Ted Cruz (D-TX) questioned\u00a0Ketanji Brown Jackson on Wednesday during her Senate confirmation hearing if a plaintiff could alter his or her gender or race and continue to hold legal standing during a lawsuit involving race or gender.<\/p>\n<p>\u201cYesterday, under questioning from Senator Blackburn you told her that you cannot define what a woman is \u2014 that you are not a biologist, which I think, you are the only Supreme Court nominee in history who has been unable to answer the question \u2014 what is a woman.\u201d Cruz prefaced.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Senator <a href=\"https:\/\/twitter.com\/tedcruz?ref_src=twsrc%5Etfw\">@tedcruz<\/a>: &#8220;I think you&#8217;re the only Supreme Court nominee in history who&#8217;s been unable to answer the question: what is a woman?&#8221; <a href=\"https:\/\/t.co\/y7MsJLvMU9\">pic.twitter.com\/y7MsJLvMU9<\/a><\/p>\n<p>\u2014 RNC Research (@RNCResearch) <a href=\"https:\/\/twitter.com\/RNCResearch\/status\/1506712385372962816?ref_src=twsrc%5Etfw\">March 23, 2022<\/a><\/p>\n<\/blockquote>\n<p>\u201cUnder the modern, leftist sensibilities, if I decide right now that I am a woman, then, apparently, I am a woman, does that mean I would have article three standing to challenge a gender-based restriction?\u201d Cruz asked.<\/p>\n<p>Jackson refused to answer the question. \u201cThose kinds of issues are working their way through the courts, and I am not able to comment on them,\u201d she claimed.<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">SEN. <a href=\"https:\/\/twitter.com\/tedcruz?ref_src=twsrc%5Etfw\">@tedcruz<\/a>: &#8220;I&#8217;m an Hispanic man. Could I decide I was an Asian man\u2026and challenge Harvard&#8217;s discrimination because I made that decision?&#8221;<\/p>\n<p>JACKSON: &#8220;Senator, I&#8217;m not able to answer your question.&#8221; <a href=\"https:\/\/t.co\/0EhSt64JHi\">pic.twitter.com\/0EhSt64JHi<\/a><\/p>\n<p>\u2014 RNC Research (@RNCResearch) <a href=\"https:\/\/twitter.com\/RNCResearch\/status\/1506707675173765120?ref_src=twsrc%5Etfw\">March 23, 2022<\/a><\/p>\n<\/blockquote>\n<p>Cruz continued down his line of questioning and posed the question a different way.<\/p>\n<p>\u201cIf I can change my gender and be a woman and an hour later I decide I am not a woman anymore, I guess I would lose article three standing,\u201d Cruz stated. \u201cDoes that same principle apply to other protected characteristics?\u201d Cruz asked. \u201cFor example, I\u2019m a Hispanic man. Could I decide I was an Asian man? Do I have the ability to be an Asian man and challenge Harvard\u2019s discrimination because I made that decision?\u201d Cruz asked in <a href=\"https:\/\/www.breitbart.com\/education\/2022\/03\/23\/ketanji-brown-jackson-will-recuse-herself-from-harvard-race-case\/\">reference<\/a> to a case before the Supreme Court.<\/p>\n<p>Jackson refused to answer again. \u201cYou are asking me about hypotheticals,\u201d she complained before giving a broad answer that did not answer the question.<\/p>\n<p>\u201cI would assess standing the way I assess other legal issues which is to listen to the arguments made by the parties, consider the relevant precedents and constitutional principles involved and make a determination,\u201d she said.<\/p>\n<p>Cruz\u2019s question comes as Jackson\u2019s confirmation hearings have lasted three days.
