Marsha Blackburn asked her to provide a definition of the word \u201cwoman.\u201d<\/p>\n<p>But for not knowing what a \u201cwoman\u201d is, Jackson loves to use the word. Here are 14 times she invokes the fairer sex in just the first two days of her confirmation hearings, plus 34 times she\u2019s used the word in her legal opinions as a judge (emphasis ours).<\/p>\n<h2 id=\"kbj-referenced-women-14-times-in-first-two-days-of-hearings\">KBJ Referenced Women 14 Times in First Two Days of Hearings<\/h2>\n<p>In her opening statement on <a href=\"https:\/\/www.c-span.org\/video\/?518341-1\/jackson-confirmation-hearing-day-1\">day one<\/a> of her confirmation hearings, Jackson opined that \u201cI stand on the shoulders of so many who have come before me, including Judge Constance Baker Motley, who was the first African-American <strong>woman <\/strong>to be appointed to the bench.\u201d<\/p>\n<p>On <a href=\"https:\/\/www.c-span.org\/video\/?518342-1\/confirmation-hearing-supreme-court-nominee-ketanji-brown-jackson-day-2&#038;live\">day two<\/a>, Jackson couldn\u2019t talk about the Supreme Court\u2019s precedent on abortion without referencing women. <\/p>\n<p>\u201c<em>Roe <\/em>and <em>Casey <\/em>are the settled law of the Supreme Court concerning the right to terminate a <strong>woman\u2019s <\/strong>pregnancy,\u201d she said.<\/p>\n<p>\u201cAfter <em>Casey<\/em>, the court has determined not so much that the right to terminate a <strong>woman\u2019s <\/strong>pregnancy is fundamental,\u201d she continued. \u201cThe right exists and it\u2019s subject to the framework in <em>Casey <\/em>that allows for regulation.\u201d<\/p>\n<p>She also mentioned a female witness in a case related to child sex crimes, an area of law where she has been accused of <a href=\"https:\/\/thefederalist.com\/2022\/03\/18\/yes-the-senate-should-investigate-ketanji-brown-jacksons-leniency-towards-sex-predators\/\">handing down light sentences<\/a> to child pornography offenders.<\/p>\n<p>\u201cI somehow still have nightmares about the main witness, the <strong>woman <\/strong>I mentioned earlier,\u201d Jackson said, demonstrating her ability to identify the woman\u2019s sex.<\/p>\n<p>She\u2019s also invoked the concept of womanhood to pat herself on the back for being nominated.<\/p>\n<p>\u201cI am humbled and honored to have the opportunity to serve in this capacity and to be the first and only black <strong>woman <\/strong>to serve on the United States Supreme Court,\u201d she said.<\/p>\n<p>And again: \u201cBecause I am a <strong>woman<\/strong>, because I am a black <strong>woman<\/strong>, all of those things people have said have been really meaningful to them.\u201d<\/p>\n<p>Yet again: \u201cHaving meaningful numbers of <strong>women <\/strong>and people of color, I think matters.\u201d<\/p>\n<p>And then three times in the same sentence: \u201cI gave a speech about black <strong>women <\/strong>in the civil rights movement, most of the speech if not all of the speech was focused on African American <strong>women<\/strong>, their contributions to the civil rights movement, unsung contributions in many cases, and then some of the more recent African American <strong>women <\/strong>who have made claims, who have done things in our society.\u201d<\/p>\n<p>She even acknowledged not just the existence of women, but the existence of men. \u201cWe believe that we have a government of laws and not men,\u201d she told senators. \u201cAnd yet there are men and <strong>women <\/strong>who are acting as judges in the context of our system.\u201d<\/p>\n<p>When she spoke of her own motherhood and her own daughters, she tacitly admitted the strong connection that the telos of motherhood has to womanhood. \u201cI know so many young <strong>women<\/strong>, in this country especially, who have small kids who have these momentous events and have to make a choice,\u201d she said of balancing career obligations with children\u2019s schedules.<\/p>\n<p>And after Blackburn questioned Jackson about an <a href=\"https:\/\/firstliberty.org\/wp-content\/uploads\/2022\/03\/Amicus-Brief-on-Behalf-of-NARAL-McGuire-v-Reilly.pdf\">opinion<\/a> she\u2019d signed referring to pro-lifers as \u201ca hostile, noisy crowd of \u2018in-your-face\u2019 protesters,\u201d Jackson referred to \u201c<strong>women <\/strong>who wanted to enter [abortion] clinics\u201d in her response. That opinion made five more references to a \u201cwoman\u201d or \u201cwomen.\u201d<\/p>\n<p>But that\u2019s not the only document in Jackson\u2019s legal record where she used the terms \u201cwoman\u201d and \u201cwomen\u201d and assumed there will be no confusion about what she meant. <\/p>\n<h2 id=\"34-plus-mentions-of-woman-or-women-in-judicial-opinions\">34-Plus Mentions of \u2018Woman\u2019 or \u2018Women\u2019 in Judicial Opinions<\/h2>\n<p>In her opinion in the case <em>Policy &#038; Research, LLC v. U.S. Department of Health &#038; Human Services<\/em>, Jackson <a href=\"https:\/\/casetext.com\/case\/policy-v-us-dept-of-health-human-servs?q=ketanji%20brown%20jackson%20women&#038;PHONE_NUMBER_GROUP=P&#038;sort=relevance&#038;p=2&#038;type=case&#038;tab=keyword&#038;jxs=\">referenced<\/a> \u201cprograms that seek to decrease the prevalence of teen pregnancy among eighteen- and nineteen-year-old African American and Latina <strong>women<\/strong>.\u201d<\/p>\n<p>She <a href=\"https:\/\/casetext.com\/case\/azadeh-v-govt-of-the-islamic-republic-of-iran-1?q=ketanji%20brown%20jackson%20women&#038;PHONE_NUMBER_GROUP=P&#038;sort=relevance&#038;p=2&#038;type=case&#038;tab=keyword&#038;jxs=\">used<\/a> the word \u201cwoman\u201d four times and the word \u201cwomen\u201d twice in <em>Azadeh v. Government of the Islamic Republic of Iran<\/em>. In <em>James v. United States<\/em>, she <a href=\"https:\/\/casetext.com\/case\/james-v-united-states-90?q=ketanji%20brown%20jackson%20woman&#038;PHONE_NUMBER_GROUP=P&#038;sort=relevance&#038;p=1&#038;type=case&#038;tab=keyword&#038;jxs=\">wrote<\/a> \u201cwoman\u201d 11 times.<\/p>\n<p>In <em>City &#038; County of San Francisco v. Azar<\/em>, Jackson <a href=\"https:\/\/casetext.com\/case\/city-cnty-of-sf-v-azar?q=ketanji%20brown%20jackson%20women&#038;PHONE_NUMBER_GROUP=P&#038;sort=relevance&#038;p=3&#038;type=case&#038;tab=keyword&#038;jxs=\">referred<\/a> to \u201cpregnant <strong>women<\/strong>,\u201d \u201cthe relationship between physicians and <strong>women <\/strong>seeking the abortion,\u201d \u201cthe obstacles <strong>women <\/strong>have in asserting their right to an abortion,\u201d \u201c<strong>women <\/strong>seeking abortions,\u201d and \u201ca <strong>woman <\/strong>seeking an emergency abortion,\u201d in addition to stating that \u201c<strong>women <\/strong>generally cannot safely secure abortions without the aid of physicians.\u201d<\/p>\n<p>In <em>Garcia v. Roberts,<\/em> she <a href=\"https:\/\/casetext.com\/case\/garcia-v-roberts-2?q=ketanji%20brown%20jackson%20women&#038;PHONE_NUMBER_GROUP=P&#038;sort=relevance&#038;p=2&#038;type=case&#038;tab=keyword&#038;jxs=\">wrote<\/a> about the \u201cmanner that bar admission rules in the nineteenth century unlawfully discriminated against <strong>women <\/strong>and African\u2013American applicants.\u201d<\/p>\n<p>\u201cPlaintiff Bukola Alibalogun (\u2018Alibalogun\u2019) is a <strong>woman <\/strong>of African descent,\u201d she <a href=\"https:\/\/casetext.com\/case\/alibalogun-v-first-coast-sec-solutions-inc-1?q=ketanji%20brown%20jackson%20woman&#038;PHONE_NUMBER_GROUP=P&#038;sort=relevance&#038;p=1&#038;type=case&#038;tab=keyword&#038;jxs=\">said<\/a> in <em>Alibalogun v. First Coast Security Solutions, Inc.<\/em><\/p>\n<p>She <a href=\"https:\/\/casetext.com\/case\/janellperry-v-colvin?q=ketanji%20brown%20jackson%20woman&#038;PHONE_NUMBER_GROUP=P&#038;sort=relevance&#038;p=1&#038;type=case&#038;tab=keyword&#038;jxs=\">introduced<\/a> a plaintiff similarly in <em>Perry v. Colvin<\/em>: \u201cPlaintiff, Janell Perry, is a 46-year old <strong>woman <\/strong>residing in Washington, DC.\u201d<\/p>\n<p>In <em>Beshir v. Jewell<\/em>, she <a href=\"https:\/\/casetext.com\/case\/beshir-v-jewell?q=ketanji%20brown%20jackson%20woman&#038;PHONE_NUMBER_GROUP=P&#038;sort=relevance&#038;p=2&#038;type=case&#038;tab=keyword&#038;jxs=\">explained<\/a> \u201cShirlean Beshir (\u2018Beshir\u2019 or \u2018Plaintiff\u2019) is an African\u2013American <strong>woman <\/strong>who was fifty-one years of age during the summer and fall of 2007.\u201d<\/p>\n<p><a href=\"https:\/\/casetext.com\/case\/austin-spearman-v-aarp-aarp-servs-inc?q=ketanji%20brown%20jackson%20woman&#038;PHONE_NUMBER_GROUP=P&#038;sort=relevance&#038;p=1&#038;type=case&#038;tab=keyword&#038;jxs=\">And<\/a> in <em>Austin-Spearman v. AARP &#038; AARP Services Inc.<\/em>: \u201cPlaintiff Ethel Austin\u2013Spearman is an internet savvy <strong>woman<\/strong>.\u201d<\/p>\n<p><a href=\"https:\/\/casetext.com\/case\/lawson-v-sessions-2?q=ketanji%20brown%20jackson%20woman&#038;PHONE_NUMBER_GROUP=P&#038;sort=relevance&#038;p=2&#038;type=case&#038;tab=keyword&#038;jxs=\">Again<\/a>, in <em>Lawson v. Sessions<\/em>: \u201cSheila Lawson is an African\u2013American <strong>woman <\/strong>who began her employment as a Special Agent (\u2018SA\u2019) with the FBI on October 15, 1995.\u201d<\/p>\n<p>In her <a href=\"https:\/\/casetext.com\/case\/campfield-v-commr-of-soc-sec?q=ketanji%20brown%20jackson%20woman&#038;PHONE_NUMBER_GROUP=P&#038;sort=relevance&#038;p=2&#038;type=case&#038;tab=keyword&#038;jxs=\">description<\/a> of plaintiff Geraldine Campfield in <em>Campfield v. Commissioner of Social Security<\/em>, Jackson wrote, \u201cAt the time of the alleged onset of her disability, Plaintiff was a 51-year-old <strong>woman<\/strong>.\u201d<\/p>\n<p>In <em>United States v. Georgieff<\/em>, she <a href=\"https:\/\/casetext.com\/case\/united-states-v-georgieff-1?q=ketanji%20brown%20jackson%20woman&#038;PHONE_NUMBER_GROUP=P&#038;sort=relevance&#038;p=1&#038;type=case&#038;tab=keyword&#038;jxs=\">noted<\/a> that defendant Jordan Georgieff had \u201cmarried a second <strong>woman<\/strong>, Dariana Borisova,\u201d while still married to his former wife.<\/p>\n<p>Jackson repeatedly <a href=\"https:\/\/casetext.com\/case\/rothe-dev-inc-v-dept-of-def?q=ketanji%20brown%20jackson%20women&#038;PHONE_NUMBER_GROUP=P&#038;sort=relevance&#038;p=2&#038;type=case&#038;tab=keyword&#038;jxs=\">referred<\/a> to \u201c<strong>woman<\/strong>-owned small businesses\u201d in her opinion in <em>Rothe Development, Inc. v. Department of Defense<\/em>.<\/p>\n<p>In <em>United States v. Hillie<\/em>, a child pornography case, the judge <a href=\"https:\/\/casetext.com\/case\/united-states-v-hillie?q=ketanji%20brown%20jackson%20woman&#038;PHONE_NUMBER_GROUP=P&#038;sort=relevance&#038;p=2&#038;type=case&#038;tab=keyword&#038;jxs=\">wrote<\/a> that \u201cCharles Hillie (who was born in November of 1983) became romantically involved with a <strong>woman<\/strong>.\u201d<\/p>\n<p>Repeatedly using a word she says she \u201ccan\u2019t\u201d define is not a good look for a potential Supreme Court justice.
