She was literally the court-packers\u2019 pick for this seat. And she has repeatedly refused to reject their position.\u201d<\/p>\n<p>McConnell pointed out that both Justice <a href=\"https:\/\/www.dailywire.com\/news\/liberal-justice-breyer-warns-against-democrats-packing-supreme-court-people-will-lose-trust-in-the-court\">Stephen Breyer<\/a>, whose seat Jackson was nominated to fill, and the late Justice <a href=\"https:\/\/www.dailywire.com\/news\/honor-her-wishes-rbg-blasted-democrats-for-proposing-bad-idea-of-packing-supreme-court\">Ruth Bader Ginsburg<\/a>, had no issues denouncing the idea of adding justices to the Supreme Court.<\/p>\n<p>\u201cBut Judge Jackson has refused to follow in the footsteps of Justices Ginsburg and Breyer. She refuses to rule out what the radical activists want,\u201d McConnell said. \u201cWhere Justices Ginsburg and Breyer slammed the door shut, Judge Jackson leaves it open. She told <a href=\"https:\/\/www.youtube.com\/watch?v=_cDnKXWC_8M\">Senator Kennedy<\/a> that she does have an opinion on court-packing, but it\u2019s \u2018not a strongly held opinion,\u2019 and in any event, she wouldn\u2019t tell Senators what it is.\u201d<\/p>\n<p>\u201cJudge Jackson also displayed a remarkable lack of candor during basic questions about judicial philosophy,\u201d McConnell continued. \u201cWhen asked about judicial philosophy, the nominee tried to punt by simply restating the most basic elements of a judge\u2019s job description. She said she looks at the facts of cases and treats litigants fairly. That\u2019s not explaining a judicial philosophy. That\u2019s just rewording the judicial oath. It\u2019s a non-answer. These are pivotal questions. They require clear responses.\u201d<\/p>\n<p>McConnell then pointed to one particular moment where Jackson said that she did not deal with interpreting the Constitution in her capacity as a judge in lower courts.\u00a0\u201cHere\u2019s what she said,\u201d McConnell quoted. \u201c\u2018I would say, just as an aside \u2026 that while I have been on the bench for nine plus years, the issue of constitutional interpretation in that sense doesn\u2019t come up very\u00a0often. It comes up to the Supreme Court for sure, but it doesn\u2019t come up very often in the lower courts.\u2019 In other words, at least in that moment, a nominee for the United States Supreme Court tried to tell the Committee that her professional experience had not prepared her for an in-depth discussion of constitutional interpretation.\u201d<\/p>\n<p>McConnell also blasted Jackson for trying to explain away accusations that she has a lenient sentencing history.<\/p>\n<p>\u201cIn a number of instances, she\u2019s given out sentences far, far below the sentencing guidelines and far below the government prosecutors\u2019 requests. In cases ranging from child exploitation to fentanyl trafficking, she used every possible ounce of discretion to essentially remake sentencing policy from the bench.\u201d He pointed out that, while being questioned by <a href=\"https:\/\/www.dailywire.com\/news\/a-very-simple-question-tom-cotton-has-testy-exchange-with-ketanji-brown-jackson\">Senator Tom Cotton<\/a>, she refused to give her opinion on sentencing guidelines, but at other times claimed judges have wide latitude in sentencing. \u201cEither subjective questions about sentencing are fair game for the judicial branch, or they are not.
