Only immigration judges can currently consider such applications.<\/p>\n<p>The agency said it expects the changes to decrease the time it takes for asylum applications to be processed from years to months.<\/p>\n<p>\u201cThe current system for handling asylum claims at our borders has long needed repair,\u201d DHS Secretary Alejandro Mayorkas said. \u201cThrough this rule, we are building a more functional and sensible asylum system to ensure that individuals who are eligible will receive protection more swiftly, while those who are not eligible will be rapidly removed.\u201d<\/p>\n<p>Attorney General Merrick Garland said the new rule \u201cwill help reduce the burden on our immigration courts, protect the rights of those fleeing persecution and violence, and enable immigration judges to issue removal orders when appropriate.\u201d <strong><a href=\"https:\/\/dailycaller.com\/2022\/03\/23\/photos-border-patrol-migrants-texas\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: Photos Reportedly Show Border Patrol Releasing Migrants Into Texas Towns)<\/a><\/strong><\/p>\n<div id=\"attachment_7397353\" class=\"wp-caption alignnone\">\n<p id=\"caption-attachment-7397353\" class=\"wp-caption-text\">LA JOYA, TEXAS \u2013 NOVEMBER 17: Migrants sit against a fence while waiting to board a border patrol bus after crossing the Rio Grande into the U.S. on November 17, 2021 in La Joya, Texas. (Brandon Bell\/Getty Images)<\/p>\n<\/div>\n<p>Under the new rule, asylum applicants with a credible fear claim will be given a \u201ctimely interview with an asylum officer\u201d to determine whether their asylum claim is valid. After the interview, a USCIS officer will then determine whether or not to grant the asylum claim. Individuals whose asylum claims are not granted by a USCIS officer will be referred to an immigration judge for a removal proceeding, according to the DHS statement.<\/p>\n<p>There are currently 1.7 million cases pending in <a href=\"https:\/\/dailycaller.com\/2022\/03\/15\/customs-border-protection-cbp-chris-magnus-february-2022\/\" target=\"_blank\" rel=\"noopener noreferrer\">immigration<\/a> court, according to Syracuse University\u2019s <a href=\"https:\/\/trac.syr.edu\/phptools\/immigration\/court_backlog\/\" target=\"_blank\" rel=\"noopener noreferrer\">Transactional Records Access Clearinghouse<\/a>, which tracks immigration data.<\/p>\n<p>The announcement comes as U.S. officials are reportedly <a href=\"https:\/\/dailycaller.com\/2022\/03\/18\/biden-administration-prepares-mass-influx-migrants-southern-border\/\" target=\"_blank\" rel=\"noopener noreferrer\">quietly preparing<\/a> for more than 170,000 migrants to arrive at the <a href=\"https:\/\/dailycaller.com\/2022\/03\/24\/customs-border-protection-joe-biden-administration-mexico-southern-border\/\" target=\"_blank\" rel=\"noopener noreferrer\">southern border<\/a> pending the potential lifting of a COVID-era expulsion policy, <a href=\"https:\/\/www.axios.com\/biden-border-mexico-migrants-title-42-a91b6441-2197-463f-ab1f-2435824a9566.html\" target=\"_blank\" rel=\"noopener noreferrer\">according<\/a> to Axios.
