Circuit Court Judge Ketanji Brown Jackson promised Wednesday to recuse herself from a lawsuit challenging Harvard University\u2019s affirmative action policies if confirmed to the Supreme Court.<\/p>\n<p>The Supreme Court will <a href=\"https:\/\/www.nytimes.com\/2022\/01\/24\/us\/politics\/supreme-court-affirmative-action-harvard-unc.html\">hear<\/a> two cases in the fall addressing affirmative action at Harvard and the University of North Carolina. The plaintiffs in the Harvard case <a href=\"https:\/\/dailycaller.com\/2021\/02\/25\/students-for-fair-admissions-harvard-lawsuit-supreme-court-ban-race-college-admissions\/\">allege<\/a> that the university effectively established a racial quota to limit the number of Asian-American applicants. The university docked Asian-American applicants admissions points in categories like \u201cpositive personality,\u201d likability and \u201cwidely respected,\u201d the lawsuit <a href=\"https:\/\/dailycaller.com\/2018\/06\/15\/harvard-asian-americans-lawsuit\/\">alleges<\/a>. <strong><a href=\"https:\/\/dailycaller.com\/2019\/10\/01\/harvard-affirmative-action-ruling\/\">(RELATED: Federal Judge Rules Against Asian Students In Harvard Race-Based Admissions Trial)<\/a><\/strong><\/p>\n<p>\u201cThat is my plan,\u201d Jackson said about recusal when asked by Republican Texas Sen. Ted Cruz.<\/p>\n<p>Jackson currently <a href=\"https:\/\/www.harvard.edu\/about\/leadership-and-governance\/board-of-overseers\/\">sits<\/a> on the university\u2019s Board of Overseers. Under the federal judiciary\u2019s rules for recusal, judges must <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/28\/455\" target=\"_blank\" rel=\"noopener noreferrer\">recuse<\/a> themselves from \u201cany proceeding in which his impartiality might reasonably be questioned,\u201d including when the judge may have \u201ca personal bias or prejudice concerning a party, or personal knowledge of disputed evidentiary facts concerning the proceeding.\u201d<\/p>\n<p>Cruz, who <a href=\"https:\/\/dailycaller.com\/2022\/03\/21\/senators-signal-three-issues-define-ketanji-brown-jackson-hearing-supreme-court\/\">attended<\/a> Harvard Law School at the same time as Jackson, staunchly criticized the alleged discrimination during an exchange with Jackson.<\/p>\n<p><strong>WATCH:<\/strong><\/p>\n<p>Cruz described the school\u2019s affirmative action practices as an \u201cexplicit and, in my view, egregious policy of discriminating against Asian-Americans,\u201d before delving into a question about legal rules regarding standing.<\/p>\n<p>\u201cEven though I see that policy is egregious, I as an individual plaintiff could not bring a lawsuit challenging it because I am not Asian-American, is that right?\u201d he asked Jackson, who did not directly answer the question.<\/p>\n<p>\u201cIf you brought a lawsuit, the court would have to evaluate whether you had an actual injury in order to be able to determine whether it had subject matter jurisdiction to hear the suit,\u201d she responded.<\/p>\n<p>Jackson\u2019s recusal decision was considered a key issue before her confirmation hearings, with several Republican <a href=\"https:\/\/www.washingtonpost.com\/politics\/2022\/03\/10\/ketanji-jackson-harvard-affirmative-action-case\/\">senators<\/a> and conservative legal commentators calling for her to make it clear.<\/p>\n<p>\u201cIt would be profoundly inappropriate for a jurist to sit on a case for a school in which she has held a governing position and a role in setting institutional policies,\u201d George Washington University law professor Jonathan Turley <a href=\"https:\/\/thehill.com\/opinion\/judiciary\/596249-judge-jackson-should-recuse-herself-from-major-discrimination-case-before\">wrote<\/a>.<\/p>\n<p>Other Supreme Court justices have recused themselves in the past from proceedings related to schools with which they have connections. Justice Clarence Thomas <a href=\"https:\/\/www.nytimes.com\/1995\/10\/06\/us\/high-court-to-hear-case-about-vmi.html\">recused<\/a> himself from a 1995 case involving the gender integration of Virginia Military Institute because his son attended the school. Justice Amy Coney Barrett <a href=\"https:\/\/www.politico.com\/news\/2020\/09\/29\/amy-coney-barrett-recuse-election-cases-423248\">pledged<\/a> during her confirmation hearings to recuse herself from all cases involving her former employer, the University of Notre Dame.<\/p>\n<p>The Supreme Court has upheld affirmative action schemes in the cases <a href=\"https:\/\/www.law.cornell.edu\/wex\/regents_of_the_university_of_california_v_bakke_(1978)\" target=\"_blank\" rel=\"noopener noreferrer\">Regents of the University of California v. Bakke<\/a> and <a href=\"https:\/\/www.oyez.org\/cases\/2002\/02-241\">Grutter v. Bollinger<\/a>, although it has found explicit racial quotas to be unconstitutional.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>D.C.
