Sen. Marsha Blackburn (R-TN) explained Jackson\u2019s past rulings to The Daily Wire\u2019s \u201cMorning Wire\u201d podcast.<\/p>\n<p>\u201cWhat we found was 10 cases where she\u2019s weighed in on child pornography,\u201d Blackburn told \u201cMorning Wire.\u201d \u201cEight of those 10 cases, she was below the minimum sentence. \u2026 And this ranged anywhere from 14% to 88%.\u201d<\/p>\n<p>Jackson\u2019s propensity to give child pornography convicts lighter sentences is part of a large trend among judges. Republicans critical of the trend have pressed the Supreme Court pick on her sentencing judgement for several days.<\/p>\n<p>\u201cThere were two cases where she didn\u2019t have judicial discretion, and those cases were right at the guidelines,\u201d Blackburn said. \u201cBut what she did by and large, when she had \u2014 when she was given that discretion, she went below the guidelines.\u201d<\/p>\n<p>Blackburn questioned Jackson on Tuesday, asking the potential Supreme Court justice if she could define the term \u201cwoman.\u201d Jackson demurred. The Daily Wire reported on the exchange:<\/p>\n<blockquote>\n<p><em>\u201cCan you provide a definition for the word \u2018woman\u2019?\u201d Blackburn asked.<\/em><\/p>\n<p><em>\u201cCan I provide a definition?\u201d Jackson repeated the question.<\/em><\/p>\n<p><em>\u201cMmhmm, yeah,\u201d Blackburn confirmed.<\/em><\/p>\n<p><em>\u201cI can\u2019t,\u201d Jackson replied.<\/em><\/p>\n<p><em>\u201cYou can\u2019t?\u201d Blackburn asked.<\/em><\/p>\n<p><em>\u201cNot \u2014 in this context, I\u2019m not a biologist,\u201d Jackson laughed.<\/em><\/p>\n<p><em>\u201cSo you believe the meaning of the word \u2018woman\u2019 is so unclear and controversial that you can\u2019t give me a definition?\u201d Blackburn continued to press.<\/em><\/p>\n<p><em>\u201cSenator, in my work as a judge, what I do is I address disputes,\u201d Jackson pushed back, suggesting that she could only provide a decision based on arguments and the law. \u201cIf there is a dispute about a definition, people make arguments and I look at the law and I decide, so \u2014 I\u2019m not \u2014\u201d<\/em><\/p>\n<p><em>\u201cThe fact that you can\u2019t give me a straight answer about something as fundamental as what a woman is underscores the dangers of the kind of progressive education that we are hearing about,\u201d Blackburn continued.<\/em><\/p>\n<\/blockquote>\n<p>In addition to her sentencing history, Jackson has also received questions about her history with Critical Race Theory. Jackson <a href=\"https:\/\/www.dailywire.com\/news\/biden-nominee-serves-on-board-of-dc-school-promoting-critical-race-theory\">serves<\/a> on the board of a Washington, D.C., school that promotes CRT in its curriculum. In speeches and lectures given over the past seven years, Jackson has <a href=\"https:\/\/www.dailywire.com\/news\/bidens-supreme-court-pick-championed-advocates-of-critical-race-theory-in-lectures-speeches\">legitimized<\/a> CRT terms such as \u201cmicroaggression,\u201d and touted some of CRT\u2019s leading scholars. As The Daily Wire reported:<\/p>\n<blockquote>\n<p><em>A review of a handful of Jackson\u2019s lectures and speeches from the past seven years shows that the nominee has a strong appreciation for leading proponents of\u00a0<a href=\"https:\/\/www.dailywire.com\/news\/what-is-critical-race-theory-breaking-down-the-ideology-thats-hitting-schools-across-the-country\">CRT<\/a>, a progressive idea that holds in part: \u201cracism is endemic to, rather than a deviation from, American norms,\u201d legal scholar Kimberle Crenshaw, who coined the term, wrote in 1989.
