Ted Cruz pressed Supreme Court nominee Ketanji Brown Jackson Wednesday on being able to identify as a \u201cwoman\u201d or an \u201cAsian man.\u201d<\/p>\n<p><a href=\"https:\/\/dailycaller.com\/2022\/03\/22\/ted-cruz-whiteboard-ketanji-brown-jackson-child-pornography-sentencing\/\" target=\"_blank\" rel=\"noopener noreferrer\">Cruz<\/a> asked Jackson on how she can determine which individuals are eligible to receive Article III standing in order to challenge gender-based policies without the ability to define what a woman is. This <a href=\"https:\/\/www.appellate.net\/resources\/article-iii-standing-pleading-injury-fact\/\" target=\"_blank\" rel=\"noopener noreferrer\">standing<\/a> holds that a plaintiff must allege real,\u00a0 \u201cconcrete\u201d harm in order to have standing to sue in federal court.<\/p>\n<p>\u201cSenator, I know that I\u2019m a woman. I know that Senator [Marsha] Blackburn is a woman, and the woman who I admire most in the world is sitting in this room today, my mother,\u201d Jackson began.<\/p>\n<p>Cruz then challenged the nominee on whether identifying as a woman or an Asian man gives him the standing to challenge gender and race-based restrictions. <strong><a href=\"https:\/\/dailycaller.com\/2022\/03\/23\/not-biologist-judge-jackson-declines-answer-20-week-old-unborn-child-outside-womb\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: \u2018I\u2019m Not A Biologist\u2019: Judge Jackson Declines To Answer Whether A 20-Week-Old Unborn Child Can Live Outside The Womb)\u00a0<\/a><\/strong><\/p>\n<p>\u201cIf I can change my gender, if I can be a woman and then an hour later, if I decide I\u2019m not a woman anymore, I guess I would lose Article III standing,\u201d Cruz said. \u201cTell me, does that same principle apply to other protected characteristics? For example, I\u2019m an Hispanic man, could I decide I\u2019m an Asian man? Would I have the ability to be an Asian man and challenge Harvard\u2019s discrimination because I made that decision?\u201d<\/p>\n<p><a href=\"https:\/\/dailycaller.com\/2022\/03\/22\/josh-hawley-judge-jackson-child-porn-offender-scotus-hearing\/\" target=\"_blank\" rel=\"noopener noreferrer\">Jackson<\/a> declined to directly answer the question, arguing that the issues are currently being debated in the courts. She then answered that she would assess any issue by listening to the parties involved and considering \u201crelevant precedents and constitutional principles involved.\u201d<\/p>\n<p>Republican Tennessee Sen. Marsha Blackburn <a href=\"https:\/\/dailycaller.com\/2022\/03\/22\/judge-jackson-marsha-blackburn-woman-definition\/\" target=\"_blank\" rel=\"noopener noreferrer\">asked<\/a> Jackson to define the term \u201cwoman\u201d during her Tuesday hearing, which she declined to answer, saying, \u201cI\u2019m not a biologist.\u201d She then said she would address disputes over a definition and make a final decision after proper review.<\/p>\n<p><a href=\"https:\/\/dailycaller.com\/2022\/03\/21\/ted-cruz-democrats-filibuster-black-hispanic-nominees\/\" target=\"_blank\" rel=\"noopener noreferrer\">Cruz<\/a> said Jackson is the \u201conly Supreme Court nominee in history\u201d unable to define a woman.<\/p>\n<\/p><\/div>\n","protected":false},"excerpt":{"rendered":"<p>Republican Texas Sen.
