was right in the middle of drilling down on an evasive Judge Jackson when the fireworks between Durbin and Cruz erupted.<\/p>\n<p><a href=\"https:\/\/thehill.com\/homenews\/senate\/599454-durbin-cuts-off-cruz-as-tempers-flare-you-have-to-follow-the-rules\" target=\"_blank\" rel=\"noopener\"><em>The Hill:<\/em><\/a><\/p>\n<blockquote>\n<p class=\"x_MsoNormal\">\u201cYou don\u2019t want her to answer that question?\u201d Cruz asked.<\/p>\n<p class=\"x_MsoNormal\">\u201cYou wouldn\u2019t allow her \u2014\u201d Durbin shot back. \u201cYou\u2019ve gone over the time, senator, by two minutes.\u201d<\/p>\n<p class=\"x_MsoNormal\">\u201cBecause you\u2019ve interrupted me for two minutes, chairman. Will you allow her to answer the question or do you not want the American people to hear why, with someone she described as an egregious \u2014\u201d Cruz said before being interrupted by Durbin again.<\/p>\n<p class=\"x_MsoNormal\">\u201cWhy are you not allowing her to answer the question?\u201d\u00a0Cruz asked with rising irritation. \u201cChairman Durbin, I\u2019ve never seen the chairman refuse to allow a witness to answer questions.\u201d<\/p>\n<p class=\"x_MsoNormal\">Durbin started banging his gavel to bring Cruz to order, prompting Cruz to exclaim: \u201cBang it as loud as you want.\u201d<\/p>\n<\/blockquote>\n[embedded content]\n<p>All nominees to the Supreme Court try to say as little as possible in order to offend the fewest number of people. It\u2019s an old game going back to the 1980s. Before then, Supreme Court hearings were fairly serious affairs \u2014 not the three-ring circuses they\u2019ve become.
