Matthew Krause (R) <a href=\"http:\/\/www.frcaction.org\/get.cfm?i=LK22C01\">filed a lawsuit<\/a> against President Joe Biden and several other health and transportation agencies on Wednesday over \u201cauthoritarian\u201d mask mandates on airplanes.<\/p>\n<p>The lawsuit, filed\u00a0in the\u00a0Northern District of Texas\u00a0by powerhouse D.C. law firm Schaerr Jaffe, alleges that Biden\u2019s mask mandate for air travel\u00a0violates the Administrative Procedure Act (APA) because it\u00a0is \u201carbitrary and capricious,\u201d and not supported by science. The complaint argues that there is \u201cno significant link between wearing masks and slowing the spread of COVID-19,\u201d and noted that the air on commercial airlines is among the \u201ccleanest and safest of any environment on earth.\u201d The filing also points to \u201cgrowing scientific literature\u201d documenting the harms of mask wearing, especially for children.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p><span>In an exclusive statement to Breitbart News on Thursday, FRC Action President Tony Perkins slammed the Biden administration and local governments across the United States, saying they have \u201cexploited\u201d the pandemic to \u201csuffocate freedoms.\u201d\u00a0<\/span><\/p>\n<p>\u201cGiven what we have learned over the past two years, this overreaching government mask mandate on the 2.9 million Americans who fly on a typical day is not based on science. In some cases, masks have actually proven detrimental to adults and children. Air in airplanes is filtered at a more frequent rate than even hospitals, and it is one of the least conducive environments for the spreading of a virus,\u201d Perkins said.<\/p>\n<p>\u201cFRC Action believes these authoritarian mandates must be challenged. The Biden administration, along with a number of other local governments across the country, has exploited the COVID pandemic, used it to suffocate our freedoms unnecessarily, and in some cases target churches and people of faith,\u201d he continued.\u00a0<b><\/b><\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>The lawsuit revolves around\u00a0an\u00a0executive order Biden issued the day after his inauguration,\u00a0Executive Order 13998,\u00a0in which he instructed the\u00a0U.S. Departments of Transportation (DOT), Health and Human Services (HHS), and Homeland Security\u00a0(DHS), as well as their components the Federal Aviation Administration (FAA), Centers for Disease Control and Prevention (CDC), and Transportation Security Administration (TSA) to continue mandating mask wearing on commercial airlines in the United States. The order was set to expire on March 18, but Biden extended the order until April 18 \u201cwith no assurance that the mandate will expire at that time,\u201d the complaint states.<\/p>\n<p>The plaintiffs, among whom are Perkins\u2019\u00a0teenage\u00a0son and another\u00a0member of FRC Action, argue that none of them would wear a mask on upcoming flights, were it not for Biden\u2019s executive order. The lawsuit points to various articles and research\u00a0that\u00a0show that \u201cmasks are actually ineffective, particularly the cloth masks and surgical masks commonly worn\u201d and\u00a0that prolonged use of masks\u00a0can harm the wearers.<\/p>\n<p>\u201cGiven that wearing cloth or surgical masks satisfy the Mask Mandate, it is not effective at stopping COVID-19 in airports or on airplanes,\u201d the complaint states.<\/p>\n<p>\u201cThe Mask Mandate is harmful to children. Forcing children to wear masks comes with a variety of health risks: skin issues, carbon dioxide in the blood, anxiety and depression, which outweighs [sic] the mild benefits for children,\u201d the lawsuit continues. \u201cSome of the data regarding children does not specify whether the harm to children is specifically due to the wearing of masks, but is relevant to assessing the potential impact of the Mask Mandate.\u201d<\/p>\n<p>Rep. Krause also gave an exclusive statement to Breitbart News, saying Biden\u2019s mandate is \u201cnot tethered to science or facts.\u201d<\/p>\n<figure id=\"M-ROS-B3\" class=\"a8d adSo\"><\/figure>\n<p>\u201cPresident Biden and his administration have become more and more comfortable ignoring federal laws in order to pursue a progressive agenda not tethered to science or facts,\u201d the lawmaker said. \u201cThe airport and airplane mask mandates are further evidence of his arbitrary and capricious decision making. I am proud to stand with my friends at FRC Action against yet another unconstitutional action by President Biden.\u201d<\/p>\n<p>Overall, the plaintiffs are asking the court not to \u201cdefer to\u00a0the agency\u2019s conclusory or unsupported suppositions,\u201d\u00a0and emphasized their point by noting that the government has not updated its policy to include\u00a0recently confirmed\u00a0medical science regarding children\u2019s lower risk from the virus, heightened risks from mask wearing, and natural immunity.<\/p>\n<p>\u201cDefendants likewise failed to consider the U.S. Government\u2019s own DARPA [a U.S. Dept. of Defense agency] study regarding the miniscule risk of contracting COVID-19 on a commercial aircraft. These facts alone should result in a holding of arbitrary and capricious,\u201d the filings reads.\u00a0<b><br \/><\/b><\/p>\n<p>The lawsuit was filed soon after several U.S. airlines <a href=\"https:\/\/www.breitbart.com\/politics\/2022\/03\/24\/it-makes-no-sense-airlines-demand-biden-drop-mask-mandate\/\">sent a letter<\/a> to President Joe Biden, asking him to drop his federal mask mandate for aircraft and international testing requirements.<\/p>\n<p>\u201cIt makes no sense that people are still required to wear masks on airplanes, yet are allowed to congregate in crowded restaurants, schools and at sporting events without masks, despite none of these venues having the protective air filtration system that aircraft do,\u201d the letter\u00a0from CEOs from American Airlines, United Airlines, Southwest Airlines, JetBlue, and others\u00a0<a class=\"x5l\" href=\"https:\/\/www.airlines.org\/news\/a4a-urges-white-house-to-lift-predeparture-testing-requirements-mask-mandate\/\" target=\"_blank\" rel=\"noopener external\">said<\/a>\u00a0in the letter, also dated Wednesday.<\/p>\n<p>The case is\u00a0<em>Family Research Council Action Inc.\u00a0v.
