She also evaded questions about her judicial philosophy, insisting that she had a judicial \u201cmethodology\u201d instead.<\/p>\n<p>Curiously, however, Judge Jackson seemed to identify herself as a judicial \u201coriginalist,\u201d criticizing \u201cjudicial activism\u201d and claiming that she did not even know what the left-wing view of a \u201cliving Constitution\u201d meant.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>As Reason.com <a href=\"https:\/\/reason.com\/2022\/03\/23\/ketanji-brown-jacksons-partial-tribute-to-the-judicial-philosophy-of-originalism-earns-conservative-praise\/\">noted<\/a>, optimistically:<\/p>\n<blockquote>\n<p>\u201cI believe that the Constitution is fixed in its meaning,\u201d Jackson said. \u201cI believe that it is appropriate to look at the original intent, original public meaning of the words when one is trying to assess [a constitutional provision] because, again, that is a limitation on my authority to import my own policy views.\u201d<\/p>\n<p>\u2026<\/p>\n<p>Those words came as a pleasant surprise to many originalists. \u2026<\/p>\n<p>Libertarian-minded originalists may also take heart in Jackson\u2019s comments during an exchange with Sen. John Cornyn (R\u2013Texas), who complained to her about the Supreme Court thwarting the will of the majority when it invalidated certain democratically enacted state regulations. \u201cWell, senator,\u201d Jackson calmly and correctly told him, \u201cthat is the nature of a right. When there is a right, it means that there are limitations on regulation.\u201d<\/p>\n<\/blockquote>\n<p>What Cornyn discovered next, though, revealed that Judge Jackson is not an \u201coriginalist\u201d at all. As Breitbart News <a href=\"https:\/\/www.breitbart.com\/politics\/2022\/03\/22\/judge-ketanji-brown-jackson-caught-in-contradiction-over-judicial-activism\/\">noted<\/a>:<\/p>\n<blockquote>\n[W]hen Cornyn questioned her further about the doctrine of \u201csubstantive due process\u201d \u2014 the idea that the Constitution incorporates rights that it does not actually enumerate explicitly \u2014 Judge Jackson seemed flummoxed by his queries.<br \/>On the one hand, she defended the idea that the Constitution could incorporate rights that were a part of common tradition. On the other, she could not answer why, if traditional marriage were part of that cultural tradition, it was somehow excluded.<\/p>\n<p>Sen. Cornyn continued, pointing out that the same discretion that judges used to find new rights in some cases could be abused in other cases. He referred to the notorious Dred Scott case upholding slavery; she seemed not to follow his argument.<\/p>\n<p>So the Senator tried again: \u201cWhat other unenumerated rights are out there?\u201d Judge Jackson was evasive, saying that the question was \u201chypothetical.\u201d Cornyn noted that while she purported to oppose judicial activism, she set no boundary for it.<\/p>\n<p>Judge Jackson protested that she would be bound by the law and by judicial precedent. But Sen. Cornyn pointed out that as a Supreme Court justice, she would be largely unconstrained by precedent, given the Court\u2019s tendency to set new precedents.<\/p>\n<\/blockquote>\n<p>Cornyn, in his polite way, revealed the reality behind Judge Jackson\u2019s confirmation-friendly pretense. She is no \u201coriginalist.\u201d She is no \u201coriginalist,\u201d looking to the original meaning of words. She could not even say what the word \u201cwoman\u201d meant.<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>Something worse is going on here than the usual attempt by a Supreme Court nominees to evade hostile questions about their views on controversial legal issues. Judge Jackson is actually pretending to be something she is not: a judicial conservative.<\/p>\n<p>As Sen. Lindsey Graham (R-SC) pointed out, the vast armada of left-wing organizations opposed Judge J. Michelle Childs of South Carolina in favor of Judge Jackson. They did so because she has been, and will be, a reliable vote for the Democrats.<\/p>\n<p>But the left\u2019s enthusiasm for Judge Jackson has been muted, other than perfunctory applause for the fact that she is black and a \u201cwoman\u201d (whatever that means). She is not defending their ideas, such as Critical Race Theory; she is downplaying them.<\/p>\n<p>Judge Jackson is pretending to be a originalist because conservatives have won the argument over legal philosophy, and because the public will reject a judge who admits pursuing what Judge Jackson once <a href=\"https:\/\/www.breitbart.com\/politics\/2022\/03\/21\/ketanji-brown-jackson-college-thesis-argued-judges-have-personal-hidden-agendas\/\">called<\/a> \u201cpersonal hidden agendas.\u201d<\/p>\n<p><em>Joel B.
