John Cornyn<\/a> asked Jackson to answer whether a 20-week-old unborn child is capable of surviving outside of the womb, saying a child would \u201cneed to be fed, sheltered and all of the other essentials to sustain human life.\u201d<\/p>\n<p>\u201cSenator, I\u2019m not a biologist,\u201d she replied. \u201cI haven\u2019t studied this. I don\u2019t know.\u201d<\/p>\n<p>\u201cYou don\u2019t know whether an unborn child can live outside the womb at 20 weeks gestation?\u201d Cornyn pressed.<\/p>\n<p>The nominee said the Supreme Court has established the right for a woman to terminate her pregnancy up to the point of viability and have \u201ctests and standards\u201d in place to properly regulate abortion.<\/p>\n<p>Jackson referred to the 1973 landmark case <a href=\"https:\/\/dailycaller.com\/2021\/07\/26\/hawley-cruz-lee-supreme-court-overturn-roe-v-wade\/\" target=\"_blank\" rel=\"noopener noreferrer\">Roe v. Wade<\/a>, where the Supreme Court ruled that a woman\u2019s right to terminate her pregnancy up to the point of fetal viability \u2014 24-28 weeks gestation \u2014 while allowing states to regulate abortion procedures after the viability point.<\/p>\n<p>A fetus born prior to 24-weeks gestation typically has below a 50% chance of survival, <a href=\"https:\/\/healthcare.utah.edu\/womenshealth\/pregnancy-birth\/preterm-birth\/when-is-it-safe-to-deliver.php\" target=\"_blank\" rel=\"noopener noreferrer\">according<\/a> to the University of Utah. Infants born prematurely have a 40% chance of suffering from long-term health complications. <strong><a href=\"https:\/\/dailycaller.com\/2022\/03\/22\/ketanji-brown-jackson-refuses-answer-court-packing\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: \u2018I Agree With Justice Barrett\u2019: Jackson Dodges On Court-Packing Again)<\/a><\/strong><\/p>\n<p>Jackson also <a href=\"https:\/\/dailycaller.com\/2022\/03\/22\/judge-jackson-marsha-blackburn-woman-definition\/\" target=\"_blank\" rel=\"noopener noreferrer\">declined<\/a> to provide a definition for the term \u201cwoman\u201d during her Tuesday hearing when pressed by Republican Tennessee Sen. Marsha Blackburn. She gave the Tennessee senator the same excuse, telling her, \u201cI\u2019m not a biologist.\u201d<\/p>\n<p>When further pressed if providing a definition is too controversial, Jackson said her role as a judge is to settle disputes about a definition and make a final decision after proper review.<\/p>\n<p>Republican Louisiana <a href=\"https:\/\/dailycaller.com\/2021\/11\/30\/john-kennedy-roe-v-wade-poorly-reasoned-decisions-mississippi-abortion-law\/\" target=\"_blank\" rel=\"noopener noreferrer\">Sen. John Kennedy<\/a> asked her Tuesday when she believes life begins, to which the nominee <a href=\"https:\/\/twitter.com\/atrupar\/status\/1506437532430573569\" target=\"_blank\" rel=\"noopener noreferrer\">said<\/a> she did not know.
